DEPARTMENT OF VETERANS AFFAIRS
Justification and Approval (J&A) For
Other Than Full and Open Competition (>SAT) eCMS Action ID: V797P2290D
1. Contracting Activity:
The Department of Veterans Affairs, Network Contracting Office (NCO) 10, including the Battle Creek VA Medical Center.
2. Nature and/or Description of the Action Being Processed:
The Department of Veterans Affairs, Network Contracting Office (NCO) 10 has an urgent need for on-site psychiatry physician services and requests a 3-month contract be put in place to provide continual on-site psychiatry services to the Battle Creek VA Medical Center. This will be an extension to the existing contract V797P2290D, for months April 1, 2020 through June 30, 2020. The on-site psychiatry services is being procured from the current contractor Spectrum Healthcare Resources, Inc. located at 12647 Olive Blvd STE 600 Saint Louis, MO 63141. The proposed contract is being entered as a sole source due to the timeframe needed to fulfill the required on-site psychiatry services necessary to continue uninterrupted patient care under 41 U.S.C. 3304(a)(2) and FAR 6.302-2(a)(1)(c)(1). The need for continued care provides an unusual and compelling urgency in relation to disgnostic medical activities and the continuation of patient care within NCO 10 and ability to meet patient services. Due to the lead time required to complete contract award activities for a new five-year agreement, the sole source as this contractor can fulfill the requirement appropriately without interruption to critical patient care services.
3. Description of Supplies/Services Required to Meet the Agency’s Needs:
The Department of Veterans Affairs, Network Contracting Office (NCO) 10 has a need for three-months of on-site psychiatry services to the Battle Creek VA Medical Center, in accordance with the requirements outlined in the Performance Work Statement (PWS). NCO 10 requests services in the most expeditious manner due to the timeframe needed to fulfill the required on-site psychiatry services necessary to continue uninterrupted patient care.
The period of performance is anticipated to be July 1, 2020 through September 30, 2020. A new contract is required to ensure continuance of services. The total dollar amount estimated for the 3-month contract is $874,764.80, based on the price schedule. The period of performance will begin July 1, 2020.
4. Statutory Authority Permitting Other than Full and Open Competition:
( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1;
(X) (2) Unusual and Compelling Urgency per FAR 6.302-2;
( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability

( ) (6) National Security per FAR 6.302-6;
( ) (7) Public Interest per FAR 6.302-7;
5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):
NCO 10 is requesting that the contractor be capable of providing the above cited services to meet the Agency’s need. This is due to the urgency and compelling need to award the contract to a contractor who can provide immediate care.
The contractor, Spectrum Healthcare Resources, Inc. is already the established vendor. Awarding to another contractor is not possible; it will cause a break in the continuity of services to NCO 10 patients receiving on-site psychiatry services . Establishing a new vendor to service patients within NCO 10 can take approximately 3 months or longer to fully implement. Spectrum Healthcare Resources, Inc. have the professional expertise for this procurement and are in good-standing in meeting the current NCO 10 on-site psychiatry needs at the Battle Creek VA Medical Center.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:
Not applicable for this request.
The Contracting Officer contacted Spectrum Healthcare Resources, Inc. to determine if they would be interested in puirsuing a 3-month short-term contract holding their prices from the current contract (V797P2290D under Order Number 36C25020F0512), and Spectrum agreed, in order to maintain continuity of care.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:
I hereby determine the anticipated cost to the Government is fair and reasonable based on a review of the most recent previous procurement (V797P2290D) which was determined fair and reasonable based on a comparison of costs with historical pricing. Spectrum healthcare Resources, Inc. agreed to keep the current prices the same from contract V797P2290D for this new contract.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:
Market Research was not conducted for this action as it was already conducted for the long-term award that is currently being modified to extend services.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition:
Originally, this request was created with the intent of a long-term contract to be awarded July 1, 2020. However, a long-term contract was not ready for award and the Contracting Office was out of time to solicit for a new procurement, citing an urgent and compelling urgency IAW FAR 6.302-2.
