1.0 Description of Services

1.1 Objective(s): This requirement is for MC-130J aircraft sustaining engineering services and technical support for systems on Air Force Special Operations Command (AFSOC) aircraft throughout their life cycles. This effort will require the contractor to define, assess, and resolve various engineering and technical support issues for the MC-130J aircraft (hereafter referred to as “the aircraft” or “MC-130J”) systems and subsystems. The contractor shall provide an enhanced engineering design and analysis capability, support aircraft modifications, address operational capability improvements, analyze/recommend aircraft availability improvements, suggest reliability and maintainability actions, perform replacement system analysis, assist with resolving deficiency reports, and assist with aircraft troubleshooting/repair. The contractor shall provide engineering support for all MC-130J modifications to include, but not limited to, Increment 3, Defense System Upgrade (DSU), Electronic Warfare Bus, Cotton Mouth, Buffer Boards, and Auxiliary Flight Deck Station

(AFDS) and develop implementation / installation integration plan and provide reach back support during kit installations as technical support. The contractor shall also be required to perform logistical studies, develop Time Compliance Technical Orders (TCTO), submit technical order (TO) change packages, determine parts obsolescence solutions, develop prototypes, address drawing deficiencies, and perform other sustaining engineering activities required for weapon system sustainment. The contractor shall as required produce and install limited kits for minor modifications in order to standardize fielded aircraft installations with the MC-130J consolidated modification line. This acquisition will benefit the government by assisting Multi-Function Teams (MFT) with logistics and addressing technical and engineering matters relating to the overall sustainment of the aircraft platforms. When properly addressed/corrected, expediting resolution of these sustaining engineering issues will provide increased operational capability for the aircraft in the areas of operational safety, suitability, and effectiveness.

1.2 Benefit to United States Air Force (USAF): This acquisition will benefit the USAF by providing timely system engineering activities, improved capability to the war-fighter, and by helping to reduce down-time of Low Density/High Demand aircraft.

1.3 Background: The MC-130J is undergoing several SOF unique development and modification programs over the Future Years Defense Program (FYDP). These programs and capabilities include, but not limited to, Increment III (INC 3), Defense System Upgrade (DSU), Electronic Warfare Bus (EW BUS), Cotton Mouth, Buffer Boards, Auxiliary Flight Deck Station

(AFDS), Radio Frequency Countermeasures (RFCM), MC-130J Common Terrain

Following/Terrain Avoidance Radar (MCTF), Airborne Mission Networking (AbMN), and multiple tanker modifications. These programs are highly interdependent, thereby requiring management at the platform level to ensure effective and efficient integration onto the MC-130J aircraft and training systems.

The contractor shall submit a status report by the

4.4.3.6 Upon notification by AFLCMC/WIU of a technical

report requirement, the contractor’s report shall be delivered by the specified due date and complete and accurate, so that the number of report rejections, due to omitted or inaccurate technical information shall not exceed one (1) per submittal. Rewritten reports shall be resubmitted to AFLCMC/WIU within five

(5) business days of notification that a rewrite is required.

5.5.5 Within 30 calendar days of contract/order award, the

5.6 The Contractor shall submit a Quality Control

Plan (QCP) addressing detection of quality program problems and defects, identification of root causes for quality related problems/defects, correction of root causes related to detected problems/defects, and follow-up to ensure quality related problems/defects do not recur.

3.0 Government Property and Services

Access to Government data: During the life of this contract, AFLCMC/WIU shall provide the contractor access to the Government Technical Data Package, TOs, drawings, assets, testing facility, and Government equipment, as required for the accomplishment of the contract, and the development and testing of equipment, on an as-available basis. The testing facilities, which include the System Integration Laboratory (SIL), is located at Robins 580th.

3.1 Applicable documents include all Technical Orders related to AFLCMC/WIU managed and/or integrated systems and operational maintenance instructions for the SOF MC-130J aircraft.

3.1.1 Contractor Responsibility: The Contractor shall be responsible for Government property in accordance with the Federal Acquisition Regulation (FAR) and as specified in the contract/order.

3.1.2 MILSTRIP Authority: For the MC-130J Supermod, the Government authorizes PCI

Aviation LLC with DLM 4000.25, Volume 2, Military Standard Requisitioning and Issue

Procedures (MILSTRIP) Authority.

3.2 Government Property to be Provided: Government property to be provided includes technical data packages and technical manuals as needed.

3.2.1 Loss of Government Property

In accordance with DFARS 252.245-7002, Reporting Loss of Government Property, “loss of

Government property” means unintended loss of or damage to Government property including property that cannot be found after a reasonable search, loss due to inadequate storage, theft, loss due to lack of security, damage requiring repair to restore the item to usable condition, or damage that renders the property useless for its intended purpose or Beyond Economical Repair

(BER). Loss of Government property does not include manufacturing defects, obsolescence, normal wear and tear, or purposeful destructive testing. Unless otherwise stated in the contract/order, loss of Government property does not include normal and reasonable inventory adjustments, i.e., losses of low priority consumable material, such as common hardware, as agreed to by the contractor and the Government Property Administrator.

3.2.2 Reporting Loss of Government Property: The contractor shall use the Defense Contract

Management Agency (DCMA) eTools software application to report loss of Government property at the site below. The reporting requirement does not change any liability provisions or other reporting requirements that may exist under the contract/order.

3.3 Return of Government Property: All property provided by the Government remains the property of the Government and shall be returned to the Government upon completion of the contract/order. All Government property shall be returned to the Government in the condition provided unless approved in advance by the Procuring Contracting Officer (PCO). All material generated under the contract/order becomes the property of the Government and shall be returned to the Government upon completion of the contract/order. All Department of Defense

(DD) Form 1423, Contract Data Requirements List (CDRL), deliverables become the property of the Government upon receipt.

3.4 Government System(s): The Government will provide contractor personnel access to system(s) necessary to perform tasks under the contract/order. Upon completion/termination of the contract/order or transfer/termination of contractor personnel, the system account(s) will be closed.

4.0 Technical Requirements

4.1 Period and Place of Performance:

4.1.1 Contract/Order Period of Performance: The period of performance for the contract/order will extend:

Basic: 29 September 2020 through 28 September 2021

Option I: 29 September 2021 through 28 September 2022

Option II: 29 September 2022 through 28 September 2023

Option III: 29 September 2023 through 28 September 2024

Option IV: 29 September 2024 through 28 September 2025

4.1.2 Place of Performance: These services will be performed at the contractor or subcontractor’s facility, Government facility, or other locations as required.

4.2 Contract Data Requirements List (CDRL):

4.2.1 The Contractor shall deliver all data/reports associated with all CDRLs, with no more than one rejection of each deliverable. There shall be no more than one (1) total rejection(s) of deliverables per each six (6) month period. The Government will reject a deliverable if two (2) or more technical errors or two (2) or more minor errors are found within the deliverable. A technical error is defined as the format not being in accordance with the CDRL or the content not being accurate and complete in accordance with the CDRL, PWS or contract. A minor error is defined as a typographical or grammatical error. The rejected deliverable shall be corrected and resubmitted within five (5) business days of notification of Government rejection. in accordance with the associated DD Form 1423 instructions/requirements.

4.2.2 CDRL deliverables shall be submitted via Wide Area Workflow (WAWF) and submitted directly to the MFT member identified on the CDRL. The Contractor shall deliver all CDRLs with no more than one (1) late submission(s) of deliverables per each six (6) month period. The

Contractor shall notify the Government if the delivery of any data/document will not meet the scheduled delivery date and negotiate a revised delivery date. The data/document shall be delivered by the revised delivery date acceptable to the Government.

4.3 General Information

4.3.1 Program Management: The contractor shall provide one (1) Project Manager with authority and responsibility for this task. The level of program management shall support financial controls, material and logistics management, scheduling, security, data management and reports, and task proposals. The contractor shall provide periodic status reports detailing accomplishments within the reporting period. The contractor shall maintain a schedule addressing significant milestones for the effort. The contractor shall submit a status report by the

15th calendar day of the delivery month. The contractor’s report shall be complete and accurate, so that the number of report rejections shall not exceed one (1) per each six (6) month period.

4.3.2 Systems: The contractor shall provide system engineering and technical services to support

AFLCMC/WIU managed systems/subsystems and their integration into aircraft associate interfaces, trainers, and support equipment for the MC-130J aircraft. Additionally, the contractor shall support new integration efforts.

4.3.3 Service Engineering: The contractor shall perform system engineering and technical liaison services to support the aircraft system/subsystems and their integration into the aircraft.

These system services include analytical engineering, system integration engineering, independent engineering tests, aircraft performance engineering, and the development of engineering design packages. Additionally, engineering shall support accident investigations, failure analysis, and aircraft trainers. One-time damage analysis and damage tolerance assessments may be required as well as on-the-spot design of temporary and permanent repairs.

Engineering services shall support testing of systems and subsystems, development and qualification of replacement parts, updating of drawings and specifications, technical data, and updating support equipment. This engineering services effort will encompass approximately

9,000 hours of labor per year, across multiple labor categories, to complete. Upon notification by

AFLCMC/WIU of a technical report requirement, the contractor shall provide reports within two

(2) workdays of the request. The contractor’s report shall be delivered complete and accurate by the specified due date so that the number of report rejections, due to omitted or inaccurate technical information, shall not exceed one (1) per submittal. Rewritten reports shall be resubmitted to AFLCMC/WIU within five (5) business days of notification that a rewrite is required. (DI-MISC-80508B/T, CDRL# A002)

4.3.4 Deficiency Corrections: The contractor shall furnish guidance to operational and maintenance personnel on the specifics of the modification and/or the changes implemented to resolve the aircraft system/subsystem deficiencies in conjunction with service engineering. (DI-

4.3.5 Test and Evaluation Support: The contractor shall assist with aircraft flight test programs related to the service provided under this contract. The contractor shall support Test Plan

Working Groups (TPWG), safety reviews and Test Readiness Reviews (TRR). The contractor shall support the Configuration Control Board (CCB) approval and/or Airworthiness Release

(AR) meetings. The contractor shall provide liaison and test support for the aircraft modification efforts. The Contractor shall support planning for modifications to the aircraft. (DI-MGMT-

4.3.6 Test and Evaluation Plans: The contractor shall be responsible for reviewing contractor developed test plans and procedures and providing written recommendations to the Government as to the suitability of this data to support the aircraft test efforts. Written recommendations shall be submitted as attachments to the monthly status report. The contractor shall submit test plans and procedures, test reports, and system safety analysis. 4.3.7 Prototyping: The contractor shall develop and fabricate prototype system hardware/software as required to validate and test alternative designs, integrate equipment in the aircraft, update trainers, update support equipment, and conduct qualification testing. Rapid prototyping may be a requirement for time sensitive obsolescence part failures. This capability will be used to provide mock up parts for fit check purposes and as a basis for production representative hardware. Typical prototype hardware/software shall be production representative and shall be documented by engineering drawings and specifications. Government approval is required to purchase material required for prototyping. (DI-NDTI-80809B, CDRL# A005)

4.3.8 Acceptance Test Procedures: The contractor shall be responsible for generating or reviewing Acceptance Test Procedures (ATPs). The ATPs shall include the requirements for all ground and flight testing for the purpose of acceptance of the installation/modification for the modification production aircraft installation. 4.3.9 Technical Interchange Meetings (TIMs) Design Reviews: The contractor shall either attend or host TIMs in support of this effort. Agenda, minutes and trip reports for these meetings shall be the responsibility of the contractor. (DI-MGMT-80368A, CDRL#; A001; DI-ADMN-

4.3.10 Studies: The contractor shall perform independent technical studies to support the aircraft systems/subsystems and their integration into the aircraft. The intent of the study is to provide the Government the assessment of a number of potential solutions to any specified problems.

The assessment shall provide the Government with sufficient insight to pursue an appropriate solution to resolve the problem being studied and/or tested. The technical solution(s), being recommended by the contractor shall be provided to the Government in a report, with all rationale and analysis that supports the technical solution(s), scheduling information and projected costs. Included in each report shall be a description of all options reviewed, how each option will resolve the problem, and ranked order by the contractor of the viability of each option in solving the problem being studied. The contractor shall provide the rationale describing the methodology used in ranking the potential solutions to the problem being studied. (DI-MISC-

4.4 Reports and Data Deliverables

4.4.1 Packaging: Packaging: The Contractor shall package and mark material in accordance with the contract/order Air Force Materiel Command (AFMC) Form 158, Packaging

Requirements, and applicable Government regulations. The Contractor shall ensure that classified material is packaged, marked and delivered in accordance with DoD 5220.22-M, National Industrial Security Program Operating Manual (NISPOM).

4.4.1.1 Reports: The contractor shall submit final reports documenting the events of each integration effort and any open or unresolved issues. (DI-MISC-80508B/T, CDRL# A002)

4.4.1.1.2 Monthly Status Report: The contractor shall submit monthly status reports to the

Government. These reports shall cover the engineering and technical support provided by the contractor during the last monthly period. The contractor shall document task status, data deliverables, contract issues and actions and expenditure data, as well as anticipated task requirements during the next reporting period. Regular updating of cumulative cost verses estimated total cost shall be submitted in the monthly status reports. A fund expenditure chart that plots actual and planned expenditures and man-hours against time will be included with each monthly status report. In addition, all problems areas shall be addressed, with recommended solutions and the outcomes after solutions are implemented. Reports shall include a “Burn Rate” chart that plots actual versus proposed expenditures, man-hours by labor category, and cumulative man-hours. (DI-MGMT-80368A, CDRL# A001)

4.4.1.1.3 Travel: Contractor personnel, in conjunction with engineering services, shall be required to travel to other Government installations or to contractor facilities to observe and conduct tests, ensure compatibility or configuration changes and other integration services, and to furnish technical guidance as required. Trips, numbers and types of personnel shall be limited to the minimum required to accomplish work requirements. The contractor shall be responsible for arranging all contractor personnel travel during the program effort. The contractor shall use the lowest cost mode of transportation commensurate with the mission requirements and good traffic management principles. 4.4.2 Data Deliverables: Per DoD policy, every attempt shall be made by the contractor to provide ‘paperless’ electronic or digital deliveries. Monthly status reports shall be submitted by

E-mail. Other documents, such as acquisition documentation and reports shall be submitted on disk in a Microsoft Office compatible format. All final submissions shall be hand delivered to the Government quality assurance representative or their alternate.

4.4.3 Engineering Data Deliverables

4.4.3.1 Engineering Data: The contractor shall develop/produce/maintain and deliver a Technical

Data Package (TDP) that accurately depicts the final product. TDP data includes, but is not limited to, Computer Aided Design (CAD) data, CAD models, model based definition data sets, Gerber data and Master Bill of Materials (BOM). The TDP shall provide the necessary design, engineering, manufacturing, testing and quality assurance requirements information necessary to enable the procurement or manufacture of an interchangeable item that duplicates the physical and performance characteristics of the original product without additional design engineering effort or recourse to the original design activity or any third party. The TDP shall represent the approved, tested, and accepted configuration of the defined delivered item(s). This shall include software and all test requirement documentation data required to test systems, subsystems and/or components.

Vendor Item Control Drawings shall be used to specify the requirements for purchased items when such items have been approved for use in the design and are used without alteration, selection or source qualification (testing of an item prior to procurement action to ensure that it satisfies the specified requirements). All engineering product definition data created using Government funding as a result of this contract shall be considered a part of the TDP and shall be delivered to the

Government with unlimited rights. The TDP shall be created IAW the following American

Society of Mechanical Engineers (ASME) standards: ASME Y14.100-2017, Appendix B, sections

B6 through B9.1 and Appendices C, D, E, and F in conjunction with ASME Y14.24-2012, ASME

Y14.34, ASME Y14.35 and ASME Y14.41 and as defined in the corresponding CDRL for this task to create and deliver Product Engineering Design Data and Associated Lists (Engineering

Data) under this contract. Data set classification code marking IAW Appendix F of ASME

Y14.100-2017 is required. CAD model file name and extension identification is required on drawing graphic sheets. TDP data shall specify parts marking requirements for item identification

IAW MIL-STD-130N, other applicable documents referenced therein, and as specified in this contract. Test Criteria for Electrical and Avionics Items shall be IAW document 9579777

4.4.3.2 Engineering Data Guidance Conference: The contractor shall support and co-chair a

Guidance Conference with AFLCMC/LZPEM for engineering data within 60 days after contract award. The Conference shall be convened at a site and on a date agreed upon by the Government contracting officer and the contractor. The contractor shall prepare an agenda and record the minutes of the Guidance Conference. The contractor shall address, discuss, and provide status on the following:

a. Understanding of all CDRL requirements, applicable DIDs, specifications and standards.

b. TDP review requirements and schedules.

c. TDP delivery requirements and schedules.

d. Contractor's drafting practices/procedures/TDP drawing formats/CAD programs.

e. The contractor's quality assurance procedures relating to TDP documents, including quality control of subcontractor and vendor data.

f. The role of subcontractors and vendors who may deliver TDP documents under this contract.

g. The contractor's configuration management system, including methods for releasing documents, approving documents, and incorporating changes into documents.

h. Digital Technical Data Package (TDP) deliverables.

Note: Guidance Conference may be held in conjunction with other meetings or conferences.

4.4.3.3 In-Process Review (IPR) of the TDP: The contractor shall host, support, and co-chair an

IPR of the engineering drawings and associated lists and other documentation to be included in the TDP. The IPR shall be conducted only after the contractor's quality assurance personnel have completely reviewed the data and determined that data are of sufficient quality that Government time will be effectively utilized during the review. IPR may be scheduled when data has reached the 50% percent completion point and shall be held, when possible, in conjunction with other reviews (i.e., PDR, CDR). Concurrent with the IPR, the contractor shall submit four (4) representative samples of each digital data format of data for this project in accordance with Air

Force drawing 9579776 (CAGE 98752), These shall consist of the Native, Neutral, Word

Searchable PDF, HPGL, Metadata Spreadsheet, BOM, Gerber Data, and Software/memory

Device Data. The contractor shall notify AFLCMC/LZPEM a minimum of 30 days prior to the anticipated date of completion point. The IPR shall focus on the contractor's progress in the preparation of the TDP. The contractor shall support and provide the necessary resources, i.e., meeting agenda, conference room, applicable data, minutes, and appropriate personnel available to answer any questions to perform the IPR effectively. The contractor shall correct all discrepancies identified in the IPR. All subcontractor/vendor data shall be made available for review. If the quantity of subcontractor/vendor data is of sufficient magnitude, the Government may schedule a separate IPR at the subcontractor's/vendor's facility.

4.4.3.4 Relationship of Contractor with Subcontractors/Vendors: The contractor shall levy on sub-contractors and sub-vendors the same requirements for Technical Data Packages (TDPs) as are levied on them by this contract. This requirement shall apply at all tiers of sub-contractor/vendor levels associated with the program.

4.4.3.5 Engineering Data Updates and Revisions: The contractor shall (and shall cause subcontractors and vendors to) update and maintain engineering data for the item(s) designed/ developed/modified/produced and funded by this contract for the life of this contract and shall incorporate all changes in accordance with the following:

a) All engineering changes shall be incorporated into the applicable engineering data within 90 days after engineering release/Air Force concurrence or at intervals of five changes, whichever occurs first, except a change involving safety, which shall be incorporated immediately.

b) All engineering changes shall be incorporated into the applicable engineering data prior to delivery of data for review.

c) All engineering changes shall be incorporated into the applicable engineering data prior to delivery of final media.

d) Revisions to existing engineering drawings/models and associated lists and other documentation to be included in the TDP for which the contractor is the current design activity shall result in the delivery of the entire revised document and associated data file.

For example, when a portion of a document is revised the entire document shall be delivered.

4.4.3.6 Counterfeit Electronic Parts: The contractor shall establish policy and procedures to mitigate the risk of counterfeit electronics parts being installed end items or otherwise entering the USAF/DoD inventory in accordance with DFARS 252.246-7007 Contractor Counterfeit

Electronic Part Detection and Avoidance.

5.0 GENERAL INFORMATION

5.1 CONTINUATION OF MISSION-ESSENTIAL SERVICES DURING A CRISIS

5.1.1 Designation of Services as Mission-Essential: In accordance with DFARS 237.7602(a), The Continuation of Essential Contractor Services / Policy, DFARS 252.237-7023(a)(2), and

Air Force Instruction (AFI) 10-403, Deployment Planning and Execution, paragraph 1.9.1.33.2, the Functional Commander (FC) or civilian equivalent has determined these services are not mission-essential and will not continue in the event of a crisis.

5.2 SECURITY REQUIREMENTS

5.2.1 Actual knowledge and/or generation of classified information and/or Controlled

Unclassified Information (CUI) are not expected to be necessary for performance of the contract/order. Contractor personnel are required to comply with security requirements to preclude potential security incidents or violations. If a change in the security classification of the contract/order becomes necessary after contract/order award, the contractor shall make a reasonable effort to continue performance of tasks under the contract/order in compliance with the change in security classification in accordance with FAR 52.204-2, Security Requirements.

5.2.1.2 Knowledge and/or generation of classified information and/or CUI are required for performance of the contract/order. The contractor shall ensure applicable contractor personnel have security clearances at the Secret level.

5.2.2 Government Security Regulations: The contractor shall ensure personnel, information, system, property, and facility security requirements are met. The contractor shall comply with

Government security regulations including, but not limited to, Department of Defense (DoD)

5200.2-R, Personnel Security Program; DoD 5220.22-M, National Industrial Security Program

Operating Manual (NISPOM); DoD Directive (DoDD) 5205.02E, DoD Operations Security

(OPSEC) Program; DoD Manual 5205.02, DoD Operations Security (OPSEC) Program Manual;

and Robins Air Force Base Integrated Defense Plan (RAFB IDP) 31-101.

5.2.3 Operations Security (OPSEC): The purpose of OPSEC is to reduce the vulnerability of

USAF missions to adversary collection and exploitation of critical information. The contractor shall ensure compliance with DoDD 5205.02E and DoD Manual 5205.02-M to protect U.S.

Government interests. The contractor shall ensure contractor personnel who perform work on a

Government facility comply with the OPSEC procedures of the facility.

5.2.4 Communications Security (COMSEC): The contractor shall use only secure communications methods and/or equipment to transmit or otherwise transfer classified information and/or CUI in accordance with DoD 5220.22-M. Applicable equipment shall be safeguarded, maintained and operated in accordance with DoD 5220.22-M.

5.2.5 Security Clearance: The contractor shall ensure applicable contractor personnel have security clearances at the Secret level for proper accomplishment of contract/order requirements.

The security clearance shall be obtained IAW the DD Form 254, Department of Defense

Contract Security Classification Specification. Contractor personnel whose clearances have been suspended or revoked shall immediately be denied access to classified information and/or CUI and classified items.

5.2.6 Security Incident or Violation: The contractor shall immediately notify the Government

Security Office of any potential or actual security incident or violation including potential or actual unauthorized disclosure or compromise of classified information and/or CUI.

5.2.7 Security of Contractor System(s): The contractor shall ensure the security of Automated

Information System(s) (AIS) at the contractor’s facility to preclude potential security incidents or violations including potential unauthorized disclosure or compromise of classified information and/or CUI.

5.2.8 Access to Government System(s): The Government will provide contractor personnel access to system(s) necessary to perform tasks under the contract/order. The contractor shall ensure contractor personnel who require access to an unclassified or classified Government AIS have the appropriate background check or security investigation conducted. The Government will provide system access subject to approval of the DD Form 2875, System Authorization

Access Request (SAAR). Upon completion/termination of the contract/order or transfer/termination of contractor personnel, the system account(s) will be closed.

5.2.9 Access to Government Facility: The contractor shall ensure contractor personnel who require access to a Government facility comply with the security requirements of the facility.

5.2.10 The Contractor shall ensure a CAC is obtained by all contractor/subcontractor personnel who require access to DoD computer networks/systems, for DoD facility entry control and/or for physical access to facilities and buildings to perform tasks under the contract/order. The

Contractor shall provide a list of contractor/subcontractor personnel who require a CAC to the

PCO. The Government will provide the Contractor instruction on how to complete a Contractor

Verification System (CVS) application and notify the Contractor of approval/disapproval of contractor/subcontractor personnel application. Contractor/subcontractor personnel shall obtain the CAC from the local Real Time Automated Personnel Identification Documentation System

(RAPIDS) issuing facility [usually the Military Personnel Flight (MPF)].

5.2.11 The Contractor shall immediately report a lost or stolen CAC as directed by local

Government policy. The Contractor shall notify the PCO of any change to the list of contractor/subcontractor personnel who require a CAC and provide an updated list within five business days. The Contractor shall return a CAC within five business days once contractor/subcontractor personnel no longer require computer network/system access and/or facility access. The Contractor shall return an expired CAC within five business days after the expiration date. The Contractor shall return any and all CACs within five business days after completion/termination of the contract as directed by local Government policy.

5.3 EVIRONMENTAL MANAGEMENT SYSTEM (EMS)

5.3.1 Contractor/subcontractor personnel who perform work on any Government facility shall comply with the EMS requirements established by the facility. Contractor/subcontractor personnel may be required to complete EMS training prior to beginning work.

5.4 AGENCY AFFIRMATIVE PROCUREMENT PROGRAMS

5.4.1 This acquisition does not require the purchase of Environmental Protection Agency (EPA)-designated products or United States Department of Agriculture (USDA)-designated products;

therefore, the requirement does not apply.

5.5 SAFETY REQUIREMENTS

5.5.1 Contractor Compliance: The contractor shall comply with Government Safety and

Health regulations including, but not limited to, Public Law 91-596, Occupational Safety and

Health Act (OSHA), and DoDD 4715.1E, Environmental, Safety, and Occupational Health

(ESOH). OSHA and ESOH requirements shall be incorporated into the Contractor’s safety program.

5.5.1.1 Safety and Health Plan: While performing work under this contract the contractor shall comply with all applicable federal, state and local regulations regarding occupational safety and health. The contractor shall notify the Contracting Officer (CO), within eight (8) hours of any damage to government property where the dollar value exceeds $500,000.00 and within two workdays, for any damage to government property less than $500,000.00 during the execution of the contract.

Mishap notifications shall contain, as a minimum, the following information:

a. Contract, Contract Number, Name and Title of Person(s) Reporting

b. Date, Time and exact location of accident/incident

c. Brief Narrative of accident/incident (Events leading to accident/incident)

d. Cause of accident/incident, if known

e. Estimated cost of accident/incident (material and labor to repair/replace)

f. Nomenclature of equipment and personnel involved in accident/incident

g. Corrective actions (taken or proposed)

h. Other pertinent information

If requested by the designated CO, the contractor shall immediately secure the mishap scene/damaged property and impound pertinent maintenance and training records, until released by the Procuring Safety Office. Contractors will not dispose of contract data related to a mishap until notified to do so by the CO.

5.5.2 Voluntary Protection Program (VPP): The USAF is a participant in the OSHA VPP.

Contractor personnel performing work on a USAF installation shall participate in the local VPP.

5.5.3 Mishap Notification/Investigation: The Contractor shall report mishaps including damage to DoD property; occupational illness to DoD military or civilian personnel; injury to on- or off-duty DoD military personnel; injury to on-duty DoD civilian personnel; and damage to public or private property or injury or illness to non-DoD personnel caused by Government operations. The Contractor shall ensure the Safety Office and the PCO are notified of mishaps.

The Contractor shall contact the MFT (COR, if available, or another MFT member) by telephone within four business hours. The Contractor shall cooperate with Government safety investigations.

5.5.4 Mission Inspection of Services: In accordance with the Inspection of Supply/Services clause(s) identified in the contract/order, the Government reserves the right to inspect Contractor performance.

5.5.5 Contractor Manpower Reporting: In accordance with 10 United States Code 2330a, the

Contractor shall provide an annual count of contractor/subcontractor personnel performing work for each fiscal year if the DoD is the requiring activity and if the acquisition is in excess of

$3,000,000.00. The Contractor shall report all Contractor labor hours, including subcontractor labor hours, required for performance of the services provided under the contract in the

Enterprise-wide Contractor Manpower Reporting Application (eCMRA). Reporting shall be conducted for each fiscal year, which extends October 1 through September 30. While inputs may be made any time during the fiscal year, all data shall be reported no later than October 31 of the following fiscal year. The Contractor shall establish a record for the contract/order in eCMRA no later than 30 calendar days after contract/order award. The Contractor shall enter

Order Data, Contact Data and Location Data. Data for Air Force service requirements must be input at the Air Force CMRA link. Additional information and user manuals for government personnel and contractors are available at the Army CMRA link at http://www.ecmra.mil.

5.6 Quality Control Plan/Quality Management System (QMS): The Contractor shall ensure the quality of services through a quality and/or inspection system. The Contractor shall submit a

Quality Control Plan (QCP) addressing detection of quality program problems and defects, identification of root causes for quality related problems/defects, correction of root causes related to detected problems/defects, and follow-up to ensure quality related problems/defects do not recur. The plan shall include the schedule of quality assurance/control inspections planned by the Contractor. 100% compliance with the QMS is required.

5.7 Trafficking in Persons: The Contractor shall comply in accordance with the FAR and applicable supplements and shall be in compliance with all applicable guidance and clauses listed in the contract as it relates to Trafficking in Persons. Additional information about

5.8 INVOICING/PAYMENT AND RECEIPT/ACCEPTANCE

5.8.1 In accordance with DFARS 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports, the contractor shall submit/process payment requests (invoices, Receiving Reports or combos) and receipt/acceptance documents via Wide Area Workflow

5.8.2 Services will be accepted by the Contracting Officer Representative (COR)

5.9 Inspection of Services: Inspection of Services will be accomplished in accordance with the

FAR and applicable supplements and shall be in compliance with all applicable guidance and clauses listed in the contract. The Government reserves the right to inspect Contractor performance.
