Questions and Answers
Q: In Attachment 4 (Wage Determinations) under the “ALL OCCUPATIONS LISTED ABOVE RECEIVE THE FOLLOWING BENEFITS:” It discusses Health and Welfare and Vacation. Does this mean that the employees we have working this site will be covered with Health Insurance and if they go on vacation or have some time off is that being covered (pending they have worked for a year).
Your Job Description is stated that you are looking for Level 2 Armed Security Guards, so does that mean when looking at the “Wage Determination” sheet that we are titles under “27102 – Guard II” at the rate of $21.32? There is another section that states that Guard II rate is at $16.31, we just wanted to ensure we have the right quote. And I’m assuming that would be both the Davis Bacon Act with the Fringe, is that correct?
A: This solicitation and resulting contract includes the McNamara-O’Hara Service Contract Act (SCA). Under this act, any contractors or subcontractors performing services under a contract that includes SCA, are required to pay service employees no less than wage rates and fringe benefits found prevailing in the locality, or the rates (including prospective increases) contained in a predecessor contractor's collective bargaining agreement. The wage determinations that are attached to the solicitation cover all counties within the State of Colorado. The sites covered under this contract will include both fixed sites (tentative Pueblo, CO) and mobile sites. Because the route is not yet confirmed for the mobile sites the wage determinations were included for all Colorado counties. Once the mobile route has been confirmed, the associated wage determination for that county would apply for any services being performed under this contract within that specific area. The Davis Bacon Act does not apply for this requirement. The Davis Bacon Act is only applicable for construction contracts exceeding a certain dollar threshold. I have included the link to the U.S. Department of Labor, which provides more guidance on Wage Determinations. https://www.dol.gov/agencies/whd/government-contracts/service-contracts
Q: I have not found anywhere on any of the forms that state how many Security Guards are needed, what the hours are and for what days.
A: This contract will be issued as a Labor Hour contract as the exact schedule and posts are unknown at this time. The Contracting Officer Representative (COR) will be responsible for issuing post and/or task orders. Please refer to section 4.3 of the Statement of Work (SOW) for further details.
The tentative plan, although subject to change, is for 2 security officers for the night shift, and between 4-6 security officers during the day, dependent on the needs of the community with potentially one of those positions requiring travel within the County of Pueblo.
