NATIONAL AERONAUTICS AND SPACE ADMINISTRATION

GLENN RESEARCH CENTER (GRC)

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION (JOFOC)

For PMSS NNC14BA03B

1. Federal Acquisition Regulation (FAR) 6.303-2(b)(1) - Identification of the agency and the contracting activity, and specific identification of the document as a "Justification for other than full and open competition."

This document is a justification for other than full and open competition prepared by National Aeronautics and Space Administration (NASA) Glenn Research Center (GRC). The procuring agency is the National Aeronautics and Space Administration (NASA) and the contracting activity is GRC.

2. FAR 6.303-2(b)(2) -The nature and/or description of the action being approved:

This justification provides the rationale for contracting by other than full and open competition to award an extension to NNC14BA03B with Summit Technologies & Solutions

Inc. for Project Management Support Services (PMSS) under contract NNC14BA03B.

Marshall Space Flight Center (MSFC) is Currently in the process of awarding an agency-wide contract for Project Management Support Services (PMSS). Since the MSFC contract has yet to be awarded for PMSS, NASA Glenn is requesting a deviation for continuing PMSS work with Summit Technologies & Solutions Inc., pending the agency contract award.

The current period of performance for the PMSS contract is December 2013 - June 2021.

3. FAR 6.303-2(b)(3) - A description of the services required to meet the Agency's needs:

Summit Technologies provides expert support to Project Managers by assisting in the fo1mulation and management integration of any and all aspects of the project including but not limited to the identification, assessment, evaluation and integration of project planning, tracking and control data (i.e. management, budget, cost, schedule, risk, etc.), hardware, software, ground support equipment and personnel.

The current period of performance of the PMSS contract is December 2013 - June 2021 and is broken down as follows:

Base - 24 months (12/12/2013- 12/l l/2015) Option 1 - 12 months (12/12/2015- 12/11/2016) Option 2 - 12 months (12/12/2016-12/11 /2017) Option 3 - 12 months (12/12/2017-12/11 /2018) Option 4 - 18 months (12/12/2018-6/11/2020) Option 5 - 3 months (6/12/2020-9/11/2020) Option 6 - 3 months (9/12/2020-12/1l/2020) *Option 8 - 6 months (12/12/2020-6/11/2021) *Numbering is out of order

The estimated value of this extension is $1,689,151.21.

4. FAR 6.303-2(b)(4) - An identification of the statutory authority permitting other than full and open competition:

The statutory authority permitting other than full and open competition is 10 U.S.C.

2304(c)( l ), as implemented by FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements, and 10 U.S.C. 2304(g), special simplified procedures.

5. FAR 6.303-2{b)(5) -A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited:

The rationale supporting the use of 10 U.S.C. 2304(c)(l) is only one responsible source and no other supplies or services will satisfy agency requirements, as described below.

GRC exercised an option of the contract in December 2020 with an approved deviation; this latest option expires June 2021. There are no remaining options to be exercised.

Beginning in 2015, NASA initiated an Agency Business Systems Assessment (BSA) to assess the health and optimization of budget and management processes. This led to findings in the June 2016 timeframe to evaluate the health of the Agency's current Program/Project Planning & Control (PP&C) functions, identify opportunities for optimization, and provide findings that will promote excellence, effectiveness, and efficiency across the Agency - including contracts in place for the provision of such services. A decision package was presented at the Agency Mission Suppol1 Council (MSC) in May 2017, which included the regionalization of PP&C contracts, and identified a large amount of work from all Centers to be completed through CY2018.

Several risks /challenges and mitigation approaches were also identified. This JOFOC exercises one such acceptable mitigation approach: "modifying existing PP&C contracts, or by creating timeline to consolidate PP&C contracts when current contracts expire in phased approach. As current contracts expire, the work will transition to the new regional contracts."

Therefore, in exercising an acceptable mitigation approach while awaiting completion of identified forward work during CY2018 and beyond, it was determined that, to avoid disruption of any project support for GRC multiple Mission Directorate projects assigned to GRC, a 2-year bridge from 12/12/2018 to 12/12/2020 should be added to the life of the current PMSS contract until further decisions were made as an Agency. This determination was concurred upon by HQ Procurement Officials in the September/October 2017 timeframe.

GRC made the necessary contract adjustments and incorporated requirements into the contract upon its extension.

The purpose of this JOFOC is to extend the PMSS contract an additional six months, consisting of one three-month option, and three one-month options, which would retain uninterrupted services during this planning process. This extension will also increase the contract life value by $1,689,151.21.

With a collaborative effort between users of these services, GRC Procurement, and HQ Procurement, a contract bridge extension was granted to proceed in December 2017, with a schedule to award the contract an additional two and a half option years, which would make the contract end date in June 2021.

This final Justification for Other Than Full and Open Competition approval completes the required documentation prior to formally authorizing the contractor to proceed.

The most recent Contractor evaluation of 12/2020 reflects Exceptional ratings in all categories of the Contractor Performance Assessment Reporting System (CPARS).

6. FAR 6.303-2(b)(6) – A description of the efforts made to ensure that offers are solicited from as many potential sources as practicable, including whether a notice was publicized as required by Subpart 5.2:

In accordance with FAR 5.2, a description of this requirement was posted to Federal Business Opportunities (FBO) on 04/08/2021 and closed on 04/23/2021.

Market research was also conducted at the onset of the original procurement when a sources sought synopsis was issued. The synopsis was posted via the NAIS system on FedBizOpps.

Multiple companies responded to the sources sought with several of the companies being qualified and certified Government Hub-Zone firms. Due to this response, a determination was made that the procurement be designated as a Hub-Zone set-aside procurement.

7. FAR 6.303-2(b)(7) – A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable:

The Contracting Officer’s signature on this document indicates that the Contracting Officer has determined that the anticipated cost to the Government will be fair and reasonable. The Contractor shall be required to submit a proposal to be evaluated and negotiated by the Government. Prior to execution of the contractual instrument, a proposal analysis will be performed. The proposal analysis will ensure that the final agreed-to price for the contract action is fair and reasonable.

8. FAR 6.303-2(b)(8) – Description of the market research conducted and the results:

Comparisons were made to other NASA GRC contracts for the tasks performed by the contractor on the PMSS contract. The statements of work of the GESS (Glenn Engineering and Scientific Services), PACE (Professional, Administrative, Computational, and Engineering Services), ARTS (Advanced Research and Technology Support), and TIALS (Technical Information, Administrative, Logistical Support Services) were analyzed against the current PMSS SOW. There is little to no overlap in the SOW, so utilizing another Center contract is not feasible at this time.

A sole source Special Notice was posted to the www.beta.sam.gov website on 4/8/2021 with a response/completion date of 4/23/2021.

Overall, the market research activity confirmed that the current PMSS SOW is sufficient to support current NASA program and project needs. The contractor has been able to supply workforce as needed and timely for all NASA GRC task order requests. As such, it is determined that the requirements in the current contract and its options continue to offer the best path to attaining maximum program/project effectiveness for GRC. The exercise of this contract option is in the best interest of the Government.

9. FAR 6.303-2(b)(9) – Any other facts supporting the use of other than full and open competition:

Per the initial proposal submission, the labor rate escalation for each Option period is .

This is below the rates issued annually by NASA Headquarters' Procurement Office for calendar years 2015 (2.5), 2016 (2.9) and 2017 (3.2).

The Contracting Officer has requested Summit to submit an estimated price proposal for the extension period. The Overhead and G&A rates are tied into the labor rates. Per the initial proposal submission, the labor rate escalation for each Option period is . This is below the rates issued annually by NASA Headquarters’ Procurement Office for calendar years 2015 (2.5%), 2016 (2.9%) and 2017 (3.2%). The rates used by the Government to evaluate the reasonableness of the proposed rates were the initial rates proposed on the current PMSS contract with a two percent escalation per year. Then the rates of the major labor categories utilized on the contract were compared to the General Services Administration (GSA) rate library for the local geographical area. This is the same method that the Chief Financial Officer used for the initial Internal Government Cost Estimate. For the major labor categories utilized on the contract, the rates currently paid are less than those reported on the website in a range of The rates have been determined to be lower than average than reported on the GSA library. As a result of this analysis, the CO has the rates were determined the rates to be acceptable, fair and reasonable.

10. FAR 6.303-2(b)(10) – A listing of the sources that expressed an interest in writing in the acquisition:

A notice of NASA’s intent to award this sole-source action was synopsized on the GPE website (beta.sam.gov) per FAR Subpart 5.2 on 04/08/2021 and closed on 04/23/2021.

In terms of this overall JOFOC, the interested parties had no impact on it.

11. FAR 6.303-2(b)(11) – A statement of actions the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the services required:

This JOFOC is being used as a bridge as part of the overall larger competitive MSFC procurement.

No actions can be taken to remove barriers to competition for this procurement for Project Management Support Services, as the changes that would be required to the current system would result in substantially higher costs to the government for this procurement action. The Agency will continue to examine the market in the future for alternative solutions or new sources before executing any subsequent acquisitions for the same requirements.
