SECTION 1. INTRODUCTION AND INSTRUCTIONS TO RESPONDENTS

1.1 INTRODUCTION

The County of Orange (County), consisting of 22 agencies and departments, and the Orange

County Flood Control District (District) deliver a broad range of services to the residents of Orange

County. Services provided include public protection, public health, infrastructure maintenance, and community and social services. As the District relies on County staff to carry out its duties, the District will also be included as a party to any contract(s) resulting from this solicitation. It is the primary responsibility of the County’s public works department (OC Public Works) to enrich the community through efficient delivery and maintenance of public works infrastructure, planning, capital improvement and development services.

OC Public Works intends to pre-qualify firms to provide services for Architect-Engineer (A-E) and A-E related County-wide and District-wide services for their various maintenance and capital projects. To satisfy this need, this Request for Qualification (RFQ) process will enable the County to establish Qualified Vendor Lists (QVL) for A-E disciplines to provide those services. The

Qualified Vendor List (QVL) will be established through this (RFQ) process and will result in

Board of Supervisors awarded contracts with a term of three (3) years. At the conclusion of the contract term, the County may issue a new solicitation to provide additional Contractors the opportunity to compete for future services

The County reserves the right, at its sole discretion, to make multiple awards to respondents for services requested in this solicitation.

ORDERS

This RFQ is issued as a fully electronic solicitation. Respondents must submit their Statement of

Qualifications (SOQ) through the County’s eProcurement Portal. Only electronic submissions will be accepted. Submissions by facsimile or email will not be accepted.

1.5 EVALUATION PROCESS AND CRITERIA

An evaluation panel will conduct evaluations of the SOQs submitted through the RFQ process.

The committee will consider the information supplied by Respondents. If it finds a failure or deficiency in the SOQ or any information provided in connection thereto, the evaluation panel may reject said SOQ or information or reflect the failure or deficiency in the evaluation.

The County may request clarifications, or otherwise verify the contents of the SOQ, including information about the Respondent, consultants, and sub-consultants. County reserves the right to seek publicly available information about the Respondents.

http://www.dnb.com/ http://www.usfcr.com/ https://hrs.oc.gov/employee-relations/employee-resources

The evaluation panel will rank the responding Consultant SOQs and develop a shortlist of firms to be placed on the Qualified Vendor List (QVL). At the discretion of the evaluation panel and based on evaluation results and County needs, top-ranked consultants from that QVL may be issued contracts, which may require County Board of Supervisors approval.

Note that once the QVL is established, at the time Consultants are chosen for specific projects, different scoring criteria may be applied to determine the successful consultant for the specific project under consideration. These criteria may include, but are not limited to, project specific considerations, interviews, evaluation of references, negotiations, and past projects.

Proposals deemed to meet all minimum RFQ requirements will be scored based on the established criteria, and will be assigned points that measure the responsiveness to each identified criterion. The total number of points earned will be tallied for each Proposal, based upon the Respondent(s) submitted written materials.

Proposals shall be evaluated by an Evaluation Panel of subject matter experts on the basis of the responsiveness to the requirements in this RFQ. The County may request clarifications, or otherwise verify the contents of the Proposal, including information about the Respondent, Contractors and sub-contractors. The County reserves the right to seek publicly available information about the Respondents.

The scoring is based on evaluation of the Proposal as measured against the Scoring Criteria.

Proposals will be evaluated from the most advantageous to the least advantageous to the County.

*Please note: These minimum qualifications must be verified for the Proposal to be deemed responsive. Any Proposal may be construed as non-responsive and ineligible for consideration if it does not comply with the requirements of the RFQ.

A. Minimum Qualifications/Requirements:

Respondent’s SOQ shall meet the following minimum requirements and qualifications to proceed to the evaluation and scoring process:

Respondent must possess the following credentials and certifications listed below:

1. The Respondent must have the ability to do business in Orange County, California;

2. The Respondent will have conducted business in California for a minimum of three

(3) years;

3. The Respondent must have conducted similar work as is being requested in this SOQ;

4. The Respondent must possess a valid Licensed Land Surveyor or pre-January 1, 1982, Registered Civil Engineer license in the state of California.

B. Written SOQs Scoring Format

See the WRITTEN SOQ SCORING FORMAT section for scoring criteria and points.

* NOTE: RESPONDENTS SUBMITTING EXCEPTIONS TO THE COUNTY MODEL

CONTRACT LISTED IN SECTION III OF THIS RFQ, SHALL RECEIVE A SCORE OF

“0” FOR THIS CRITERIA.

SOQs deemed to meet all minimum RFQ requirements shall be scored based on the established https://procurement.opengov.com/portal/ocgov/projects/270340/document?section=2604939 criteria, which have been weighted and will be assigned points that measure the responsiveness to each identified criterion. The total number of points earned will be tallied for each SOQ, and the SOQs will be ranked in order, based upon the Respondent(s) submitted written materials.

Any inquiry to determine the responsibility of a Respondent to this RFQ may be conducted.

Respondent agrees that the submission of a SOQ is permission by Respondent for County to verify all information contained therein. If County believes it necessary, additional information may be requested from Respondent. Failure to comply with any such request may disqualify a

Respondent from further consideration.

1.6 SELECTION/AWARD PROCEDURES

Upon the completion of the evaluation process, the evaluation panel will make a recommendation for a shortlist of qualified consultants (“QVL”) to the County DPA. At the time services are required, a contract may be issued to a QVL consultant. Upon recommendation for placement on the QVL, consultants will be required to submit a fee schedule, which shall remain for the full term of the QVL. The County reserves the right to negotiate this fee schedule. Final award determination or placement on the QVL shall be subject to successful negotiations, reference checks, and past performance.

At the time A-E services are required, a contract up to Board threshold may be issued to a QVL consultant by negotiating project cost and scope of work independently upon each contract approval. Also based on evaluations and County needs, contracts over the Board threshold may also be awarded to a QVL consultant but will require Board of Supervisors approval.

Upon the completion of the evaluation process, the Evaluation Committee will make a recommendation for an award to DPA. Final award determination shall be subject to reference checks and past performance and may be subject to approval(s) by the County Board of

Supervisors. In addition, County reserves the right to verify and validate any information prior to the Contract Award and during the entire term of the Contract.

The Model Contract contained in Section III of this solicitation is a sample of a contract which may be proposed for execution. It may be modified to incorporate negotiated items and other pertinent terms and conditions set forth in this solicitation, including special conditions and requirements and those added by addendum and necessary attachments and/or exhibits and to reflect the Respondent’s SOQ and qualifications.

Each selected Respondent may enter into a multi-year contract with the County. After award of contract as each project is identified, the awarded firm within the required discipline(s) will be requested to submit cost/fee schedule.

No guarantee is expressed or implied as to the total services to be purchased under this RFQ.

Award of a consultant does not guarantee any future work to be awarded.

In the event a firm is selected for a specific project, the selected firm will be required to negotiate and execute an agreement with the County, which agreement may require County Board of

Supervisor approval.

Inquiries may or may not be conducted with the finalists; therefore, the SOQs submitted should contain Respondent's most favorable terms and conditions, since the selection and award may be made without further discussion. Exceptions to the terms and conditions of the proposed

Contract or the statements regarding Respondent’s inability to comply with any of the provisions thereof are to be declared in the response to the RFQ in Section II, Part 1, H.

“Statement of Compliance”.

F. Negotiate the final Contract with any Respondent(s), including pricing/fee schedule, as necessary to serve the best interests of the County;

SECTION 3. SCOPE OF WORK

3.1 INTRODUCTION

OC Public Works, on behalf of the County of Orange (County) and Orange County Flood

Control District (District), requires supplemental professional services to meet workload demands and project scheduling commitments in relation to Architect-Engineer (A-E) Design, Project Administration and Management Services for various projects. A-E is defined as an

Architect or Engineer for design and/or engineering of a project. To supplement existing resources, County intends to issue QVL FOR LAND SURVEYING SERVICES - TASK

ORDERS for use by County and District on an "as-needed" basis. No specified amount of work is guaranteed to Respondent.

3.2 GENERAL DESCRIPTION OF SERVICES

The Respondent will be contacted by County Project Management staff on an “as-needed” basis as projects arise to provide A-E services for professional services. Requirements will be discussed by the Parties and Respondent shall prepare a written Scope Statement that will include the specific work to be performed, including the costs and time required to complete the project/task. County

Project Management staff will then review the Respondents’ Scope Statement, proceed with negotiation of task costs and when satisfied, issue a Contract Task Order (CTO) against this

Contract.

The Respondent shall restrict themselves to the Scope Statement of the Contract Task Order. Any changes in the Scope Statement shall require prior written authorization by County.

3.3 CONTRACT TASK ORDER

Respondent shall be assigned work via a task order by County which shall subsequently be referred to as the “Contract Task Order” (hereinafter “CTO”). A CTO for each project shall be developed by Respondent in conjunction with County Project Management staff. The County Project

Manager shall manage all Respondent’s work including monitoring the CTO work schedule, quality of deliverables, review of invoiced amounts, adherence to set budget, and internal review of submittal packages. Respondent shall follow all requirements as outlined in the CTO; this general Scope of Work, the project specific Scope Statement, and the Architect-Engineer Guide

(Rev July 2018).

The CTO shall include a detailed Scope Statement, describing tasks to be performed with a specific list of deliverables for each task, schedule of work and cost to complete the work. The schedule of work shall allow enough time for meetings with County Management staff to review the work progress, provide technical and policy direction, resolve problems and ensure adherence to the work completion schedule. The CTO shall include a cover sheet provided by County Project

Management staff with the appropriate signature blocks and contract information. Once both

Parties agree, and all Parties have signed the CTO, County Management staff shall provide

Respondent with a Notice to Proceed (NTP) to begin work. Respondent shall submit all plans, reports and other documents produced under the CTO to the assigned County Project Manager within the timeframe indicated in the CTO or as directed by County Project Management staff.

3.4 STANDARDS & MINIMUM QUALIFICATIONS FOR LAND SURVEYING

FIRMS

Surveyors' Act (PLSA). In accordance with the Act, "responsible charge" for the work shall reside with a Licensed Land Surveyor or a pre-January 1, 1982, Registered Civil Engineer, in the

State of California. Unless otherwise specified, conventional control surveys shall conform to second-order Class I (modified) accuracy standards as specified by the County. All services and deliverables shall be in compliance with the most current Orange County Surveyor

Procedure Standards Manual, a copy of which will be provided here.

The minimum standard of survey quality shall be that of similar surveys performed by the

County, such that:

• All "found" and "set" monuments must be turned through from two or more control stations.

• If monuments cannot be set due to construction, obstructions, etc., then offset monuments must be set as agreed upon by the County.

A-E shall own equipment sufficient to provide services to meet the required accuracy standards and have personnel qualified to perform the required services. A-E will have land surveying as the primary focus of their business or have a division within a larger firm that can provide land surveying services.

All surveying services work performed must comply with the State of California requirements described in Article 5 of the Professional Land Surveyors' Act.

3.5 SERVICES

Professional and technical land surveying services will potentially require professional oversight, field survey operations and office computation/drafting work to support the development, construction, improvement, and maintenance of existing and/or future projects located in, or the responsibility of, the County of Orange, the Orange County Flood Control District, and other contract agencies. All Services and Deliverables will be in compliance with the most current

Procedures & Standards Manual(s) of those contracting organizations.

Required services shall include, but are not limited to:

A. Records Research

County will provide title reports with supporting documentation (some title reports may cover more than one parcel). A-E shall be responsible for researching and obtaining copies of any additional records necessary for surveying, resurveying, mapping, and preparing legal descriptions and title investigations. One copy of each record obtained shall be provided to

County.
