Questions and Answers to 7‐2‐24 RFP PR288225 C‐103 Niobium Alloy Rods UT ‐ Battlle, LLC at ORNL

Question Answer Our manufacturer/supplier for the blank Niobium rods is asking whether they need permission or it is okay to share the RFP Drawing with the overseas mill they work with.

The drawings have been reviewed by our export control group and were OKd for public posting on SAM.gov and further distribution if necessary.

I am wondering if the Niobium must be US sourced, I see that 52.225‐9 Buy American is called out for construction materials for UT‐BATTELLE but I am not sure if this project would be considered construction materials. Please advise.

52.225‐9 is called out in our prime flowdowns as applicable to construction contracts. This procurement is not a construction contract.

Can you advise if there is a material temper requirement (other than annealed condition) or any specific additional mechanical property requirements or testing requirements beyond the ASTM specifications?

No requirements beyond the ASTM specifications.

The Representations & Certifications – Abbreviated, attached to the subject RFP, include a Buy American clause. The C103 bar that we would include in our response is manufactured in China. Please discuss the incorporation of China‐sourced materials in the deliverable with the appropriate individuals within ORNL to determine if they are going to accept them. We will await your response.

Regarding the foreign source question, we will consider offers of both foreign and domestic product. If you have both foreign and domestic sources you can submit separate responses for each.

In order to quote finished parts in this material I will need to share the drawing with the overseas mill that we work with that we have an NDA on file with. Please advise if that is okay.
