About this file

This document is a justification for a single source award under the simplified acquisition threshold for the Department of Veterans Affairs. The agency intends to award a contract to MediaNow Inc. for the rental of a Knightscope K5 Autonomous Security Robot, setup, one year of maintenance, and access to the FedRAMP authorized SaaS portal. The value is estimated at $92,000. Knightscope holds relevant patents and will not license their technology to other vendors, limiting competition to only Knightscope and their authorized resellers. Market research identified MediaNow as the only authorized reseller for this solution for the federal government. The contracting officer certified the justification as accurate and complete on September 12, 2023.

VHAPG Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source Attachment 1: Single Source Justification for SAP under the SAT

Last Updated: 02/01/22 Page 1 of 2

DEPARTMENT OF VETERANS AFFAIRS

Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C257-23-AP-4696 JOFOC Log Number: 2023-09-12T07:03:52

1. Contracting Activity:

The agency responsible for this acquisition is the Department of Veterans Affairs (VA), Network Contracting Office (NCO)17, San Antonio, Texas. The Department of Veteran Affairs proposes to enter into a contract on the basis of justification for other than full and open competition. This contract will be for the Audie L. Murphy VA Medical Center in San Antonio, TX.

Purchase Request: 671-23-4-4047-0458

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

This acquisition is the purchase of services that will supply the South Texas VHA/San Antonio VHA with the Knightscope Autonomous Robot Solution. The Solution service will consist of the rental of a K5 Autonomous Robot, the Setup of the Autonomous Robot, the use of the Knightscope Users Web based Portal to interact with the Autonomous Robot, and 1 year worth of maintenance for the Autonomous Robot and Users Web based Portal. This will also include the required customer support and the FedRAMP ATO of the SaaS platform.

Estimated Amount: $92,000.00

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

Contact was made with Knightscope, the OEM, to see if they had a list of authorized resellers. The POC Mr. Jason Gonzalez stated Knightscope has multiple authorized resellers, but only one (1) authorized reseller of the K5 system that can work with the Federal Government. Mr. Gonzalez provided a signed letter from the OEM Knightscope that states MediaNow Inc., a VOSB, is the only authorized reseller of the K5 v5.2, designed specifically for the Federal Government due to being FedRAMP authorized. (See P11 Knightscope Federal Government authorized reseller letter)

Knightscope holds patents. They are not willing to share or sell them to competitors to allow them to obtain the technology, allowing others to be in the same competition space. Those patents are:

“Autonomous Data Machines and Systems” U.S. Patent No. 9,329,597, "Autonomous Parking Monitor” U.S. Patent No. 9,773,413, and "Systems And Methods For Security Data Analysis And Display" U.S. Patent No. 9,792,434, which make this SaaS very special and specific to Knightscope and no other competitor. The VA cannot obtain another competitor or competition to do those specific items thus limiting the competition only to Knightscope and their authorized resellers.
