About this file
This document is a Justification & Approval for Other Than Full and Open Competition for a simplified acquisition over the micropurchase threshold, dated April 8, 2026.
The acquisition concerns the compelling and urgent installation of government-furnished conduit for emergent electrical system repairs to support the FREEDOM 250 special event in North Dakota. The justification for sole source procurement is based on urgent and compelling circumstances rather than only one responsible source being available. The government requires new power conduit to enable installation of replacement power cables for restoration of street lighting to operational condition necessary for special event support. The increased public use of the property during the special event creates heightened safety and security concerns that necessitate the expedited timeline.
Market research was conducted and documented in the justification. Cordova Construction was identified as the contractor due to ongoing concurrent contracts in the park and its ability to mobilize and execute the repair quickly, whereas competitive bidding and open solicitation would defer necessary repairs. The park evaluated alternative methodologies including park-performed excavation and replacement, which would cause substantially more landscape damage and require greater labor intensity. The park also considered whether the repair could be handled under local micropurchase procedures, but determined the condition and extent of repairs exceed micropurchase service levels. Additionally, the option to replace local wire segments was deemed unlikely to succeed long-term given the extent of damage accumulated over multiple years of utility projects. The contracting officer, Philip McCall (Chief of Facility Management), certified on April 9, 2026, that only one source is available or urgent compelling circumstances exist, and that anticipated pricing will be determined fair and reasonable using FAR Part 13.106-3(a) price analysis techniques. The Contracting Officer (Joseph Kirk) signed on April 13, 2026.

JUSTIFICATION & APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION
for SIMPLIFIED ACQUISITIONS OVER THE MICROPURCHASE THRESHOLD (See FAR

Date: _4/8/2026 PR Number: ___TBD______________________
1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):
________Compelling and urgent installation of government furnished conduit for emergent electrical system repairs for special event support related to FREEDOM 250 North Dakota.
2. Sole Source Justification rationale (Check one and explain below):
______ Only one responsible source.
__x____ Urgent and compelling circumstances exist. Include critical delivery or performance dates, and when you became aware of the requirement. Provide a specific statement of the impact on Government operations, financial or otherwise, if the required delivery or performance dates are not met.
______ Other _____________________________________________________
Explain: _______________Special event occurrence for Freedom 250, public use of property will increase propensity of safety and security issues. New power conduit will advance governments’ ability to install replacement power cables for restoration of street lighting to operational condition necessary for special event support in A250.
3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received or anyone expressed interest:Cordova Construction has ongoing contracts in park concurrently. Cordova can mobilize and execute repair required where bids and open solicitation would defer repairs. The park explored other methodology for effecting this repair including Excavation and replacement Park Performed, an alternative that will do substantially more damage to the landscape and be more labor intensive. The Park also evaluated the local micro purchase market, the condition of and extent of needed repairs exceeds the micro purchase service level of contracting for which this work entails. Lastly the park evaluated the condition to repair and specifically replace local segments of wire.
The extent of damage which has occurred over multiple years of utility projects makes that alternative a less than likely chance of long-term success. _________________________________________
