About this file
This is a regulatory notification from the New York State Department of Labor (NYSDOL) and the Office for People With Developmental Disabilities (OPWDD) regarding mandatory contractor registration requirements for public works projects. Effective December 30, 2024, all contractors and subcontractors seeking to work on Article 8 Labor Law projects must be registered with NYSDOL prior to bid submission and before commencing work. Bidders are required to provide their valid NYSDOL registration number in the designated space on bid forms; failure to do so will result in automatic bid disqualification. The NYSDOL estimates processing registration applications may take approximately 34 weeks, making immediate registration action critical for contractors to avoid project delays or bidding disruptions. For projects with bids due before December 30, 2024, but with work commencing after that date, contractors must complete registration before beginning work.
Subcontractors are prohibited from working on these projects without written approval from OPWDD. Additional information and registration instructions are available on the NYSDOL website, with frequently asked questions provided for clarification. Contractors requiring further assistance should contact the Bureau of Public Work and Prevailing Wage at 518-457-5589 or email labor.sm.pwask@labor.ny.gov. This registration requirement applies uniformly across all contractors and subcontractors without pricing variations or set-asides, and represents a compliance threshold rather than a procurement selection criterion.
