INTRODUCTION: The Osiris 9 Consulting (O9C) Team is excited to demonstrate we are well suited to provide design services support to meet the unique needs of District 5 (D5) staff in this miscellaneous design continuing service contract (CSC). Our Team is comprised of an exceptional group of professionals with the necessary experience and understanding of the scope of services required. We are eager to work closely with Project Manager Victor LoPiccolo, CPM, to accomplish the Department’s objectives on this contract. O9C opened offices in Orlando and Gainesville in 2023. Our Orlando office is centrally located in D5, and our Gainesville office is 30 minutes away from D5’s northwestern boundary. Our headquarters in Jacksonville is less than one hour from the northeastern district boundary. This geographic coverage of D5, coupled with immediate responsiveness as projects arise, allows us to rapidly visit project locations or the D5 office in DeLand.

FOCUSED ON DEPARTMENT OBJECTIVES: Based on our meeting with Mr. LoPiccolo and the TRC Team, we understand our Team will be supporting D5 with unique and complex projects that may occur in waves and overlap. Therefore, we assembled the O9C Team with four redundant Teams that will jump into action when D5 requires it. We are committed to D5's priority of identifying and implementing innovative solutions with cost savings in the design, survey collection, and construction of any of these projects.

Our Team of professionals has a proven track record in their fields of specialization and will address the unique challenges and scope of any task work order (TWO) that arises throughout the contract life cycle. Our management Team has tremendous experience with TWO based contracts, serving as the prime consultant on seven current TWO based contracts and as a subconsultant on 13 other active TWO based contracts. We can rapidly issue TWO assignments in one day and our management system monitors TWO contract progress and budgets weekly.

375-030-22

PROCUREMENT

THE RIGHT TEAM: O9C staff have completed hundreds of TWO driven contract tasks for FDOT throughout the state and have developed a reputation for innovative solutions on some of the most prominent drainage projects within the State of Florida. In line with D5's priority for cost savings on this contract, we have assembled a group of consultant firms on our Team that have a history of working together, and each firm has many years of experience delivering projects for D5. Our strategic subconsultant Burgess & Niple (B&N), formerly ICON, successfully leads the current contract and has, according to Mr.

LoPiccolo, “Raised the Bar” for project delivery. They will lead a Task Team and provide guidance on project management procedures and quality assurance. The remaining subconsultants on our Team include: Florida Bridge & Transportation (FBT), DRMP, Environmental Science Associates (ESA), Arehna Engineering (AR), CivilSurv Design Group (SUR), Brindley Pieters & Associates (BPA), and Geotechnical & Environmental Consultants (GEC). B&N, DRMP, GEC and ESA are non-BDI firms, and their participation will be significantly less than the maximum allowable 45%. See Table 1:

Leadership Team for a summary of key staff, years of experience, and roles proposed for each Team member. We have 30+ additional staff, not in Table 1, available to assist in any assignment.

RELEVANT TEAM EXPERIENCE: SR 400 and I-4 Drainage Study: Expert drainage investigation and report in response to local business accusations of increased flooding from the I-4 Ultimate construction that escalated to the US Congressional attention.

SR 421 (Dunlawton Ave) Drainage Study: District Secretary’s special request for a forensic approach to determine roadway overtopping. Modeled Halifax Canal for bank improvements and upgraded emergency response measures to prevent overtopping.

SR 13/CR 13 Culvert Extensions: Design and permitting of 25 cross drain extensions to remove drop-off hazards from the clear zone and other improvements such as a nutrient removal baffle box.

Fountain of Youth Drainage Study: Flooding in two small neighborhoods escalated to politicians. A brief study resulted in scaled plans for immediate construction.

SR 35 (US301) From North of CR 470 E to SR 44 Expansion: Over a dozen new ponds sited with limited Right-of-Way (R/W), within OFWs, and impaired basins.

D5 Design Traffic CSC: Prime consultant with D5 TWO based experience.

D7 Drainage CSC (2019 & 2024): Major subconsultant with more than 10 TWOs.

KEY TEAM STAFF: Project Manager (PM) Leonardo (Leo) Valencia, PE, has 21 years of experience, including 10 years as an ERP reviewer for the St. Johns River Water Management District in Orlando. Leo has management experience on several TWO based contracts and his project experience ranges from drainage connection permit applications, road widening, and limited access projects to minor drainage, safety, and maintenance response projects. Deputy PM Christian Gyle, PE, CFM, has 20 years of experience and has an exceptional history of innovative drainage design and permitting to aid in navigating any permitting issues. Principal in Charge Walter Nemecek, PE, has 27 years of experience designing and managing a wide range of over 50 drainage and flood improvement projects including master stormwater models, forensic investigations, and innovative ERP solutions saving over $10 Million in R/W. Most O9C design staff have worked with Walter for their entire careers on some of the most challenging projects in Florida. Imran Ghani, PE, AICP, former Florida Turnpike Enterprises PD&E Manager, founder of O9C, and Orlando Office leader, has tremendous understanding of D5 management priorities and will oversee Public Involvement and review TWO preparation. Satya Kolluru, PE, PTOE, has designed safety improvements on over 150 projects. He will provide input on safety improvements from the project’s outset and review designs at all milestones. Bryon Wuczynski, PE, served as engineer for I-75 RRR and will be responsible for signing and pavement marking (S&PM). Eric Olszewski, PE (B&N), has 19 years of experience including being the lead designer for the current drainage CSC contract with D5. Juan Valenzuela, PE (FBT), has 22 years of experience including serving as the D5’s districtwide structures CSC lead plans reviewer. Frank Lopez, PSM (DRMP), will lead the survey effort with 22 years of experience and has provided survey services for many D5 projects including the CSC C-A024 contract for D5. Tom Percival (O9C) has 50+ years of experience (34 working for D5). He will serve as a project resource and will lead QA/QC.

PROJECT APPROACH AND UNDERSTANDING OF CRITICAL ISSUES: Under this contract we will support and assist District staff in addressing drainage design concerns in anticipation of future issues or rapid response to unexpected and evolving drainage emergencies.

For both circumstances, our Team will provide innovative and long-lasting solutions. We understand that projects will vary in scope and could be the result of aging infrastructure or poor design. We listed critical issues anticipated for this contract.

Local Engagement: We are aware there is a human factor involved in addressing many concerns. This requires seasoned engineers experienced in engaging the public that can convey and explain complex issues in non-technical terms.

Therefore, once a project is brought to our attention, we will coordinate with Mr.

LoPiccolo to schedule a site visit to identify project issues. We will engage property owners, District staff, and other key stakeholders, and we will consider all concerns to develop innovative and cost-effective solutions to meet D5’s highest standards.

RACE Day: Osiris 9 is built on the principle that the best design is not done in a vacuum - instead all disciplines must collaborate. We developed an approach to problem solving called Rapid Alternative Concept Evaluation (RACE) Day. During RACE Day, a multi-disciplinary Team of drainage, roadway, traffic, safety, structural engineers, and environmental planners collaborate to efficiently develop and analyze innovative alternatives. Our goal is to create cost-effective and implementable alternatives to recommend to our clients. We accelerate design by utilizing immediately available data, including, but not limited to, LiDAR contours, R/W maps, GIS parcels, Web Soil Survey, and the National Wetland Inventory. This allows us to immediately begin design without needing to wait for surveyed information, and when more precise data is obtained, we make the necessary modifications to promptly finish off the design. For complex/tight designs, we use 3D design to verify tie-downs and to avoid/identify utility conflicts.

Drainage: Anyone can regurgitate designs from the drainage manuals, but FDOT staff call upon us because they know we think outside the box and develop practical solutions that other engineers miss. We have provided drainage solutions to FDOT throughout the state for hundreds of projects, including nutrient removal baffle boxes, regional ponds, flood reduction, and creating additional permitting credit from existing FDOT and municipal ponds. These innovative solutions eliminate R/W acquisition, reduce overall cost, and deliver projects ahead of schedule.

Permitting: Still available within the New State Stormwater Rule, we anticipate most projects within this contract will qualify for permit exemptions. If not, we will seek a General Permit to reduce application efforts and approval time. We will apply for an Individual Permit only if necessary. With 20+ years’ experience interpreting Florida Statutes with Water Management District staff we can expedite applications through the review process. General or Individual Permits approved after December 28, 2025, must demonstrate nutrient loading net improvement.

Environmental: All permits go through the ACOE since the supreme court ruling. With 26 years of experience, Eric Shneider anticipates reviewer needs to reduce and expedite applications. He understands mitigation nuance in D5 and the ACOE preferences.

Survey/SUE: Survey is a critical factor at the very earliest stages of any project and redundancy is critical to ensure we can meet any schedule. Therefore, we have partnered with DRMP and SUR to provide district-wide, reliable, innovative and effective survey service that keeps any project moving and staying ahead of schedule. Both firms have served FDOT for a combined total of 70 years. They provide a wide range of survey and SUE services. Some types can be performed rapidly with minimal disruption to traffic to better fit a “quick-burn” task.

Quality Assurance (QA) & Quality Control (QC): Two of O9C’s Core Values are Client Focused and Excellence Driven. We believe this is accomplished in large part by delivering high quality products. Every deliverable passes a strict Quality Control review that is approved by our Quality Control Manager, David Anderson, with more than 36 years of experience.

Task Management/Execution: Upon accepting a TWO, Leo will meet with the D5 PM to clearly define project goals, objectives, commitments, risks, scope and staff hours, and expedite delivery of required information to procurement. Leo will assign a TM, who is responsible for scope refinement, data collection (existing permits, geotech, survey, etc.), and a field review to identify existing deficiencies.

Cost Savings: We are keenly aware that inflation has driven up construction costs across all our projects in the last couple years. We understand the budget constraints of the Department on this contract and will identify innovative cost-saving measures to offset construction increases and any value-added costs.

Why The O9C Team? We have assembled a well-qualified Team and are eager to make this contract a success. Osiris 9 has a history of delivering high quality work to FDOT, with an average composite consultant grade of 4.0. We are confident our Team is the best choice.

Sincerely, Leo Valencia, PE – Project Manager, Osiris 9 Consulting, LLC

If the Attorney General declines to provide the requested attorney services, the Attorney General’s written approval shall include a statement that the private attorney services requested cannot be provided by the office of the Attorney General or that such private attorney services are cost-effective in the opinion of the Attorney General. The Attorney General shall not consider political affiliation in making such decision. The office of the Attorney General shall respond to the request of an agency for prior written approval within 10 working days after receiving such request. The Attorney General may request additional information necessary for evaluation of a request. The Attorney General shall respond to the request within 10 working days after receipt of the requested information.”
