About this file
This document is a justification for other than full and open competition regarding an annual service and maintenance contract for Honeywell R7044XL Plus controllers at the Nashville VA Medical Center. The contract is for a one-year period from October 1, 2020 to September 30, 2021 with an estimated value of $300,728.70. Only Honeywell can provide the required preventative maintenance for these proprietary controllers as third parties are restricted from accessing the licensed Honeywell Deltanet software that programs the system. The justification cites 41 USC 3304(a)(1) and an intent to sole source was posted on July 30, 2020 with no responses received. Market research found no other qualified vendors. The contracting officer determined the price to be fair and reasonable based on previous awards, estimates, and market conditions. The justification and sole source award were approved by the contracting officer, contracting officer representative, and branch chief. The contract was awarded to Honeywell Building Solutions SES Corporation for $299,548.45 beginning October 1, 2020.

DEPARTMENT OF VETERANS AFFAIRS
Justification and Approval (J&A) For
Other Than Full and Open Competition (>SAT)
Acquisition Plan Action ID: 36C249-20-AP-2886
1. Contracting Activity: Department of Veterans Affairs, VISN 09, Nashville VA Medical Center, 626-21-1-4148-0005
2. Nature and/or Description of the Action Being Processed: This acquisition is for the annual service/maintenance of the R7044XL Plus controllers programmed by the Honeywell Deltanet Computer Aided Engineering software. This is a firm fixed price requirement for the period of October 1, 2020 – September 30, 2021.
3. Description of Supplies/Services Required to Meet the Agency’s Needs: The Nashville VA Medical
Center requires annual service/maintenance of the R7044XL Plus controllers that exist through the facility. These controllers are programmed by the Honeywell Deltanet Computer Aided Engineering software. This work includes using the Honeywell Excel Building Supervisor computer system to conduct preventative maintenance on almost 10,000 points within the system. The points include sensors and controls on 56 air handlers, 7 chillers, 350 exhaust fans, and temperature and pressure controls located in critical areas of the hospital that maintain the proper hospital environment for patient care. The total estimated value of the proposed action is $300,728.70.
4. Statutory Authority Permitting Other than Full and Open Competition: .
( X ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per 41 USC §3304(a)(1) as implemented by FAR 6.302-1;
5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The Honeywell R7044XL Plus controllers are a critical part of the facility’s ability to provide safe patient care. The controls maintain a proper environment for essential areas such as isolation areas, surgical areas, and bone marrow clinics. These controllers are part of the Excel Building Supervisor system that is governed by a software license agreement. Under the terms of this software license agreement, third parties are not allowed to access this licensed software.
Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: The preventative maintenance of the Honeywell R7044XL Plus controllers is a proprietary service that can only be performed by Honeywell. Honeywell has provided a proprietary letter that has been filed in the contract briefcase.
6. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: To meet the regulatory requirements as required by FAR Part 13.106-3(2), the Contracting Officer has determined that this sole source firm fixed price service is fair and reasonable based on both the validity of the comparison and the price reasonableness of previous award prices, market research, and the Independent Government Cost Estimate.

Revision 09 Date: 04/17/2020
7. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: A VIP Search was conducted using NAICS code 811310 and keywords “Honeywell maintenance”. 118 SDVOSB vendors were returned on the search, however due to the proprietary nature of the service, none of these vendors can provide the required service.
Additionally, An Intent to Sole Source, 36C24920Q0340 was posted to Beta SAM on July 30, 2020.
Zero vendors responded to the Intent to Sole Source.
8. Any Other Facts Supporting the Use of Other than Full and Open Competition: These controllers are governed by a software license agreement. Allowing a third party other than Honeywell to provide the preventative maintenance would void this license agreement. The entire control system would be in jeopardy of failing and could result in halting patient care within the facility.
9. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:
Honeywell 2525 Perimeter Place Drive Nashville, TN 37214
10. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Due to the proprietary nature of the service, no additional actions can be taken to overcome barriers to competition.
11. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
