Date: April 27, 2016

1. GENERAL DESCRIPTION: The Blanket Purchase Agreement (BPA) Holder/Contractor shall provide all necessary and qualified personnel, facilities, equipment, transportation and materials required to provide Laboratory Analysis for Low-Level Selenium Sampling Services to Water, Soil, Vegetation, and Tissue Samples. The BPA Holder/Contractor shall ensure that good business and management practices are followed in performing the ordered services, such that the Government receives the greatest value for the services provided.

2. TYPES OF SERVICES: This Blanket Purchase Agreement (BPA) shall cover requirements for laboratory analysis for low-levels of selenium to water, soil, vegetation, and tissue samples in accordance to the tests outline in the pricing schedule. The samples may be collected throughout the states of California, Oregon and Nevada.

3. PRODUCTS: U.S. Bureau of Reclamation (USBR) will be responsible for supplying and delivering the samples to the BPA Holder/Contractor. The Contractor shall analyze the samples using approved EPA or other approved methods and report the results of the analysis to Reclamation. See the Pricing Schedule for more information.

4. LOCATION OF SERVICES: Samples shall be collected from California, Oregon and Nevada by Reclamation and delivered to the BPA/Contractor(s) facility.

5. GENERAL REQUIREMENTS:

a. In order to receive an award the laboratory must be approved by Mid-Pacific Region’s Environmental Office MP-156. Approval will include but not be limited to passing a Quality Assurance Audit (Attachment 2A), receiving an acceptable review of the laboratory’s QA Manual, round-robin performance evaluation samples, and reporting limits.

b. The laboratory must analyze USBR samples in the batches requested on the Chain of Custody.

c. The laboratory must follow the USBR QA section guidelines for re-analysis:

i. The USBR QA section will incorporate blind external QA samples as an external laboratory check.

ii. If the laboratory is unable to obtain an acceptable result(s) on the external QA samples(s) for the original analysis, the QA section will request re-analysis of the external QA sample(s). The re-analysis request will provide a confirmation range and a bracket of samples to re-analyze if the laboratory cannot confirm the original result.

iii. If the laboratory confirms the original result(s), USBR will pay for the re-analysis. If the laboratory does not confirm the original result, there will be no charge to USBR for the re-analyzing of the sample(s).

iv. If the laboratory does not confirm the original result, the laboratory must re-analyze the bracket of samples at no additional cost to USBR.

d. To meet the required turn-around times, the laboratory is responsible for assessing whether or not re-analysis confirmed the original result and requesting additional bracket analysis.

e. The laboratory must meet the following turn-around times:

i. Initial analysis – 3 week turn-around time.

ii. 1st set of re-analysis – 2 week turn-around time.

iii. 2nd set of re-analysis – 1 week turn-around time.

f. The laboratory must analyze samples within the required holding time. If the laboratory does not analyze the samples within the required holding times and re-sampling must occur, the laboratory must analyze the re-sampled samples at no cost to USBR and must analyze the re-sampled samples with a one week turn-around time.

g. The laboratory must provide Level 1 certified bottles for all sampling events upon request. The bottles must be pre-preserved using the appropriate preservative for the analysis.

h. The laboratory shall participate in annual performance testing studies and demonstrate acceptable analytical performance by analyzing the samples for these studies.

i. The contractor shall submit one copy of the written laboratory analysis data report or a Work-compatible electronic copy of the report to:

Environmental Monitoring Branch, MP-156 Bureau of Reclamation 2800 Cottage Way Sacramento, CA 95825

j. The contractor shall be capable of providing analysis 0001 – 0007 listed on the pricing schedule.

k. The laboratory shall not charge USBR for the performance evaluation samples submitted by USBR as part of the audit.

l. All laboratory analysis must be conducted in-house. The laboratory may not sub-contract USBR samples for analysis without approval from the USBR QA section.

15. PERFORMANCE BASED PLAN:

a. Monitoring Performance: During the course of the evaluation period, the COR will track Contractor performance. Interim (mid-term) evaluations may be provided to identify strengths and weaknesses in the Contractor's performance during the period being evaluated. At the end of the period, the COR will assess the Contractor's performance in accordance with the Quality Assurance Surveillance Plan (QASP) and report to the Contracting Officer.

b. Contractor Self-Assessment: Following each evaluation period, the Contractor may provide a written self-assessment of its performance to the COR to be considered in its report to the Contracting Officer. The self-assessment shall be submitted not later than 5 working days after the end of each evaluation period.

The self-evaluation shall not exceed 1 page per PRS element. The self-assessment shall address both the strengths and weaknesses of the Contractor's performance during the evaluation period. Where deficiencies in performance are noted, the Contractor shall describe the actions planned or taken to correct such deficiencies and avoid their recurrence. The self-assessment itself will NOT be the basis for the payment determination.

c. COR Recommendation: The COR will consider all evaluations and any other pertinent information, including Contractor self-assessment, and will prepare a report to the Contracting Officer with findings and recommendations. The Contractor will be provided a copy of the draft findings and recommendations of the COR and will be afforded the opportunity to identify factual errors. The COR's draft recommendation is not subject to negotiation and the COR will not engage in discussions with the Contractor. Any errors identified by the Contractor will be addressed by the COR in its final report. The Contractor will be provided a copy of the final COR report at the same time the report is submitted to the Contracting Officer.

d. Payment Determination: The Contracting Officer may meet with the COR to discuss the COR's report. The Contracting Officer will make a final determination in writing as to the percentage of work successfully completed, and the resulting payment to be made. A copy of the determination will be provided to the Contractor no later than 45 calendar days after the end of the period being evaluated. All Contracting Officer decisions regarding payment calculations are unilateral decisions made solely at the discretion of the Government.

e. Deduction: Notwithstanding any other clause of this contract, payment calculations will be made within the later of 60 days after the end of the evaluation period or 30 days after receipt of an approved invoice.

f. The Quality Assurance Surveillance Plan is one evaluation method the government uses to perform surveillance to determine whether the Contractor meets the standards of performance as defined in the PWS. The absence of a QASP for any contract requirement, however, shall not detract from its enforceability or limit the rights or remedies of the government under any other provision of the contract in determining the quality of the Contractor performance.
