PROCUREMENT

Metric and our sub-consultants have the available manpower, construction knowledge, skills, and ability to provide the CEI team to assure construction of a quality product for District Three.

UNDERSTANDING OF INTENT AND SCOPE OF

CONSTRUCTION PROJECT

This contract for this project mainly involves milling and resurfacing, polymer nosing, and ramp shoulder widening. It has Technical Special Provisions for Polymer Nosing for Bridge Expansion Joint and Ethernet Repeater and is scheduled to be constructed in five (5) typical sections on SR 8 (I-10), ramps at SR 81, CR 181A/Ponce De Leon Road, and Ponce De Leon Rest Area/Sunrise Circle.

In addition, there will be maintenance of traffic, erosion control, crossover construction, tree root & branch pruning, earthwork, utility work, vehicle detection, milling & resurfacing, overbuild (if needed at Sandy Creek Bridge), drainage work, pavement striping & markings, integrated multi-polymer pavement markings, guardrail removal & installation, shoulder gutter, mowing & liter pickup, and performance turf sod.

ISSUE: Accurate and timely utilization of the One.Network Lane Closure Notification System. SOLUTION: Metric field personnel will work closely with the contractor to ensure that they are entering the lane closure information correctly and timely into One.Network. If the contractor does not have the information entered, then Metric personnel will enter the information for them so that it is in the system. Additionally, we will communicate directly with the RTMC and District Public Information Office to communicate lane closures, traffic crashes, traffic alerts, and other valuable information to be disseminated to the travelling public.

ISSUE: Blue lights usually are positioned in the buffer zone or just prior to the beginning of the taper for lane closures. This has caused insufficient notice for the traveling public to move over prior to reaching the beginning of the taper. SOLUTION: Metric will get with contractor and on duty traffic officer(s) so that they are positioned in advance of the beginning of the lane closure.

This allows the traveling public to move over ahead of the lane closure as well as reduce their speed.

ISSUE: This project includes 120 calendar days after notice to proceed is issued to allow the contractor time to adjust work forces, equipment, schedules, and the procurement of materials. The contract time will begin when this time period ends or on the actual day that work begins at the site, whichever is earlier.

This has been an issue on other projects where the contractor wanted to start work immediately after the notice to proceed was issued, but the utilities required to be done prior to construction were not complete, project inspection personnel were not available, or permits required had not been obtained. SOLUTION:

Metric will start monitoring the progress of any required work, permits, etc. that are required prior to construction to ensure the contractor can begin work as soon as the notice to proceed is issued if they so elect. Also, all personnel assigned to the project will be available at least 30 days prior to the notice to proceed being issued.

ISSUE: Industry-wide material shortages and shortages of delivery trucks. SOLUTION: On behalf of the Department, Metric will work to mitigate potential shortages ahead of time and will consider the use of alternative aggregates or other materials.

Additionally, we will document the contractor’s efforts to mitigate the issue and keep accurate records as to the actual delay and cost to this project.

ISSUE: Maintenance of Traffic and Safety being emphasized on the project. SOLUTION: Our field personnel understand the significance of safety for the travelling public, contractor personnel, and inspection personnel. We will put safety first and work diligently to ensure that the MOT plans are implemented properly. Should our inspectors observe non-compliance or other safety issues, they will immediately call it to the attention of the contractor, document the issue, and work with the contractor to resolve the issue.

UNDERSTANDING OF PROJECT ISSUES

Maintenance of Traffic Issues and Solutions

ISSUE: 3-9 skip line through the intersecting ramps to accommodate autonomous vehicles. If the skips are not installed, it can cause the autonomous vehicles to veer off onto the ramp.

SOLUTION: Metric has reviewed the plans, and the 3-9 skips are shown for the ramps. We will discuss the significance of this issue at the pre-construction conference as well as ahead of the paving operations in the areas of ramps so that the skips are placed not only in the final striping but during each layer of asphalt pavement. There are not currently any 3-9 skip lines.

ISSUE: Lane closures are prohibited throughout SR 8 (I-10) project limits from 6:00 am until 8:00 pm Monday through Thursday and 6:00 am Friday to 8:00 pm Sunday. No ramp closures are permitted. SOLUTION: On similar projects in this area of SR 8 (I-

10) the contractor has requested to have the daytime lane closure restrictions modified so that all work could be done during the day Monday through Thursday. Metric is familiar with the process of getting the restrictions modified. We will perform the necessary hourly traffic counts, review the traffic counts, and make a recommendation with backup documentation for any modification of the restrictions to the department for review and approval/disapproval. We will also document the assessment of the Damage Recovery Fee per the special provisions if the lanes are not opened in a timely manner. When reviewing the contractor’s planned work from his Two Week Look Ahead, we will review the dates and work items with him to avoid violation of the lane closure restrictions.

ISSUE: On previous projects the contractor placed the cones approximately two feet outside the work area to incorporate the milling of the asphalt. However, they usually do not move the cones back once the milling machine has passed. This creates many of the cones being knocked over by the traveling public. SOLUTION:

Metric will discuss this issue at the pre-paving meeting as well as work closely with traffic control personnel to ensure that the cones are placed back after milling and any cones that are knocked over are placed back up. This operation must be performed continuously during the paving operations.

Asphalt Issues and Solutions

ISSUE: The traffic control plans in phase two (2) show milling and placing structural asphalt on the four (4) foot paved inside shoulder in order to remove the rumble strips as the first paving operation.

This operation does not leave a smooth paved shoulder because you would have to place the structural asphalt with equipment other than an asphalt spreader. On all our previous SR 8 (I-10) projects, the contractor has elected to mill and place structural asphalt on the ten (10) foot paved outside shoulder first in order to remove the rumble strips. They would then mill and place structural asphalt on the travel lane and shoulder in the same operation (paving would be sixteen (16) foot wide plus or minus the six (6) inch offset). They may also elect to mill and place structural asphalt on the outside lane prior to milling and placing structural asphalt on the inside lane and paved shoulder. SOLUTION: Metric would discuss the planned sequence of construction with the contractor at the pre-paving meeting so that all parties are aware of the contractor’s planned means and methods of construction. We also believe this is the best method to ensure a smooth pavement surface.

ISSUE: The plans on sheet 3 indicate the eastbound approach and departure slabs at SR 81 overpass and eastbound departure slab at Sandy Creek Bridge to be milled and resurfaced 3 ¾” total depth.

The mainline milling and resurfacing depth is 2 ¼”. This could impact the concrete bridge end as well as the base course leading up to and exiting the approach slabs. The plans state that milling depth should be adjusted to avoid any impacts to the existing concrete pavement as well as should base material be encountered, the contractor shall contact project administrator for potential adjustment to pavement design. SOLUTION: As on previous projects, Metric’s project administrator will be on site during these operations to modify the milling depths in case either of the above conditions occur. It is imperative that a smooth milling and resurfacing transition is obtained in order to avoid a high spot, low spot and/or bump in the roadway occurs.

ISSUE: The plans state that the rest area is to remain open during milling and resurfacing operations. On the previous project to mill and resurface the rest area (Tony Jackson was the senior inspector), the contractor requested to mill the entire rest area and roads leading to/from the rest area. The resurfacing was done after all milling is complete. SOLUTION: If a similar request is received, Metric will coordinate with the department and provide an approval/disapproval back to the contractor.

ISSUE: The contractor will use either in place or to be constructed crossovers for trucks to turn around in. This has been an issue on previous projects with the traveling public approaching a turning truck that is moving significantly slower than the traveling public in the inside (fast) lane whether entering or exiting the crossover.

SOLUTION: The department has required the contractor to set up lane closures in both directions to prevent this occurrence. Metric will discuss this issue with the department for guidance on what will be required of the contractor. We will then discuss with the contractor at the asphalt pre-paving meeting the requirements so that all parties are aware of the requirements.

ISSUE: Any final overbuild layer required on the project should be placed with the structural asphalt layer if thickness allows. If it is not it creates ride issues. SOLUTION: Metric will discuss this issue at the pre-paving meeting and ensure the final overbuild layer is placed with the structural asphalt layer.

Erosion Issues and Solutions

ISSUE: There are edge drain outfalls on the shoulder of the project which are either stopped up with grass & debris or not functioning.

This causes lower MRP ratings. SOLUTION: Even though the outfalls are not indicated on the plans, Metric will locate all outfalls from the edge drain and give a list of the outfalls that need to be removed under this contract to the contractor. We will process a work order for the additional cost of this work.

ISSUE: There is subsoil removal of approximately two (2) 2 feet +/-on plan sheet numbers 39-41 for the SR 81 eastbound exit ramp.

This can create an unsafe drop-off condition unless the edge of pavement is safed up after each day’s operation per the standard plans. SOLUTION: Metric will address this area in the weekly meeting prior to the work commencing so that all parties are aware of the importance of preventing any unsafe drop-off condition. We will use our rovers and Tremble Business Center program to document all earthwork quantities.

Other Issues and Solutions

ISSUE: Making sure that all permit requirements for the black bear, indigo snake, etc. are followed., SOLUTION: Metric will review all permits prior to the pre-construction conference and ensure these requirements are discussed extensively during the conference as well as followed up during construction should the endangered species be encountered. Should any endangered species be encountered, we will immediately stop work, document, time, location, and details of the encounter, adhere to sub article 7-1.4 & instructions handed out at the pre-construction conference, and contact appropriate personnel of the encounter.

ISSUE: There are two (2) Technical Special Provisions 1) Polymer Nosing for Bridge Expansion Joint and 2) Ethernet Repeater on this project. On previous projects the technical special provisions have not been followed. SOLUTION: Metric is familiar with both Technical Special Provision as we have had similar provisions and developmental specifications on previous projects. With the polymer nosing it is extremely important that the product manufacturer’s representative be onsite at the beginning of each repair to ensure that the contractor, Department, and Engineer understand all installation procedures and minimum curing periods. We will ensure that the product manufacturer’s representative is onsite prior to the work beginning.

With the ethernet repeater, it must be installed per Plans, manufacturer’s recommendations, NEC, and NESC as well as come with a 1-year warranty from the date of final acceptance covering defects. We will discuss the TSPs in detail at the project meetings prior to the work being done.

ISSUE: The plans call for tree root and branch pruning at four locations with each pay item. However, the plans do not indicate exactly what this pay item consists of. SOLUTION: Metric will discuss with the EOR what the intent of each location is. We will then discuss the intent with the contractor and have any subsequent meetings if needed so that all parties are clear as to the intent and work required at each of the four locations.

Potential Cost Saving Initiatives (CSI): Metric is knowledgeable of the CSI submittal and review process. We have participated in several CSI submittals and were directly involved with the largest CSI value submitted in District 3. Major items consisting of milling and resurfacing typically do not present the contractor with opportunities to submit a CSI. Metric understands the importance of Cost Saving Initiatives to the Department, and we will evaluate any idea submitted by the Contractor to determine if it meets the requirements of a CSI. If it does, we will schedule the Concept Meeting. Subsequently, we will evaluate the cost and savings for further submission and development of the Supplemental Agreement to incorporate the CSI into the contract.

QUALITY ASSURANCE / QUALITY CONTROL

Metric performs CEI Quality Assurance Reviews to assure that our CEI staff, including all subconsultants, are performing their tasks in substantial conformance with FDOT/CEI procedures as outlined in the Construction Project Administration Manual (CPAM), the Metric QA/QC Plan, and the CEI contract. The Quality Assurance (QA) Team for this project will consist of Darrel Burnett - QA Team Leader (SPE Review); Johnathan Taylor - QA Team Member (PA Review); Debbie Lark - QA Team Member (CSS, PrC, & EDMS Review); and Sheila Winkler - QA Team Member (RCS Review).

These team members will not be directly involved with the daily management of this contract, which will allow them to be objective in their review. The findings of the QA review along with steps taken to correct any deficiencies that were discovered during the review process will be submitted in a timely manner to Mr. Greg Rogers, FDOT Construction Project Manager. Metric will submit the QA plan for approval within 30 days following the award of the CEI agreement. The QA Plan will detail the procedures, evaluation criteria, and instructions to our team (including Metric and all subconsultants) on this project. QA reviews will be performed to evaluate the adequacy of materials, processes, documentation, procedures, training, guidance, and staffing of this project. We will perform the initial review within 60 days of the start of construction and at intervals not exceeding 6 months thereafter.

We will perform an initial QA review on items related to asphalt inspection upon the lesser of the completion of 10 workdays of paving or 25% of the asphalt pay item. Furthermore, we will perform any additional reviews requested by FDOT or FHWA. The QA Plan is extended to include all our team members and subconsultants working on this project. As a follow up, we ensure that the subconsultants also follow through with correcting any findings. The Electronic Earthwork Record System with Digital Density Logbook is required, and all Metric personnel are fully trained on the system. Metric has experienced and dedicated personnel to keep the necessary records for all operations. Metric will provide an additional QC process for the Electronic Earthwork Record System wherein our field and office staff will frequently monitor and assist the contractor’s QC to ensure that the correct number of tests are taken and that they are properly documented.

Management of Subconsultants / Accountability - The QA/QC process does not stop at the construction project level; it continues into the management of the CEI agreement. By continually tracking costs and available funds, we can work proactively with the Construction Project Manager to request any supplemental agreements or time extensions in a timely manner.

Metric has an internal process for managing our subconsultant funds to ensure that we meet our DBE and SBE commitments throughout the duration of this project.

Department Documents / Office Automation / Field Office / Vehicles / Equipment and Licensing - Metric will provide all items required by the Scope of Services, plus additional items that improve efficiency and safety. We propose to use our current office located at 1607 Highway 90, Chipley, Florida 32428, however, we have potential locations for offices that are closer to the project should the department want a closer office. Our proposed office is large enough to allow Metric to conduct the DBE workshop, progress meetings, and subsequent other meetings at the field office location. We plan to hold the pre-construction conference at the FDOT Ponce De Leon Operations Center.

Liaison / Performance of Consultant - Our staff will assess all issues that arise on the project and provide timely recommendations and answers to the contractor. It is Metric’s policy to inform, involve, and seek input from the FDOT Project Manager, Mr. Rogers, on project-related issues. We will provide him with the specifics of the issue and with our recommendations for resolution or interpretation of the project requirements.

Communication among all parties is the key to success! All administrative items related to invoices, personnel approvals, time extensions, and supplemental amendments will be submitted per FDOT rules and instructions to Mr. Rogers for review and approval.

General Requirements - Metric will administer, monitor, and inspect to assure this project is constructed in reasonable conformity with the plans, specifications, technical special provisions, and special provisions. Coleman Hatcher, P.E. (SPE) and Donnie Jackson (PA) will communicate all key project activities and coordinate all construction contract changes, supplemental agreements, and any outstanding issues with the CPM as they arise. In addition, Metric will prepare and attend any FDOT or FHWA inspections and ensure detailed project records are maintained for any requested in-depth reviews. Our staff is equipped with communication equipment which allows access to the team members by FDOT and the Contractor 24 hours a day, 7 days a week (weekends and holidays included).

On Site Inspection / Sampling and Testing / Engineering Services / Resident Compliance – Donnie Jackson (PA) will review all sampling and testing requirements to assure all activities are performed, verified, and recorded prior to the monthly estimate cutoff. The Metric inspection staff will monitor the contractor’s QC activities, identify and transport samples to the appropriate person(s) to test, and determine the acceptability of all materials and completed work items based on the test results, certified analysis, or verification of certifications. Metric will provide the necessary personnel to attend and/or conduct the Pre-Services meeting with Mr. Rogers, DBE Pre-Construction meeting with contractor and new EEO Compliance Manager, final estimates informational meeting with Mr. Robby Stone, EEO Compliance meeting with the new EEO Compliance Manager, PrC/EDMS meeting with Ms. Cheryl Ross, and environmental impacts meeting with Mr. John Smith, Ms. Shannon Chamberlin, and Mr. Joseph Mixon. Metric will provide a digital photo log of construction activities and video tape the pre-construction conditions throughout the project limits.

Public Information – The Scope of Services does not indicate who is responsible for public information. Metric can provide a Community Outreach Specialist, ABC Group, Inc. should the department wish. Metrics and ABC Group personnel are familiar with District Three PIO personnel and have worked closely with Mr. Ian Satter and his staff on previous projects to ensure they have timely information for the website, news releases, Facebook posts, e-mailings, etc. The team will also maintain a complaint/resolution log during the construction process to assist in a timely resolution of all issues. Metric and ABC Group have a long, successful working relationship together and have teamed on multiple projects located in District Three which includes currently working together on the SR 77 project in Wausau as well as many others.

Certification of Final Estimate - Metric’s internal QA reviews throughout the life of this project include reviews of each pay item for monthly and final estimates. Additionally, submitting material certifications and test results (QC, VT, and Resolution) are included in the QA review such that any issue associated with certifications or testing can be resolved timely. By following this process closely, we have submitted over 40 Final Estimates in a row without errors and have assured that the Materials Certification from SMO for each project was achieved in a timely manner. We recognize the need for accuracy and completeness of the digital Final As-Built Plans. We will track and document the changes electronically throughout the life of this project.

Doing so allows Metric to submit the Final As-Built Plans timely and ensures that they are accurate and complete. Metric will provide documentation according to our FDOT approved Final Estimates QC Plan. Within 30 days of final acceptance, we will submit the Final Estimate and the Final As-Built Plans documenting the Contractor’s work in accordance with CPAM and prepare the Offer of Final Payment. Metric is also well versed in the new “electronic (paperless) environment” that has been developed with Project Solve (PSSP). All Final Estimates documentation will be uploaded into EDMS via PSSP, including, but not limited to, the “Offer of Final Payment”, “digitally sealed Final Plans”, “certification of quantities”, etc. for review and certification/close-out processes by District Final Estimates Office.

CEI Contract and Agreement Management - Metric will prepare invoices monthly for the CEI services and submit them to Mr.

Rogers for his review and approval. Each monthly invoice will include a CEI/Contractor Work Effort Progress Chart and Graph documenting the CEI budget, CEI invoice number, month/year of the invoice, CEI dollars billed to date, CEI percent complete, contract start date, original completion date, original number of construction calendar days, remaining number of construction calendar days, the anticipated final contract date, the total CEI DBE/SBE dollars billed to date, the CEI DBE/SBE percent to date and a printout from the Equal Opportunity Reporting System showing the previous months payments made to subconsultants.

DBE/SBE Utilization – CEI and Contractor - Metric understands the “critical nature” of the Department meeting their DBE and SBE goals. Metric has worked with all the proposed subconsultant firms listed for this project and has an excellent working relationship without any issues or concerns about work performance. Our commitment to this project is a minimum 10% DBE and 15% SBE participation goal. A list of certified DBE subcontractors will be provided to the contractor at the DBE Pre- Construction meeting for potential utilization on this project.

Metric will continually encourage the contractor to utilize DBE subcontractors and work with them to locate qualified DBE subcontractors for the available work items.

EEO / RCS / Training Compliance – Angie Byers is the proposed Resident Compliance Specialist. Based on 375 contract days and $22,671,186 anticipated cost there will be eight (8) monthly labor interviews and six (6) trainees required. Mrs.

Pursuant to Section 287.055(5)(a), Florida Statutes, for any lump-sum or cost-plus-a-fixed fee professional services contract over the threshold amount provided in Section 287.017, Florida Statutes for CATEGORY FOUR, the Department of Transportation (Department) requires the Consultant to execute this certificate and include it with the submittal of the Technical Proposal, or as prescribed in the contract advertisement.

The Consultant hereby certifies, covenants, and warrants that wage rates and other factual unit costs supporting the compensation for this project’s agreement are accurate, complete, and current at the time of contracting.

The Consultant further agrees that the original agreement price and any additions thereto shall be adjusted to exclude any significant sums by which the Department determines the agreement price was increased due to inaccurate, incomplete, or noncurrent wage rates and other factual unit costs. All such agreement adjustments shall be made within (1) year following the end of the contract. For purposes of this certificate, the end of the agreement shall be deemed to be the date of final billing or acceptance of the work by the Department, whichever is later.

Instructions for Certification

Instructions for Certification - Lower Tier Participants:

(Applicable to all subcontracts, purchase orders and other lower tier transactions requiring prior FHWA approval or estimated to cost $25,000 or more - 2 CFR Parts 180 and 1200)

a. By signing and submitting this proposal, the prospective lower tier is providing the certification set out below.

b. The certification in this clause is a material representation of fact upon which reliance was placed when this transaction was entered into. If it is later determined that the prospective lower tier participant knowingly rendered an erroneous certification, in addition to other remedies available to the Federal Government, the department, or agency with which this transaction originated may pursue available remedies, including suspension and/or debarment.

c. The prospective lower tier participant shall provide immediate written notice to the person to which this proposal is submitted if at any time the prospective lower tier participant learns that its certification was erroneous by reason of changed circumstances.

d. The terms "covered transaction," "debarred," "suspended," "ineligible," "participant," "person," "principal," and "voluntarily excluded," as used in this clause, are defined in 2 CFR Parts 180 and 1200. You may contact the person to which this proposal is submitted for assistance in obtaining a copy of those regulations. “First Tier Covered Transactions” refers to any covered transaction between a grantee or subgrantee of Federal funds and a participant (such as the prime or general contract). “Lower Tier Covered Transactions” refers to any covered transaction under a First Tier Covered Transaction (such as subcontracts).

“First Tier Participant” refers to the participant who has entered into a covered transaction with a grantee or subgrantee of Federal funds (such as the prime or general contractor). “Lower Tier Participant” refers any participant who has entered into a covered transaction with a First Tier Participant or other Lower Tier Participants (such as subcontractors and suppliers).

e. The prospective lower tier participant agrees by submitting this proposal that, should the proposed covered transaction be entered into, it shall not knowingly enter into any lower tier covered transaction with a person who is debarred, suspended, declared ineligible, or voluntarily excluded from participation in this covered transaction, unless authorized by the department or agency with which this transaction originated.

f. The prospective lower tier participant further agrees by submitting this proposal that it will include this clause titled "Certification Regarding Debarment, Suspension, Ineligibility and Voluntary Exclusion-Lower Tier Covered Transaction," without modification, in all lower tier covered transactions and in all solicitations for lower tier covered transactions exceeding the $25,000 threshold.

g. A participant in a covered transaction may rely upon a certification of a prospective participant in a lower tier covered transaction that is not debarred, suspended, ineligible, or voluntarily excluded from the covered transaction, unless it knows that the certification is erroneous. A participant is responsible for ensuring that its principals are not suspended, debarred, or otherwise ineligible to participate in covered transactions. To verify the eligibility of its principals, as well as the eligibility of any lower tier prospective participants, each participant may, but is not required to, check the Excluded Parties List System website (https://www.epls.gov/), which is compiled by the General Services Administration.

h. Nothing contained in the foregoing shall be construed to require establishment of a system of records in order to render in good faith the certification required by this clause. The knowledge and information of participant is not required to exceed that which is normally possessed by a prudent person in the ordinary course of business dealings.

i. Except for transactions authorized under paragraph e of these instructions, if a participant in a covered transaction knowingly enters into a lower tier covered transaction with a person who is suspended, debarred, ineligible, or voluntarily excluded from participation in this transaction, in addition to other remedies available to the Federal Government, the department or agency with which this transaction originated may pursue available remedies, including suspension and/or debarment.
