VHAPM Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source Attachment 1: Single Source Justification for SAP under the SAT
VHAPM Part 813.106 Page 1 of 2 Original Date: 08/30/17 Revision 02 Eff Date: 03/31/2020
DEPARTMENT OF VETERANS AFFAIRS
Justification for Single Source Awards IAW FAR 13.106-1 For
Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)
Acquisition Plan Action ID: UID 36C263-20-AP-4929
1. Contracting Activity: Department of Veterans Affairs, Network Contracting Office 23 (NCO23) for
VA Central Iowa Health Care System (VACIHCS), Facilities Management Engineering Department, Purchase Request Number: 636-20-4-9071-2329
2. Brief Description of Services required and the intended use/Estimated Amount:
VACIHCS has an emergent need for inspection and repair services for an automatic transfer switch (ATS) that has failed. The damage to the ATS was caused by force majeure and could not have been prevented. Temporary power connections and installation are required in order to maintain project equipment while a new ATS can be purchased. The approximate estimated value of these services is $99,339.86.
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: Due to the urgent matter of this need, competition for pricing for this requirement was unable to be completed. In addition, the ATS equipment in question is part of an on-going project at the facility which has not been accepted by the VA; however, the factory warranties have expired due to lengthy delays in the project completion. It is believed that the damage to the ATS was caused by an irresistible compulsion or greater force, such as a lightning strike and could not have been prevented; therefore, no parties under the existing contract are at fault.
This work needs to be performed immediately as the inoperable ATS is causing power outages/failures to the overall chiller system and boiler plant operations; therefore, a sole source requirement is in the best interest of the Government to be able to make an award to a contractor who can meet the immediate need of services associated with this requirement, who has the knowledge of the systems involved, and who can provide the subcontractor’s builder warranty at the end of the on-going construction project. ABC Electrical Services is the only contractor who can meet all of these needs under this urgent and compelling requirement.
A delay in award of a contract could result in serious injury to employees of the Boiler Plant and others throughout the facility due to power failures to systems. A delay in award of a contract could result in other financial burdens to the Government by creating surges or other system failures due to this specific failure.
4. Description of market research conducted and results or statement why it was not conducted:
Minimal market research was conducted due to uniqueness of this requirement. As stated previously, immediate action needed to be taken by a contractor with knowledge of the existing and current systems and have the ability to provide a warranty of the work within the on-going construction project.

A VETBIZ search for SDVOSB and VOSB vendors in Iowa under NAICS 238210—Electrical Contractors and Other Wiring Installation Contractors was conducted and resulted in 5 vendors in Iowa;
however, none of them have the capability to provide the services needed within the immediate time constraints needed.
5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
