SWITCHGEAR/BREAKER REPLACEMENT
CHAIN-LINK FENCE
CENTRAL VALLEY PROJECT, CALIFORNIA
1. DEFINITIONS

2. BACKGROUND
At the Western “Tracy” substation yard (Western Switchyard), Reclamation has recently installed and tested:
• 13.8-kV Arc-Resistant switchgear assembly including four switchgears and corresponding switchgear buildings;
• Non-segregated phase bus duct;
• Structural steel supports and corresponding foundations;
• New panels skins, control boards, cables;
• New power and feeder cables, power cable trays and power cable splice cabinet;
• 125 VDC batteries, chargers and distribution panel;
• Uninterruptible Power System;
• 6-inch tubular rigid bus, structural steel supports and corresponding foundations; and
• Current Limiting Reactors (CLR), non-ferrous metal support system and corresponding foundations.
Due to the arc lengths possible at the CLRs, a new grounded 4-ft tall chain-link fence is required for safety purposes.
3. OBJECTIVES
Provide barrier from reactor and reactor’s electrical influence area and maintenance staff working in Western Switchyard boundaries. Improve safety in Western’s switchyard.
4. SCOPE
The Contractor shall furnish all necessary parts, labor, tools, transportation, supplies, supervision, equipment, materials and incidentals, and install approximately 540 linear feet of 4-foot tall gray color, galvanized metal chain-link fence, around three separate reactor groups, approximately 180 linear feet per reactor group. The chain-link fence shall tie into the east and west building walls. The south building wall has an electrical required clearance space that cannot be encroached into. See attached drawings for directional references. The fence shall be connected to the existing buried grounding system. Fence installation location has original ground with approximately 6” of loose gravel surfacing around all existing installations. After fence installation is complete, displaced gravel shall be relocated to its near original position and approximately level. Corner posts shall be required at obvious corner sets, end posts and supports at each of the gate locations (3 single-swing 4-foot wide x 4-foot tall gates).
There is an existing buried tunnel south of the buildings and north of the reactors. If the fence layout requires posts to be installed over the tunnel ceiling, the posts shall not puncture through the ceiling of the tunnel. The posts shall need to support loads, determined by the International Building Code. Any mechanical anchors cannot extend into the ceiling by more than 6-inches. Post locations over tunnel must miss concrete post in tunnel as indicated on drawings.
Warning signage shall be purchased and installed on each fence enclosure. Warning signage shall read “High Voltage Authorized Personnel Only”. The signs will be attached to each side of the fence enclosures approximately in the center and at all entrances.
Contractor shall install signs in accordance with Drawing 40-D-7095, Figure 3 without optional sticker.
Fence line shall be cleaned and prepared to make the fence line pad only. Staging of equipment and materials will be inside the Reclamation property fence line. The Contractor shall responsible for securing all materials and equipment after standard work hours.
5. SUBMITTALS
The Contractor shall submit shop drawings and project schedule submittals. Shop drawing submittals shall include all construction detailing to install the fence and connect to the grounding grid. There will be approximately 2 rounds of reviews of shop drawings. Project schedule submittal shall include a baseline schedule and, if requested by the COR, updated schedules. Submittal review time will be approximately 21 days, providing submittals and resubmittals are clear and address the Government’s concerns.
The Government will provide a submittal response to the Contractor as soon as the review is complete. Once the shop drawings are approved by the Government, using AutoCAD 2015 or newer, plans shall be required for delivery to the Government prior to construction completion.
Fence details should include, but not be limited to, plan view of installation, elevation view of the fence, installation of posts in foundation, connection of fence to existing building, fence component detailed connections and grounding details.

6. TYPE OF CONTRACT
The Government will award a Firm Fixed Price contract.
7. PERIOD OF PERFORMANCE
Onsite work to be performed and completed between January 2, 2017 and May 1, 2017. Work shall commence no later than two months from the date of contract award. The anticipated on-site construction window is approximately 14 days.
8. ADMINISTRATIVE INFORMATION
A. Federal Holidays:

6. Christmas Day-December 25
B. Hours of Operation:
Hours of Operations shall be between 7 am to 4 pm, Monday to Friday. No weekend or overtime work shall be allowed unless approved by the Contracting Officer. Any weekend or overtime work request shall be submitted to the Contracting Officer at least seven (7) calendar days prior to the requested effective date. No work shall be conducted during Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings.
C. Security:
The Contractor shall be responsible for securing all Contractor’s materials. No Security on-site. The Contractor Staging area is contained within the Reclamation’s Tracy Office extents. This space is enclosed by chain-link fence with an automatic gate requiring a pin code or authorization from Reclamation’s Tracy Office for entry. The Contractor shall be responsible for safeguarding Contractor’s property and materials, if left on-site after hours.
Construction staging and storage areas are available as shown on the drawings. A trailer will not be provided to the Contractor but the Contractor will have a space available for a trailer in the Contractor staging and storage area.
D. Outages:
To install the grounding of the fence, an outage shall be requested for the reactor and associated switchgear building. Each fence install will have a separate outage. Only one of the switchgear buildings at a time can be placed in outage status. The Contractor must submit written request to the Government at least ten (10) business days before date of each proposed outage. Include following in each request:
1. Area where work will be done (by number or other description).
2. Commencement time of work.
3. Duration of outage.
4. Number of personnel and their classification.
5. Description of equipment to be used.
Outage scheduling will depend upon power demand requirements and related operating conditions. Outages may be scheduled only during the work week between the hours of 7:00 am and 5:00 pm. Allowable time and available outage periods will govern outage requests, work scheduling, onsite delivery of materials, and required drawings and data submittals. Outages greater than 4 hours shall be shown in the construction schedule. Outages may be scheduled during off-peak periods. Government reserves right to schedule outages for any period during 24-hour day, any day of week. Usually these outages will start or end anywhere from Monday mornings to Thursday mornings during the day shift. The Contractor will be informed of restrictions and type of outages available during construction period.
E. Government-Furnished Items:
The Government will not provide any material, services, equipment, or facilities to the
Contractor except as noted herein. The Contractor may use existing facility hose water and restroom facilities as permitted by the Water Authority but is responsible for any damages that may result from operation of Contractor’s equipment.
Electric power may be obtained from the Government. This power will be available as single phase, 60 hertz, and alternating current at approximately 120/240 volts. No charge will be made for power obtained from this source. The Contractor shall supply, maintain and operate a portable generator, as needed, for installation per this Statement of Work.
F. Materials and Workmanship:
All material used shall be selected as the best available for the purpose for which used, considering: strength, ductility, durability, and best engineering practice.
All the fabrication shall be done in a thorough workmanlike manner, and shall follow the best modern practice in the manufacture of high-grade and standard requirements. All work shall be done by mechanics skilled in their various trades.
G. Notification:
The Contractor shall notify the Reclamation within 2 calendar days prior to delivery of parts or materials. The Contractor shall sign and accept all deliveries. Government employees are not responsible for any deliveries.
H. Place of Performance:
Work is located approximately 10 miles northwest of Tracy, California in Alameda
County. Appendix A provides the approximate location of work: Tracy Switchyard, 16550 Kelso Road, Byron, CA 95414. Location of work is located within Western Switchyard. To enter the facility, Contractor must use intercom at Reclamation’s automatic chain-link fence gate to be granted access.
I. Verification of Dimensions and Conditions:
A pre-proposal site visit will be held for this project. The Contractor is encouraged to visit the premises prior to submitting cost proposal to become thoroughly familiar with details of the work and working conditions, verify dimensions in the field, and calculate amount of material including cross-braces, fencing, and gates to be installed.
Estimates mentioned in this SOW are for information only and shall not be used for cost estimation by the Contractor. This is a firm fixed price contract and Contractor is not entitled to additional funds if the actual installations are above the Government estimated quantities as mentioned in this SOW.
J.Applicable Laws, Standards, and Codes:
Comply with all applicable laws, standards, codes and regulations while removing existing fence and installing new fence and gates on Reclamation property; including but not limited to the following:
1. International Building Code, 2015.
2. American Society of Civil Engineers, ASCE 7, 2010.
3. American Concrete Institute, ACI 318, 2014.
4. ASTM F587-14a, Installation of Chain-Link Fence.
5. Institute of Electrical and Electronics Engineers (IEEE), IEEE C2-2012.
6. National Fire Protection Association (NFPA), NFPA 70-2015.
7. List of Hazardous Materials (LHM) and Safety Data Sheets (SDS) on all proposed hazardous materials. (Toxic and Hazardous Substances, 29 CFR 1910.12)
8. Spill Prevention Control and Countermeasure Plan (SPCC) [Title 40 of the Code of Federal Regulations, Part 112, (40 CFR 112)].
9. The National Environmental Policy Act of 1969 (NEPA).
K. Warranty:
The Contractor shall warrant the material and workmanship, after final acceptance, against defects in workmanship and material for a period of not less than one (1) year.
Upon notice of the Government, the Contractor shall promptly replace or repair any part found to be defective during the warranty period.
The Contractor shall furnish the manufacturer’s warranty for purchased equipment. The warranty shall acknowledge the Reclamation as the owner.
L. Project Schedule:
The Contractor shall provide a schedule showing the major elements of work and work breakdown structure that include submittals, preliminary site investigation, fabrication and lead time on materials, and the anticipated onsite work. Clearly show your approach regarding completion of all work. Utilize MS Project or Primavera in developing a schedule, but also provide the schedule in PDF format.
The schedule shall cover the project duration, from Notice-To-Proceed to project close out. The schedule should follow the Critical Path Method (CPM) and indicated predecessors, successors, float, and durations for items of work.
Submission of the baseline schedule shall be within 14-days after contract award with updated schedules provided per COR request.
9. GENERALIZED TASKS
TASK 1 Locate existing underground grounding grid system. Approximate location of grounding grid is provided in attached drawings.
TASK 2 Locate chain-link fence posthole locations. Verify all postholes are clear of all underground obstructions.
TASK 3 Displace existing gravel along chain-link fence line. Install chain-link fence posts, fence, braces, and all associated connections. Install chain- link fence posts to connect to the existing buildings per approved shop drawings. Install grounding system to chain-link fence.
TASK 4 Install gate at approved locations. Install grounding system to chain-link fence gates.
TASK 5 Perform a resistance test of the ground grid to ensure ground grid resistance measures under 1 ohm.
TASK 6 Restore gravel to original placement.
10. SAFETY AND HEALTH
A. Submit the following Safety Program:
1. Written Safety Program in accordance with Section 3 of
Reclamation Safety and Health Standard (RSHS).
2. Cover all aspects of on-site and applicable off site operations and activities associated with this contract.
3. Follow the outline in Appendix B of RSHS.
4. Will not be accepted for review by the COR unless it addresses, in order, lettered and numbered per Appendix B, a narrative for each applicable item in the outline. Items that are not applicable to this contract shall be indicated by “Not Applicable” in the Safety Program
5. A generic Company Safety Plan is not acceptable. The Safety Program must be site specific for this contract.
B. Develop and Submit a List of Job Hazard Analyses for each distinct phase of work under the contract.
1. Work will not begin on the phase of work until a JHA is acceptable to Onsite Government Representative.
2. Activities involving hazardous materials shall have the appropriate Safety Data Sheet(s) attached to the JHA.
3. Under no circumstances will on site work, including mobilization, be permitted until the Safety Program has been considered acceptable by the Contracting Officer’s Representative.
4. Fully participate in a Contractor Safety Program Review meeting, according to RSHS Section 3.4.1, prior to mobilization. If applicable, include subcontractor management representatives.
5. In addition to requirements of the clause entitled “Accident Prevention”, fully comply with USBR RSHS.

7. Be cognizant of and ensure compliance with requirements set forth in paragraphs above. Contractor’s responsibility applies to all operations, including those of the Contractor’s Subcontractors.
8. When violations of safety and health requirements contained in these specifications or referenced standards are called to the Contractor’s attention by the Contracting Officer or the Contracting Officer’s Representative, immediately correct the condition to which attention has been directed.
Either oral or written notice shall be deemed sufficient. When the Contractor fails or refuses to promptly correct a compliance directive, the Contracting Officer or the Contracting Officer’s http://www.usbr.gov/ssle/safety/RSHS/rshs.html
Representative may issue an order to stop all or any part of the work. When satisfactory corrective action is taken, an order to resume work will be issued.
The Contractor shall not be entitled to extension of time, or to claim for damage or additional compensation by reason of either the directive or the stop order. Failure of the Contracting Officer or the Contracting Officer’s Representative to order discontinuance of any or all of the Contractor’s operations shall not relieve the Contractor of the responsibility for the safety of personnel and property.
9. Maintain an accurate record of, and report to the Contracting Officer’s Representatives in the manner prescribed by the Contracting Officer, all cases of death, occupational diseases, or traumatic injury to employees or the public involved, and property damage in excess of $2500 occurring during the performance of work under this contract.
10. The rights and remedies of the Government provided in this section are in addition to any other rights and remedies provided by law or under this contract.
11. In the event there is a conflict between requirements contained in USBR RSHS, specification paragraphs, Contractor’s approved Safety Program, referenced safety and health codes, and standards, or the U.S. Department of Labor Construction Safety and Health Standards, promulgated under Section 107 of the Contract Work Hours and Safety Standards Act (40U.S.C. 327 et seq.), as amended, the more stringent, applicable requirement shall prevail.
C. Contractor’s Onsite Safety Representative.
1. Designate an employee as the Contractor’s Onsite Safety Representative prior to start of construction. Designate competent supervisory employee with OSHA 30-hour safety training and experience.
2. The effectiveness of the Contractor’s Onsite Safety Representative in prosecuting the safety program will be subject to continued review and approval by the Contracting Officer. Should the Contractor’s safety effort be considered inadequate, the Contracting Officer has the option to require the Contractor to employ a full-time qualified Safety Professional.
3. Contractor’s Onsite Safety Representative is responsible for:
a. Effectively implementing the Contractor’s Safety Program
b. Correcting unsafe acts on the spot.
c. Being onsite during any and all construction activity.
d. Prepare safety inspection reports.
4. The effectiveness of the Contractor’s Safety Program will be subject to continued review and approval by the Contracting Officer.
D. Dust and Air Pollution Control
1. Use methods and devices to prevent, control, and otherwise minimize atmospheric emissions or discharges of air contaminants.
2. Do not operate equipment and vehicles that show excessive exhaust gas emissions until corrective repairs or adjustments reduce such emissions to acceptable levels.
3. Regulatory Requirements: Comply with Federal, State, and local laws and regulations, including those of the California Air Resources Board and San Francisco Bay Area Air Quality Management District.
4. Comply with RSHS. Conform to most stringent requirement in cases of conflict between specifications, regulatory requirements, and RSHS.
5. The CO may stop any construction activity in violation of Federal, State, or local laws and additional expenses resulting from work stoppage will be responsibility of Contractor.
6. Provide dust control and abatement as required during construction to keep emissions at or below required air quality levels.
7. Prevent, control, and abate dust pollution on rights-of-way during performance of work to prevent dust nuisance or damage to persons, property, agricultural activities, or wildlife habitats.
8. Provide means for eliminating atmospheric discharges of dust during mixing, handling, and storing of concrete materials.
9. Contractor shall be responsible for damages resulting from dust originating from Contractor operations in accordance with clause at FAR 52.236-7 “Permits and Responsibilities”.
10. Use pressure spray or distributor bar to apply water evenly. Apply water for dust abatement as directed by the COR.
E. Cleanup and Disposal
The Contractor shall keep the work site and staging area free from accumulation of waste material and rubbish during the contract. The work site shall be cleaned daily.
Before final acceptance of the project by the Government, the Contractor shall remove from Government land, all rubbish resulting from this work and deposit it in a State-approved sanitary landfill. Keep records of types and amounts of waste materials produced. Keep records of waste material disposal.
11. PERFORMANCE ASSESSMENT AND DISINCENTIVES
A. Monitoring Performance. During the course of the evaluation period, the COR will track Contractor performance. Interim (mid-term) evaluations may be provided to identify strengths and weaknesses in the Contractor’s performance during the period being evaluated.
At the end of the period, the COR will assess the Contractor’s performance in accordance with the Quality Assurance Surveillance Plan (QASP) and report to the Contracting Officer.
B. Contractor Self-Assessment. Following each evaluation period, the Contractor may provide a written self-assessment of its performance to the COR to be considered in its report to the Contracting Officer. The self-assessment shall be submitted not later than 5 working days after the end of each evaluation period. The self-evaluation shall not exceed 1 page per SOW element. The self-assessment shall address both the strengths and weaknesses of the Contractor’s performance during the evaluation period. Where deficiencies in performance are noted, the Contractor shall describe the actions planned or taken to correct such deficiencies and avoid their recurrence. The self-assessment itself will NOT be the basis for the Disincentives determination.
C. COR Recommendation. The COR will consider all evaluations and any other pertinent information, including Contractor self-assessment, and will prepare a report to the Contracting Officer with findings and recommendations. The Contractor will be provided a copy of the draft findings and recommendations of the COR and will be afforded the opportunity to identify factual errors. The COR’s draft recommendation is not subject to negotiation and the COR will not engage in discussions with the Contractor. Any errors identified by the Contractor will be addressed by the COR in its final report. The Contractor will be provided a copy of the final COR report at the same time the report is submitted to the Contracting Officer.
D. Payment Determination. The Contracting Officer may meet with the COR to discuss the COR’s report. The Contracting Officer will make a final determination in writing as to the percentage of work successfully completed, and the resulting payment to be made. A copy of the determination will be provided to the Contractor no later than 45 calendar days after the end of the period being evaluated. All Contracting Officer decisions regarding Disincentives are unilateral decisions made solely at the discretion of the Government.
E. Deduction. Notwithstanding any other clause of this contract, deduction of the Disincentive will be made within the later of 60 days after the end of the evaluation period or 30 days after receipt of an approved invoice.

COMPLETION OF WORK
The Contractor shall be required to
(a) commence work under this contract within 14 calendar days after the date the Contractor receives the notice to proceed,
(b) prosecute the work diligently, and
(c) complete the entire work ready for use not later than 120 calendar days after the date the Contractor receives the notice to proceed. The time stated for completion shall include final cleanup of the premises.
FAR 52.211-12 LIQUIDATED DAMAGES – CONSTRUCTION SEP 2000
(a) If the Contractor fails to complete the work within the time specified in the contract, the Contractor shall pay liquidated damages to the Government in the amount of $1,700 for each calendar day of delay until the work is completed or accepted.
(b) If the Government terminates the Contractor’s right to proceed, liquidated damages will continue to accrue until the work is completed. These liquidated damages are in addition to excess costs of repurchase under the Termination clause.

OF RECLAMATION
(a) Prior to the Contractor starting work, a post-award conference (as described in FAR Subpart 42.5), will be convened by the contracting activity or contract administration office. The Contractor's Project Manager shall attend the conference. If the contract involves subcontractors, a representative of each major subcontractor is also required to attend.
(b) The conference will be held at the Mid-Pacific Regional Office, 2800 Cottage Way, Sacramento, California 95825-1898.
(c) The Contracting Officer and the Contractor will agree to the date and time of the conference after award of the contract. In event of a conflict in schedules, the Contracting Officer shall establish the date for the conference.
(d) The Contractor shall include any associated costs for attendance at the conference, in its offer.
G.3 DIAR 1452.201-70 AUTHORITIES AND DELEGATIONS SEP 2011
(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.
(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award. The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.

(c) The COR is not authorized to perform, formally or informally, any of the following actions:
(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;
(2) Waive or agree to modification of the delivery schedule;
(3) Make any final decision on any contract matter subject to the Disputes Clause;
(4) Terminate, for any reason, the Contractor's right to proceed;
(5) Obligate in any way, the payment of money by the Government.
(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum. The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause.
(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.
(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the
COR.
(g) Any action(s) taken by the Contractor, in response to any direction given by any person acting on behalf of the Government or any Government official other than the Contracting Officer or the COR acting within his or her appointment, shall be at the Contractor's risk.
G.4 DOI-AAAP 0028 ELECTRONIC INVOICING AND PAYMENT
REQUIREMENTS - INVOICE PROCESSING PLATFORM
(IPP) – TREASURY ELECTRONIC INVOICING SYSTEM
(APR 2013)
Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP).
"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract. The IPP website address is: https://www.ipp.gov.
Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice:
Contractor shall upload an electronic copy of the invoice, along with any supporting documentation, to the IPP website. To assist in the payment process, contractors shall send a courtesy copy of the IPP invoice electronically along with below mentioned documents, with attention to the Contracting Officer, to the following email address: ktucker@usbr.gov the same day the IPP invoice is submitted online.

6. Name and address of contractor official to whom payment is to be sent (must be the same as that in the contract or in a proper notice of assignment);
7. Name, title, phone number, and mailing address of person to be notified in event of a defective invoice;
8. Substantiation of the amounts requested and certification in accordance with the requirements of FAR clause 52.232-5, Payments Under Fixed-Price Construction Contracts; and
9. Listing of total amount of each subcontract under the contract and amounts previously paid to each subcontractor under the contract.
The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in CCR) will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) within 3-5 business days of the contract award date. Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email ippgroup@bos.frb.org or phone (866) 973-3131.
If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.
Invoices must be submitted via IPP in order to be properly processed within the payment terms set forth under this contract.

H.1 DIAPR 2000-1 – NON DISCRIMINATION NOTICE TO U.S. DEPARTMENT OF
THE INTERIOR CONTRACTORS, SUBCONTRACTORS, AND LESSORS (DEC 1999)
Based upon law, Executive Order, or internal policy, the Department of the Interior prohibits discrimination in the workplace, including sexual harassment, based on race, color, national origin, sex, religion, disability, age, or sexual orientation. The Department urges its contractors, subcontractors and lessors to develop and enforce comprehensive anti-discrimination policies for their places of work.
H.2 ET 02-20 AUTHORIZED WORKERS NOTICE TO POTENTIAL BUREAU OF
RECLAMATION CONTRACTORS (SEP 2002)
(a) Definitions.

(a) Authority. Immigration Reform and Control Act of 1986 (8 USC 1101 as amended) and the Immigration and Nationality Act, Section 274A.
(b) Who is Covered. INA includes provisions addressing employment eligibility, employment verification, and nondiscrimination. These provisions apply to all employers, including government contractors.
(c) Basic Provisions/Requirements. Under IRCA, employers may hire only persons who may legally work in the U.S., i.e., citizens and nationals of the U.S. and aliens authorized to work in the U.S. The employer must verify the identity and employment eligibility of anyone to be hired, which includes completing the Employment Eligibility Verification Form (I-9). Employers must keep each I-9 on file for at least three years, or one year after employment ends, whichever is longer. Detailed guidance on the I-9 is available at the INS web site:

(d) Employment Verification Pilot Programs. The INS and the SSA are conducting the following programs that provide employers a way to confirm the employment eligibility of their newly hired employees. Any employer located in a pilot state may volunteer to participate in a pilot program. If employers are not located in a pilot state, they would verify employment eligibility by following the procedures currently in place, i.e., by completing Form I-9.
(1) The Basic Pilot is a joint pilot being conducted by the INS and SSA in the States of California, Florida, Illinois, Nebraska, New York, and Texas. This pilot involves verification checks of the SSA and INS databases of all newly hired employees, regardless of citizenship. (2) The INS is conducting the Citizen Attestation Pilot in the States of Arizona, Maryland, Massachusetts, Michigan, and Virginia. The Citizen Attestation Pilot permits participating employers to electronically verify the employment eligibility of newly hired alien employees by using a personal computer with a modem. (3) The INS and the SSA are conducting the Machine-Readable Document Pilot in the State of Iowa. The Machine-Readable Document Pilot is identical to the Basic Pilot in all respects, except http://uscis.gov/graphics/services/employerinfo/index.htm for the geographic scope of the pilot and for one additional feature. If an employee presents an Iowa's driver's license or identification card containing a machine-readable SSN, the employer will make an inquiry through the confirmation system by using the machine-readable feature. (e) Employee Rights. The INA protects U.S. citizens and aliens authorized to accept employment in the U.S. from discrimination in hiring or discharge on the basis of national origin and citizenship status.
(f) Compliance Assistance. More detailed information, including copies of explanatory brochures and regulatory and interpretative materials, may be obtained from local offices of the Department of Labor's Employment Standards Division, Wage and Hour Division, and the Office of Federal Contract Compliance Programs.
(g) Penalties/Sanctions. Employers who fail to complete and/or retain the I-9 forms are subject to penalties. The INS enforces the INA requirements on verification of employment eligibility. The Justice Department enforces the anti-discrimination provisions. As part of their ongoing enforcement efforts, the ESA's Wage and Hour Division and Office of Federal Contract Compliance Programs conduct inspections of the I-9 forms. They report their findings to the INS and to the Department of Justice when they find cases of disparate treatment or unauthorized employment. A debarring official may debar a contractor, based on a determination by the Attorney General of the United States, or designee, that the contractor is not in compliance with the INA. The Attorney General's determination is not reviewable in the debarment proceedings.
