VHAPG Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source Attachment 1: Single Source Justification for SAP under the SAT

Last Updated: 02/01/22 Page 1 of 2

DEPARTMENT OF VETERANS AFFAIRS

Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C257-23-AP-0648

JFOC#: 2023-02-22T13:40:33

1. Contracting Activity: Department of Veterans Affairs, Network/Program Contracting Office located at VA Central Texas Health Care System (VACTHCS), in support of VISN 17 VA Health Care System at 1901 Veterans Memorial Drive, Temple, Texas, 75604. Requirement number 674-23-1-029-0029.

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: This order is for the UroNav MRI/US Fusion System, which is developed by Philips. This consists of an ultrasound and UroNav targeting device used for targeted prostate biopsies. The current equipment we have in Austin for prostate biopsies is 10 years old and at the end of life. In the meantime, we have been outsourcing these biopsies to the community which per cost analysis has cost the VA $203,299 in FY2021 alone. The service submitted a purchase proposal for these devices in 12/2021 (over 1 year ago). However, this has been delayed for various reasons at the NAC level. We are still currently trying to navigate the purchase process, however, this will take several months to resolve.

In addition, even upon purchase, delivery of UroNav device is delayed to the end of the year due to supply chain issues per Philips representatives. This resulted in the sole source order for rental.

Estimated value $102,084 one-year rental

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: UroNav MRI/US Fusion System is developed and distributed only by Philips.

Several mobile medical equipment providers were contacted for UroNav rental including ForTec, HealthTronics and MobileMed. In addition, Philips was contacted regarding possible rental avenues.

However, only ForTec is the sole supplier of UroNav in the United States for rental as confirmed through Philips (UroNav manufacturer). The contact for ForTec is Ken Bothwell, 512 897-6671, kbothwell@fortecmedical.com. The contact used for Philips is Kevin Coady (National Business Leader), (410) 236-9425, Kevin.coady@philips.com.

Before rental consideration, a purchase proposal was submitted 12/2021. However this has been delayed for various reasons at the NAC level. We are still currently trying to navigate the purchase process, however this will take several months to resolve. In addition, even upon purchase, delivery of UroNav device is delayed to the end of the year due to supply chain issues per Philips representatives.

4. Description of market research conducted and results or statement why it was not conducted:, Market research was conducted IAW FAR PART 10. Pursuant to FAR 10.002, this requirement is found to be commercially available; however, IAW FAR 8.002 and FAR 8.003, this requirement cannot be fulfilled through a mandatory source.

VIP VETBIZ results from VIP showed zero (0) SDVOSBs, and zero (0) VOSBs under keyword search UroNav Ultrasound. Results attached in Briefcase.
