Quality Assurance Surveillance Plan (QASP for DLA Disposition Services Continental United States (CONUS) Performance-Based Material Handling Equipment (MHE) Maintenance

1. Purpose:

This document is to provide guidance on administering subject contracts such that the best possible quality in performance can be assured through appropriate surveillance and addressing of any performance failures as appropriate. The Acceptable Performance Level (APL) is the standard the U.S. Government (USG) expects the contractor to meet throughout the life of the contract. In general, the DLA Disposition Services MHE Maintenance contract will have two APLs that will be used to measure contractor performance though additional ones may be identified depending on the contract requirements. The standard APLs are timely preventive maintenance of all equipment and timely completion of minor repairs.

2. Acceptable Performance Levels:

a. Timely and Complete Preventive Maintenance (PM)
(i). “item” in the standard and APL column means a single piece of MHE.
(ii). The APL is measured per quarter.
b. Timely and Complete Corrective Maintenance (CM)
(i). “item” in the standard and APL column means a single piece of MHE.
(ii). The APL is measured throughout the contract performance period.

3. Surveillance:

a. The primary method of surveillance for evaluating compliance is by Contracting Officer’s Representative (COR) reporting. The COR is responsible for reporting preventive maintenance performance to the Contracting Officer (KO) promptly after the performance deadline has passed. The COR will provide when the action was required to be performed by the contractor and the date it occurred. The COR shall also include what the negative impact of the contractor’s failure to meet the APL was on the DLA Disposition Services site.
b. In instances where there are late completions of PM or CM, the COR shall determine if the late performance is caused by an occurrence beyond the reasonable control of the contractor and without its fault or negligence such as, acts of God or the public enemy, acts of the USG either its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, unusually severe weather, and delays of common carriers. In such cases as there is an excusable delay, the contractor will be deemed to have made the APL for the period.

4. Reduction for Failed APL:

a. Throughout each performance period of the contract, including options, the contractor is allowed one failure of the preventive maintenance APL and one failure of exceeding the 3 late repairs. After the failures the KO may take consideration for each additional instance of the contractor not meeting the APL. As indicated in the APL matrix, the reduction for failure to meet APLs is the same in all performance areas. The 5 - 100% consideration available is broad to give the contracting officer full latitude to take consideration based on the effect of the non-compliance on site operations and frequency of not meeting the APLs.
b. If valid failure to meet an APL is identified and consideration is warranted considering the pertinent facts, consideration is taken against the value of the preventive maintenance or repair for the item. Consideration is taken against the individual value of the maintenance or repair which is late.
c. In addition to the consideration and past performance annotation remedies available to the KO under the APL Matrix, the government may use such measures as partial or full terminations under FAR 52.212-4, not exercising options, and ending a contract early without these measures as long as it is IDIQ and has met its minimum government obligation for the period and a plan for a timely replacement contract is secured.
