About this file

This is a Single Source Justification for a federal contract award under FAR 13.106-1 for purchases exceeding the Micro-Purchase Threshold but not exceeding the Simplified Acquisition Threshold.

The Department of Veterans Affairs, VISN 5 Clarksburg VA Medical Center (Acquisition ID: 36C245-27-AP-0538) is awarding a sole-source contract to Minburn Technology Group, LLC for remote software maintenance, error correction, and support services for the Biopoint PI software system currently in use at the Louis A. Johnson VA Medical Center. The contract will include all parts, materials, and labor necessary to provide comprehensive support services for the Biopoint system. The justification documents that Minburn Technology Group, LLC is the sole proprietary owner and developer of the Biopoint PI software application and holds exclusive access to the underlying source code, licensing rights, and technical architecture. No other contractor possesses the requisite capabilities to provide application version upgrades, technical documentation, and installation assistance for this proprietary system. Market research was conducted in accordance with FAR Part 10, including a Notice of Intent to Sole Source posted to SAM.gov, which yielded no responses from alternative sources demonstrating capability to meet the requirement. The Government obtained a letter directly from the software owner confirming that Minburn Technology Group, LLC is the only authorized provider of support, upgrades, and maintenance services for the Biopoint PI application. The Contracting Officer approved the purchase in accordance with FAR 13.106-1(b) under the authority of 38 U.S.C. 8127, with the certification digitally signed by Mark Smith on September 21, 2026.

VHAPG Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source Attachment 1: Single Source Justification for MPT up to SAT

Revision: 02 Effective Date: 12/30/2025 Page 1 of 2 Acquisition ID#

DEPARTMENT OF VETERANS AFFAIRS

Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the Simplified Acquisition Threshold

Acquisition Plan Action ID: 36C245-27-AP-0538

1. Contracting Activity: Department of Veterans Affairs, VISN 5 Clarksburg VA

Medical Center. 2237# 540-27-1-089-0005

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: The purpose of this requirement is to secure remote software maintenance, error correction, and support services for the Biopoint software currently utilized by the Louis A. Johnson VA Medical center. This contract shall include all parts, materials, and labor to complete support services for the Biopoint system.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: Minburn Technology Group, LLC is the developer and sole proprietary owner of the Biopoint PI software application currently in use at the VA Medical Center. As the sole proprietor of the underlying source code and application architecture, Minburn Technology Group, LLC is the only source capable of providing application version upgrades, associated technical documentation, and upgrade installation assistance for this proprietary system. No other contractor possesses the requisite access to the Biopoint PI source code, licensing rights, or technical architecture necessary to develop, test, and deliver upgrades or provide qualified technical support for this application.

Requiring a different contractor to reverse-engineer or independently support this proprietary software would not be technically feasible, would risk system instability and data integrity issues within a clinical environment, and would voice the existing software license/warranty terms. Therefore, only Minburn Technology Group, LLC can fulfill this requirement.

4. Description of market research conducted and results or statement why it was not conducted: Market research was conducted in accordance with FAR Part 10.

A Notice of Intent to Sole Source was publicly posted to SAM.gov to afford interested sources the opportunity to identify their interest and capability to satisfy this requirement. No responses were received from any other sources demonstrating an ability to meet the Government's requirement, confirming that Minburn Technology Group, LLC remains the only source capable of providing continued support for the proprietary Biopoint PI software application. Additionally, the Government obtained a letter directly from [software owner/manufacturer, if https://www.acquisition.gov/?q=/browse/far/13
