About this file

This document is a Limited Source/Brand Name Justification under FAR 13.106-1(b)(1) for the simplified acquisition of Bad Elf Flex Mini (Standard) GNSS devices for the USDA Natural Resource Conservation Service (NRCS) in South Dakota. The USDA proposes to enter a sole source firm fixed-price contract for the purchase of 175 Bluetooth-enabled GNSS devices from Bad Elf LLC that provide 1-meter positional accuracy. Market research determined Bad Elf is the only vendor that meets the required capabilities of accuracy, Bluetooth connectivity, and cost-effectiveness. The total estimated cost is $****** with delivery within 30 days. Bad Elf LLC is a certified small business, and the USDA previously encountered poor customer service and lack of training support from the GSA vendor Monarch Products Corporation. This justification supports the associated federal contract opportunity for the Bad Elf Flex Mini Standard device.

United States Department of Agriculture Limited Source/Brand Name Justification

FAR 13.106-1(b)(1) – Simplified Acquisitions Control No. (if applicable) ______________________

1. Identification of the agency and the contracting activity.

U. S. Department of Agriculture (USDA), Natural Resource Conservation Service (NRCS) South Dakota (SD), 200 4th St Huron SD.

Procure Bad Elf Flex Mini (Standard) devices for Field Office use. NAICS code 334511

2. Description of supply or service required to meet the agency’s needs.

The USDA proposes to enter into a sole source firm fixed-price contract for purchase of Bluetooth capable GNSS devices with better than 1-meter positional accuracy from Bad Elf LLC, using the simplified procedures for certain commercial items under Federal Acquisition Regulation (FAR) Part 13.

3. The rationale or circumstances for limiting competition.

The Bad Elf GNSS Surveyor receiver units deliver 1-meter geographic positioning out of the box to the iPad/iPhone mobile devices for use in GPS field mapping activities in accordance with essential field work tied to Farm Bill programs. The Bad Elf Flex Mini (standard) is the most affordable one (1) meter Bluetooth device that connects to smartphones, tablets and other Bluetooth-enabled devices, allowing users to leverage their existing technology for accurate and real-time positioning. Bad Elf LLC is the only vendor and manufacturer of the GNSS Surveyor with Bluetooth capability with a one (1) meter accuracy. Further, the receivers would be compatible with existing equipment and GIS applications. Other brands would not be compatible.

4. A description of the market research conducted and the results or a statement of the reason market research was not conducted.

Substantial market research for GNSS receiver purchase was conducted by Alaska’s NRCS State GIS Lead with the Geospatial Enterprise Operations Branch (GEO). No other vendor and device manufacture combination was comparable to the Bad Elf GNSS devices positional accuracy, bluetooth capability, and cost. The Bad Elf GNSS devices provided comparable accuracy, ease of use, and capabilities that met the needs of NRCS conservation efforts and offered significantly higher accuracy levels than that of other units reviewed. South Dakota has utilized these devices in the past year at select locations and concur with the accuracy and compatibility of these units in comparison to similar devices. Bad Elf certified training specialists will add another layer of security available to train trainers and employees. Options for virtual and hands on trainings are included with the purchase of Bad Elf devices.

5. Estimated price, including all options, if applicable.

Bad Elf certified training specialists will add another layer of security available to train trainers and employees. Options for virtual and hands on trainings are included with the purchase of Bad Elf devices.
