Evaluation of technical capabilities: The Government will assess the strengths, deficiencies and weaknesses detailed in the technical volume of the vendor’s relevant experience as detailed in Section 2.1 of Attachment B – Quote Content and Format and the résumés of the consultants identified in the quote. This evaluation will also include a risk assessment related to the potential for the vendor’s technical capabilities to disrupt schedule, increase cost or degrade performance.

The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

C.1 INTRODUCTION/BACKGROUND

The Overseas Private Investment Corporation (OPIC), a self-sustaining agency of the U.S. Government, is seeking an audit of Rasun’s financial statements, commercial and financial performance, and compliance with contractual obligations.

OPIC (www.opic.gov) is an agency of the U.S. government, established in 1971 to mobilize U.S. capital and skills to help promote economic and social development in emerging markets. It helps U.S. businesses invest overseas, fosters economic development in new and emerging markets, complements the private sector in managing risks associated with foreign direct investment, and supports U.S. foreign policy goals.

OPIC’s political risk insurance, finance, and investment funds programs help U.S. businesses of all sizes invest in more than 150 emerging markets and developing nations worldwide. Over the agency’s 45-year history, OPIC has supported $188 billion worth of investments that have helped developing countries to generate over $13 billion in host-government revenues and create over 800,000 host-country jobs. Because OPIC charges market-based fees for its products, it operates on a self-sustaining basis at no net cost to taxpayers. OPIC has provided approximately $5.6 billion in guaranteed loans to nearly 70 privately-owned, privately-managed investment funds that make direct equity and quasi-equity investments primarily in new, expanding or privatizing companies in several dozen OPIC-eligible countries. The capital structure of each fund has historically been comprised of OPIC-guaranteed debt and limited partner equity commitments.

OPIC presently has outstanding commitments of approximately $2.6 billion in investment guarantees to 44 active funds.
