1.1.2 Materials/Parts. Descriptive data of all contractor-furnished materials/parts to be used under this contract shall be submitted for approval via a material submittal AF Form 3000. The data shall be supported by the manufacturer’s catalog cuts, product number, patent number, certificate of compliance, etc. to demonstrate equal or better quality of the original or genuine parts. Safety Data Sheets (SDS) in both English and German shall be attached to AF Form 3000 for any chemicals and hazardous materials to be used as well. To the highest extent possible, chemicals should be environmentally friendly and not require any special treatment process.
Unless changing during the life of the BPA (e.g. a change in the chemicals used), these documents will only be required to be submitted once, within 30 days of the BPA establishment, to the Contracting Officer (CO) and Contracting Administrator (CA) for forwarding to the Civil Engineering Squadron.
Any hazardous material stored on the AF installation has to be stored in approved storage containers in accordance with Wasserhaushaltsgesetz (WHG), and FGS-Germany, Chapter 5 “Hazardous Material”, and Chapter 9 “Petroleum, Oil, and Lubricants”. The contractor shall remove all hazardous materials by the end of each work day. The contractor shall not conduct process treatments (e.g. paint thinner solvent recycling) on base.

Unless specifically stated otherwise, each performance period will be coordinated with the individual who placed the call (either the Contracting Officer’s Representative (COR) or Contract Administrator (CA)), beginning on the calendar day the call is accepted by the contractor and concluding with the submittal of a final report (see section 3.2.1).
1.2.1 Work Schedule. The contractor shall establish a planned work schedule and submit it to the individual who placed the call (either the COR or the CA) within seven (7) calendar days of a call, unless otherwise agreed to during the call.

One (1) year after award of the BPA, or earlier if desired by the Contractor, the Contracting Officer shall request an update to Price Schedules. There is no requirement nor obligation, to update or not update Price Schedules at any point. Updated Price Schedules will, however, require the Contracting Officer to re-establish a determination of fair and reasonable pricing prior to issuing further calls to the subject BPA holder. Contractors are requested to maintain firm Price Schedules for a minimum of 12 months before proposing updates.
2.1 CONTRACTOR ACCEPTANCE OF CALLS. The Contractor shall notify the Government of its written acceptance of a call by e-mail stating that the Contractor’s intent to perform the service within the agreed-upon work schedule. The solicited BPA holder shall have exactly 2 business days after a site visit to accept the call, unless otherwise stated in the CO’s or COR’s call. Upon acceptance of a call, the Contractor is obligated to perform the service.
2.2 BLANKET PURCHASE AGREEMENT CALL REGISTER (BPACR) The COR will maintain a Blanket Purchase Agreement Call Register (BPACR) to ensure that the designated BPA monetary ceiling is not exceeded. The BPACR shall specify appropriate accounting classification data.
The BPACR will be closed out on the last day of each month. The COR shall send the BPACR to the Ramstein AB contracting office no later than 1000 hours on the 5th duty day after each monthly close out. To ensure an accurate system of checks and balances, the certification on the BPACR will be performed by an individual other than the one who placed the calls that is on the authorized call listing.
3 QUALITY ASSURANCE PLAN
3.1 QUALITY CONTROL. The Contractor shall develop and maintain a quality program to ensure all services are performed in accordance with Final German Governing Standards, German laws, pertinent regulations, and commercial standards and practices. The Contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. As a minimum, the Contractor shall develop quality control procedures addressing the areas identified in section 3.2 Services Summary, below.
3.1.1 Quality Assurance. The Government will evaluate the Contractor’s performance by appointing a Contracting Officer Representative (COR) to monitor performance. Please note, IAW with FAR 52.243- 4, however, changes to this Blanket Purchase Agreement can only be authorized by the Contracting Officer.
3.1.1.1 The COR and/or customer will evaluate the Contractor’s performance through work-site inspections, customer complaints, and a contractor provided report, as detailed in 3.2.1 below. The Government may inspect each call as completed or increase the number of quality control inspections during the performance period if deemed necessary or desired (such as repeated discrepancies or failure discovered during quality control inspections). Likewise, the Government may decrease the number of quality control inspections, as performance dictates.
3.2 SERVICES SUMMARY (SS).
The following Services Summary identifies the performance objectives and performance thresholds for critical tasks associated with providing support services for this requirement. The performance threshold briefly describes the minimum acceptable levels of service required for each requirement. As a general rule, defects are categorized as follows: (1), ‘Major’ defects that present significant safety or health hazards to customer or contract employees (e.g. improperly braced or attached scaffolds, uncorrectable damage to existing structures, etc.) and (2), ‘Minor’ defects are inconvenient, but correctable, do not impede or delay mission accomplishment, and do not pose a significant safety or health hazard to customer or contract employees (e.g. uncleaned area that was part of the work area, un-cleared debris at the end of the day, etc.). Deficiencies shall not exceed the performance thresholds cited in the SS for each performance objective.

Note:
Adjustments to the method of assessment shall remain the unilateral right of the Government, in so far as the change does not affect cost or cause delays in performance. The contractor may not use the method of assessment for any excusable delay.
3.2.1 Contractor Job Completion Report. To ensure all work completed is within acceptable limits, the contractor will provide a detailed report, to include the planned/actual work performance schedule and before and after photos of all work accomplished, within 10 calendar days of job completion (end of the period of performance +10). This report shall be in PDF format, with pictures, and submitted to the Contract Officer Representative (COR) and if used to place the call, Contract Administrator (CA).

may be inspected on a random basis at any frequency as determined by the COR, COR Supervisor, or the
CO.
3.2.3 Remedies for Non-Conformance. The COR or customer shall inspect the performance objectives indicated in SS and indicate performance as acceptable or unacceptable. If during an inspection the COR or customer finds unacceptable service they will conduct an investigation to ascertain the validity and cause of the unacceptable service and notify the Project Manager (PM; see section 4.3.1) of the findings.
Based on the findings, contractor’s PM may be asked to re-perform. If the PM disagrees with the finding and challenges the validity, the COR and/or customer will contact the CO. The CO shall follow FAR 52.212-4, Contract Terms and Conditions-Commercial Items, for the contractor’s failure to perform satisfactory services or failure to correct non-conforming services. If inspections indicate unacceptable performance, the COR and/or customer will notify the contractor of the deficiencies for correction. The contractor will be given an appropriate time frame (depending on the discrepancy identified) after notification to correct the unacceptable performance. If deficiencies are not corrected within the required time frame, the COR and/or customer should notify the CO for action. If the contractor disagrees with the noted discrepancy and an agreement cannot be reached, the CO shall make a final decision. When re-performance is not possible, contract price may be reduced to reflect the reduced value of the services performed.
3.2.4 Damage. The contractor shall exercise care not to damage any facilities and grounds at Ramstein Air Base. Any damages determined to have been caused by the contractor shall be repaired by the contractor at no expense to the Government.
