FDOT CONSTRUCTION CONTRACT #E3X88

The two projects under this contract were designed by Mead & Hunt, Inc.; the Roadway EOR is Christopher Lees, PE. These 3R projects will primarily consist of milling and resurfacing the section of SR 293 (Danny Wuerffel Way) from SR 30 (US 98) to the Mid-Bay Bridge—just south of the toll plaza—as well as SR 30 (US 98) from west of Paraiso Boulevard to east of Regions Way in Destin, Florida (Okaloosa County). Other improvements include concrete sidewalk repair, new and improved curb cut ramps with detectable warning, signalization and pedestrian upgrades, and new signing and pavement markings. The proposed letting date for this “Goes With” (G/W) contract is May 8, 2025 with an anticipated NTP date of July 18, 2025. Contract time has been set at 250 calendar days.

PROJECT #1: SR 293 Resurfacing, FPID: 410390-3-52-01 Work Program Budget: $2.0M

The first project in Group 25-N comprises the resurfacing of SR 293, also known as Danny Wuerffel Way. This 0.8-mile corridor connects US 98 in Destin to the Mid-Bay Bridge southern approach and Toll Plaza. This segment is a vital link between Destin’s beaches, restaurants, and other tourist destinations and commuters coming from the north. Business and residential access to Destin Commons, Paradise Key, Kelly Plantation, and Regatta Bay are all accessed via SR 293. In addition, this roadway is also an important hurricane evacuation route allowing motorists to relocate to the north in the event of a coming storm.

Milling & Resurfacing: Although not numbered, the roadway plans for the SR 293 project include five different Typical Sections (Sheets 3-7). The pavement design calls for milling the existing asphalt pavement 2.0” and resurfacing with 2.0” of FC-

12.5 dense graded friction course (TL-C). This pavement design is consistent across all typical sections with one exception: the two southbound travel lanes are to be milled 3.5” from Sta.

30+72.50 to Sta. 31+50.00 (77.5’) due to excessive rutting, and resurfaced with 2.0” of Type SP structural asphalt and a 1.5” lift of FC-12.5 friction course (TL-C).

PROJECT #2: SR 30 Resurfacing, FPID: 453548-1-52-01 Work Program Budget: $2.5M

The second project in Group 25-N includes the resurfacing of SR 30 (US 98) from west of Paraiso Boulevard to east of Regions Way and is a major east-west arterial through the City of Destin.

This segment services over 60,000 motorists daily and provides access to shopping centers like Destin Commons, Paradise Key, Shoppes at Paradise Isle, and Crystal Beach Plaza. The proposed roadway and pedestrian enhancements will improve safety, ride quality, and help manage congestion for residents and visitors navigating this high-volume corridor.

Milling & Resurfacing: Not unlike the SR 293 pavement design, the three Typical Sections for SR 30 (US 98) also call for milling the existing asphalt pavement 2.0” and resurfacing with 2.0” of FC-12.5 friction course (TL-C). These typicals also show existing bike lanes, turn lanes, and crossovers to be milled 1.5” and resurfaced with 1.5” of FC-12.5 (TL-C).

BOTH PROJECTS

Concrete Sidewalk & Curb Returns: In addition to milling and resurfacing, both projects include 4” and 6” concrete sidewalk repairs/replacement, as well as changes to the curb cut ramps to better align with ADA standards.

Pedestrian and Traffic Signalization: Resurfacing of the SR 293 intersections at US 98 and Commons Drive, as well as the intersections of US 98 and Crystal Beach/Legendary Drive will include new traffic detection loops as well as pedestrian signal assemblies, pushbuttons, and signing. The signal quantities show a combined total of 15 new polycarbonate signal heads being installed, with the existing signals that remain getting new anti-reflective backplates.

Signing and Pavement Markings Improvements: Lastly, improvements to this section of SR 293 and SR 30 will include new signing and thermoplastic pavement markings, as well as tubular markers, durable paint at median noses, and RPMs. All signalization work will be observed and inspected by SSR’s IMSA Certified signal inspector, Jerrye Barriger.

UNDERSTANDING OF PROJECT ISSUES

During our site visit(s) and from discussions with FDOT Operations and Maintenance staff, as well as the EOR, our team observed several potential issues that could arise during construction—some attributed to the design plans themselves.

Utility Conflicts / Utility Work Schedules

Issue #1: The General Notes list 12-13 utility companies and/or stakeholders in the vicinity of these projects. Beginning with the preconstruction conference and throughout the project duration, close utility coordination will be a critical component of successfully completing this project. The project specifications provide a link to four executed Utility Work Schedules (UWS) which add 13 days to contract time for relocates, adjustments, and expose and protect measures. The UWS for Destin Water Users includes five (5) valve boxes that are to be adjusted via a Utility Work by Highway Contractor Agreement (UWHCA).

Resolution #1: SSR’s Project Engineer, Eric Broome, will coordinate closely with all utility owners and seek assistance from the Area Utility Manager, John MacDonald, and his assistant, Kathy Ozmore, when needed. SSR has a great working relationship with utility owner representatives Shawn Croft (Okaloosa Gas) and Monica Wallis (Destin Water Users).

Safety while working near pressurized gas transmission lines is a huge safety issue and our team will ensure that Okaloosa Gas representatives are onsite when work is being done in the conflict areas identified in the UWS. We will coordinate the valve adjustments for Destin Water Users with the contractor or subcontractor when final grades have been established. These adjustments are included and will be paid for under Pay Item #425-6 (SR 30, FPID: 453548-1-52-02). In addition, during a site visit SSR observed an exposed fiber optic cable running in the southbound drainage conveyance through sidedrains and MES’s parallel to SR 30 (US 98). If selected, SSR will be prepared to investigate this further in order to minimize any potential delays at the onset of construction.

Quantities Review

Issue #2A: During our review of the contract quantities, SSR noted that Pay Items #102-104 and #102-107-1 for Temporary Signalization and Temporary Traffic Detection are included in both plans sets for the SR 293 / SR 30 intersection thereby doubling the necessary quantity of 250 ED for that particular intersection and possibly leading to an inflated bid. Resolution #2A: SSR has communicated this issue to the EOR so that changes can be made to the final bid quantities prior to project letting.

Issue #2B: During our review of the contract specifications package, SSR noted that Article 678-2 – Traffic Controller Accessories (pg. 19) includes a specific Malfunction Management Unit (MMU) for the existing controller (APL #678- 016-008), however there is no pay item in the plans to cover the cost of this equipment. Resolution #2B: Upon further review, SSR noted that the designer did include a “Design Note” for Pay Item #632-7-1, Signal Cable, New, F&I, on page 20 of the Quantities Report for FPID: 410390-3-52-01; however there is no mention of this in the associated pay item notes on Sheet T-2 of the Signalization Plans. SSR has communicated a recommendation to the EOR to add a pay item note for clarification so that potential bidders will not overlook this item and its cost resulting in a possible claim or needed supplemental agreement during construction.

Eberle Design – Malfunction Management Unit Type 16

(APL #678-016-008)

Issue #2C: In reviewing the typical sections and quantities for both projects, the SSR Team noted that several typicals call for areas of clearing and grubbing that overlap with the standard sod and shoulder treatment areas. The secondary quantity associated with Pay Item #110-1-1 (LS) is 0.07 acres for SR 293, and 0.97 acres for SR 30. Resolution #2C: SSR believes that Pay Item #110-1-1 is not needed in this situation as most of the sod and shoulder work should be included under Pay Items #570-1-1 and #570-1-2. Further, in areas where sidewalk and curb ramps are being modified, portions of the existing concrete are being removed and paid for as concrete removal (#110-4- 10). SSR has questioned the EOR as to whether the added cost associated with including a clearing and grubbing pay item is warranted. Further quantity revisions may be forthcoming prior to bid letting.

MOT Phasing and Pedestrian Safety

Issue #3A: This segment SR 293 and SR 30 is a popular destination for both locals and tourist alike. The need for proper and relevant work zone signing—both advanced post-mounted and PCMS messaging—will be crucial to the safety and success of the project. Resolution #3A: The SSR Team will work diligently in assuring that all PCMS message boards are operable and displaying relevant work zone safety messages through all phases of construction. In addition, SSR’s Project Engineer, Eric Broome, will coordinate with District Three’s Traffic Operations to effectively utilize the new ITS Dynamic Message Boards located within the vicinity of the project limits on both SR 30 (US 98) and the Mid-Bay Bridge Toll Plaza.

Issue #3B: Given the location of the SR 293 and SR 30 projects, including the proximity to Florida’s world-renown beaches and other tourist attractions, there is an increased likelihood of pedestrians (walking and bicyclist) in and around the work zone.

Furthermore, given that daytime lane closures are prohibited, most of this work—especially milling and resurfacing—will have to be completed at night. This elevates an already existing safety concern even higher. Further, given that MOT Typicals for Phase IIIA (SR 293) and Phase IIB (SR 30) depict bicyclist sharing a lane with vehicular traffic, the risk of a work zone accident involving a pedestrian will be at the highest level.

Resolution #3B: SSR has reviewed the MOT Plans and proposed phasing in-depth. It is our opinion that both Phase II (SR 293) and Phase IIB (SR 30) can be accomplished without shifting the existing bike lane to a shared lane with vehicular traffic. This would greatly lower the potential risks for nighttime accidents during this phase of the project which calls for constructing concrete sidewalk, curb ramps, signing, and signalization items only (no paving operations). This could be accomplished for SR 293 by leaving the two inside travel lanes open and closing off the outside lane and existing bike lane only.

The contractor will likely be using cones (not drums) which could be used in the remaining 16’ of pavement to create a 4’ bike lane away from the sidewalk work and still leave a 10’ “closed” lane for ingress and egress of the work crews. If selected, SSR will explore these options further and discuss possible changes to the MOT Plan that would increase the safety of pedestrians traversing the work zone.

Concrete Sidewalk / ADA Compliance

Issue #4A: Blocked Crosswalks – During a field review, the SSR Team observed that all four approaches to the intersection of SR 293 and SR (US 98) include right turn lanes separated by pedestrian islands. The pedestrian islands also include the mast arm foundation and poles or pedestrian signals in addition to crosswalks connecting the island to the adjacent sidewalks across the right turn lane. More often than not, vehicles entering the right turn lane would que up while waiting to merge and block the pedestrian crosswalk which resulted in pedestrian having to wait on traffic to clear, or either walking in and around traffic outside of the striped crosswalk. Resolution #4A: SSR proposes to simply add MUTCD sign #R51-5a “Yield Here to Pedestrians” to each quadrant of this intersection (to the right of the turn lane and along the shoulder) which would draw the attention of drivers to the crosswalk and, hopefully, eliminate vehicles queuing up and blocking the crosswalk itself.

Issue #4C: Pedestrian Islands – The contract plans for SR 30 (US 98) depict 1.5” milling and resurfacing of the asphalt walkways located between the concrete pedestrian island “bump-outs”. For the contractor to accomplish this, a small milling head or possibly handwork would be needed which is very tedious, time consuming and costly. What’s more, the finished asphalt would have to be hand compacted (not rolled) and cold result in a very rough texture not conducive to pedestrian traffic, especially those in wheelchairs, scooters, bikes, etc. Resolution #4C: If selected, rather than proposing the costly fix to remove and totally reconstruct these islands out of new concrete, SSR will work with the Contractor to cut one 6” investigative core at each pedestrian island location. If no depth or other concerns are found, the limits of the existing asphalt in the island areas—from curb-to-curb—could be removed and replaced with 6” concrete as opposed to paving back with asphalt. Concrete would produce a smoother, longer lasting, and more maintenance free surface in these areas until the island are removed and/or totally reconstructed on a future project.

Issue #4D: Lastly, SSR noted several areas where proposed sidewalk repairs did not conform to minimum ADA widths, where potential dropoff hazards exist that were not addressed in the design, and existing pedestrian handrail that was in disrepair.

Resolution #4D: If selected, SSR will identify and quantify these areas for review with FDOT Operations staff. If agreed to and field changes are warranted, SSR will provide the Contractor with red-lined plan revisions (as-builts in advance) to efficiently address these safety concerns making the project even more of a success.

QUALITY CONTROL & ASSURANCE

The SSR Team is committed to providing the Department with top-level staffing that meet the CEI Scope of Services for this contract. To accomplish this, SSR will accurately document all aspects of the Contractor’s work via thorough DWR’s and will maintain project files in accordance with the CPAM and Department EDMS requirements. In addition, SSR will submit a QA Plan which outlines our internal QA practices for FDOT Ponce de Leon Ops Project Manager, Troy Byers, to review and approve. It is important that any technical or other work products and deliverables are routinely checked and reviewed internally before submittal to the Department or filed to PSSP/EDMS. This includes daily records of work (DWR’s), job progress calculations, general project documentation, materials testing and certifications (MAC, APL submittals, etc.), potential change orders or supplemental agreements, and monthly progress estimates. Our Senior Project Engineer, Sharpie Smith, along with proposed Project Administrator, Eric Broome, and QA-QC reviewer David Donoho, will be responsible for ensuring that all work products are submitted for internal review and will implement SSR’s established processes and procedures throughout the duration of the construction contract. SSR will implement an objective quality assurance review (QAR) program with audits and checklists conducted at the start of the project and throughout the duration of construction in accordance with Department procedures and scope requirements.

Technology, Training, and Certifications: Our inspectors, led by Project Administrator Eric Broome, will perform verification sampling and testing of component materials through the District-wide contract with Terracon. As required, SSR will utilize the Materials Acceptance and Certification System (MAC) to document sample data and test results in accordance with the Job Guide Schedule (JGS). This will include utilization of the relatively new EERS component in MAC, resolving any material deficiencies through the Material Acceptance Resolution (MAR) process—such as rolling straight edge issues—and tracking all APL, BABA, and random samples as required by the Materials Manual. SSR will direct the Contractor to correct any observed discrepancies such that all materials incorporated into the project are in compliance and will document this effort through the MAR process. Our team of Engineers, Project Administrators, and Inspectors meet all of the CTQP certifications required for this contract. In addition, our staff is knowledgeable, experienced, and up-to-date with the latest FDOT applications being utilized on current CEI and Construction contracts, including:

• AASHTOWARE’s Project Construction (PrC)

• MAC / Electronic Earthwork Record System

• Causeway One.Network LCNS

• Project Solve Share Point / EDMS

TRUTH IN NEGOTIATION CERTIFICATION

375-030-30

PROCUREMENT

05/14

Pursuant to Section 287.055(5)(a), Florida Statutes, for any lump-sum or cost-plus-a-fixed fee professional services contract over the threshold amount provided in Section 287.017, Florida Statutes for CATEGORY FOUR, the Department of Transportation (Department) requires the Consultant to execute this certificate and include it with the submittal of the Technical Proposal, or as prescribed in the contract advertisement.

The Consultant hereby certifies, covenants, and warrants that wage rates and other factual unit costs supporting the compensation for this project’s agreement are accurate, complete, and current at the time of contracting.

The Consultant further agrees that the original agreement price and any additions thereto shall be adjusted to exclude any significant sums by which the Department determines the agreement price was increased due to inaccurate, incomplete, or noncurrent wage rates and other factual unit costs. All such agreement adjustments shall be made within (1) year following the end of the contract. For purposes of this certificate, the end of the agreement shall be deemed to be the date of final billing or acceptance of the work by the Department, whichever is later.

Instructions for Certification

Instructions for Certification - Lower Tier Participants:

(Applicable to all subcontracts, purchase orders and other lower tier transactions requiring prior FHWA approval or estimated to cost $25,000 or more - 2 CFR Parts 180 and 1200)

a. By signing and submitting this proposal, the prospective lower tier is providing the certification set out below.

b. The certification in this clause is a material representation of fact upon which reliance was placed when this transaction was entered into. If it is later determined that the prospective lower tier participant knowingly rendered an erroneous certification, in addition to other remedies available to the Federal Government, the department, or agency with which this transaction originated may pursue available remedies, including suspension and/or debarment.

c. The prospective lower tier participant shall provide immediate written notice to the person to which this proposal is submitted if at any time the prospective lower tier participant learns that its certification was erroneous by reason of changed circumstances.

d. The terms "covered transaction," "debarred," "suspended," "ineligible," "participant," "person," "principal," and "voluntarily excluded," as used in this clause, are defined in 2 CFR Parts 180 and 1200. You may contact the person to which this proposal is submitted for assistance in obtaining a copy of those regulations. “First Tier Covered Transactions” refers to any covered transaction between a grantee or subgrantee of Federal funds and a participant (such as the prime or general contract). “Lower Tier Covered Transactions” refers to any covered transaction under a First Tier Covered Transaction (such as subcontracts).

“First Tier Participant” refers to the participant who has entered into a covered transaction with a grantee or subgrantee of Federal funds (such as the prime or general contractor). “Lower Tier Participant” refers any participant who has entered into a covered transaction with a First Tier Participant or other Lower Tier Participants (such as subcontractors and suppliers).

e. The prospective lower tier participant agrees by submitting this proposal that, should the proposed covered transaction be entered into, it shall not knowingly enter into any lower tier covered transaction with a person who is debarred, suspended, declared ineligible, or voluntarily excluded from participation in this covered transaction, unless authorized by the department or agency with which this transaction originated.

f. The prospective lower tier participant further agrees by submitting this proposal that it will include this clause titled "Certification Regarding Debarment, Suspension, Ineligibility and Voluntary Exclusion-Lower Tier Covered Transaction," without modification, in all lower tier covered transactions and in all solicitations for lower tier covered transactions exceeding the $25,000 threshold.

g. A participant in a covered transaction may rely upon a certification of a prospective participant in a lower tier covered transaction that is not debarred, suspended, ineligible, or voluntarily excluded from the covered transaction, unless it knows that the certification is erroneous. A participant is responsible for ensuring that its principals are not suspended, debarred, or otherwise ineligible to participate in covered transactions. To verify the eligibility of its principals, as well as the eligibility of any lower tier prospective participants, each participant may, but is not required to, check the Excluded Parties List System website (https://www.epls.gov/), which is compiled by the General Services Administration.

h. Nothing contained in the foregoing shall be construed to require establishment of a system of records in order to render in good faith the certification required by this clause. The knowledge and information of participant is not required to exceed that which is normally possessed by a prudent person in the ordinary course of business dealings.

i. Except for transactions authorized under paragraph e of these instructions, if a participant in a covered transaction knowingly enters into a lower tier covered transaction with a person who is suspended, debarred, ineligible, or voluntarily excluded from participation in this transaction, in addition to other remedies available to the Federal Government, the department or agency with which this transaction originated may pursue available remedies, including suspension and/or debarment.
