About this file

This document provides a justification for a single source award in accordance with FAR 13.106-1. The Department of Veterans Affairs Network/Program Contracting Office 06 seeks to procure upgraded Diana Analyzers from Polymedco on a sole source basis for the Fayetteville and Hampton VA Medical Centers. The analyzers will allow for increased testing capacity to support a national mail-in Fecal Immunochemical Test program. As the incumbent supplier under FSS BPA 36C24620A0004 which expires in November 2024, only Polymedco's Diana analyzer is compatible with the existing consumables. Issuing a separate contract with another supplier would increase costs without opportunities for competition given the specialized requirements. Market research found no other sources. The contracting officer certified the justification as accurate based on FAR 13.106-1(b) criteria.

DEPARTMENT OF VETERANS AFFAIRS

Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C246-23-AP-4881 and 36C246-23-AP-5466

1. Contracting Activity: Department of Veterans Affairs, Network/Program Contracting Office 06, located at 100 Emancipation Drive, Hampton, VA 23667-0001, in support of VISN 06 VA Health Care System at 508 Fulton Street, Durham, NC 27705-3875 and 2300 Ramsey Street, Fayetteville, NC 28301-3856; 2237 #s 565-23-4-090-0193 and 590-23-4-985-0460.

2. Brief Description of Supplies/ Services Required and the Intended Use/Estimated

Amount: The estimated amount of this requirement is $136,936.00. The Fayetteville and Hampton VAMCs require their current high throughput fully automated high-throughput fecal immunochemical analyzers to be upgraded, installed, and tested before the option renewal on 12/01/2023 due to increased testing. NCO 6 seeks to procure the Diana Analyzer via a sole source open market purchase order. This equipment will allow the Fayetteville and Hampton VAMC Pathology and Laboratory Service the ability to run more Fecal Immunochemical Tests (FIT) to meet a national mail-in FIT program that is being spearheaded by Speciality Medical and Pathology and Laboratory in conjunction with the White House’s Moonshot Oncology program.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: VISN 6 holds a FIT lab cost-per-test Federal Supply Schedule BPA under award no. 36C24620A0004 for Analyzers and consumables to run the analyzer with Polymedco a small business. Polymedco’s Diana analyzer uses the same consumables as the analyzers under this BPA. The procurement of another company’s analyzer would require another cost-per-test contract with another company.

This would cost the Government more, and these costs would not be recuperated through competition.

4. Description of market research conducted and results or statement why it was not conducted: The required analyzer was not found on a mandatory supply sources contract vehicle. GSA Advantage, GSA eLibrary, NAC medsurg, and FPDS were searched for the automated fecal immunochemical analyzer with no results. Polymedco, a small business, currently holds VISN 6’s FIT lab cost-per-test BPA under award no. 36C24620A0004 which expires 11/30/2024. Under this BPA, the VISN is leased low throughput automated analyzers consumables and are invoiced on a cost-per-test basis. Previous CO correspondence with the Polymedco Customer Service Manager confirmed that the Diana analyzer is unavailable for purchase on their cost-per-test FSS award. Richmond VAMC purchased Diana Analyzer via the open market on 07/25/2022, contract #36C24622P1345.

Another analyzer would create a situation where the Hampton and Fayetteville VA Medical Centers would need to establish a separate cost-per-test contract with another company.

This would cost the Government more, and these costs would not be recuperated through competition. The VA Rule of Two cannot be met.
