UNITED STATES

NUCLEAR REGULATORY COMMISSION

WASHINGTON, D.C. 20555-0001

February 04, 2011

SUBJECT: AMENDMENT NO. 1

REQUEST FOR PROPOSAL (RFP) NO. NRC-HQ-11-R-10-0007

ENTITLED, “U.S. NUCLEAR REGULATORY COMMISSION

HEADQUARTERS SPACE RENOVATION AND RECONFIGURATION

SUPPORT”

The purpose of this amendment is to 1) answer vendor’s questions; 2) revise the solicitation in response to vendor’s questions; and 3) revise the number of proposal copies that must be submitted; and 4) extend the closing date of the RFP to 2:00pm EST on Friday, February 18, 2011.

Accordingly, the solicitation is hereby amended.

(1) Following are answers to vendor’s questions:

Question #1: Would you please provide clarification as to the intention of this clause?

“Proposals for this requirement may only be submitted by qualified 8(a) vendors doing business within the geographical area serviced by the U.S.

Small Business Administration (SBA), Washington Metropolitan Area District Office.”

Because we have a legitimate satellite office in Sterling, VA are we eligible to participate in this procurement?

Answer #1: Per the Small Business Administration (SBA), firms that are not serviced by the Washington Metropolitan Area District Office (WMADO) would only be eligible if they have a “bona fide” office in the WMADO territory. Per SOP 80-05 the following is the definition of a bona fide office:

SBA's regulations provide, in pertinent part:

a. "Bona fide place of business", for purposes of 8(a) construction procurements, means a location where a participant regularly maintains an office that employs at least one full-time individual within the appropriate geographical boundary. The term does not include construction trailers or other temporary construction sites.

b. A participant's principal place of business is always a bona fide place of business for purposes of 8(a) construction requirements. A participant may have bona fide places of business in more than one location.

Therefore, if your firm has a bona fide office in the WMADO territory, then you would have to show a letter from your servicing district office to that effect to be considered eligible.

Question #2: Does your office have info regarding a possible incumbent for solicitation NRC-HQ-11-R-10-0007, U.S. Nuclear Regulatory Commission Headquarters Space Renovation and Reconfiguration Support? I would like to know who has the contract and the dollar amount.

Answer #2: The U.S. Nuclear Regulatory Commission publicizes all of its contracts through the Agencywide Documents Access and Management System (ADAMS).

Information on the system and access instructions can be found at:

http://www.nrc.gov/reading-rm/adams.html. The previous contract for similar services is contract number NRC-10-08-419, which can be accessed through ADAMS.

Question #3: Will the list of companies that attended the site be made available?

Answer #3: The attendee list for the site visit associated with solicitation No. NRC- HQ-11-R-10-0007 entitled, “U.S. Nuclear Regulatory Commission Headquarters Space Renovation and Reconfiguration Support” will not be published. However, the Interested Vendors List is available on the Federal Business Opportunities website:

https://www.fbo.gov/spg/NRC/OA/DCPM/NRC-HQ-11-R-10-0007/listing.html

Question #4: Please clarify whether or not an Offer Guarantee (Bid Bond) is required.

Page L-9 of the RFP states that a Bonding Capacity Letter is required; however, item 13B of the SF1442 indicates that an Offer Guarantee (Bid Bond) is required.

Answer #4: Offers are required to provide Bid Guarantee. The solicitation has been revised to include Federal Acquisition Regulation (FAR) clause 52.228-1 Bid Guarantee (Sep 1996). Please see clause I.17 on page I-14 of Attachment 1 to this amendment.

Question #5: Your task order 8(a) contract has a seed project. Your RFP requires a bondability letter from our firm but do you also need a bid bond for the seed project.

Answer #5: Offers are required to provide Bid Guarantee; please see Answer #4 above.

Question #6: The 1442 states that a "offer guarantee" is required. Section L.14 calls for a "letter from a licensed bonding company". Please confirm that a Bid Bond is not required.

Answer #6: Offers are required to provide Bid Guarantee; please see Answer #4 above.

Question #7: Please confirm the requirement for a bid bond. The SF-1442 indicates that a bid bond is required but there is no mention of a bid bond in the RFP. If a bond is required please provide the percentage and if a specific form is required.

Answer #7: Offers are required to provide Bid Guarantee. The Bid Guarantee shall be 20 percent of the bid price or $3,000,000.00, whichever is less. Offers shall use Standard Form 24 (see Attachment 5 to the attached revised solicitation).

Question #8: I cannot find the amount the bid security needs to be. Please let me know if you require a bid bond in 5% of the bid amount or 20%.

Answer #8: Please see Answer #7 above.

Question #9: Is the required bid bond for the sample project only? Is it for the overall price of the IDIQ contract (Sec. B.3)? Or is it for both, meaning that we need two separate bid bonds – one for the sample project and one for the IDIQ.

Answer #9: Only one Bid Guarantee is required; please submit Bid Bond (Standard Form 24) for the Sample Project/Task Order. However, offers must also submit evidence of bonding capability of at least $2 million per project and at least an aggregate bonding capacity of $5 million. Evidence of bonding capability shall be provided in the form of a letter from a licensed bonding company (surety).

Question #10: Please refer to Attachment 1, General Decision Number MD100137.

Will these General Decision wage rates be intact for the duration of this IDIQ contract or will it be updated for each option year?

Answer #11: The U.S. Nuclear Regulatory Commission is a federal agency and is exempt from federal and state taxes.

Question #12: Can you assist in clarifying the type of projects that the NRC is looking for in terms of Relevant Past Performance? Should past performance projects be single award or all IDIQ type contracts? What dollar range should the projects stay within?

Answer #12: Per the solicitation, offerors shall submit reference contracts that are similar in size and scope to the requirements identified in the solicitation. The solicitation does not dictate/require that the reference contracts provided are single projects or IDIQ/task ordering types. Reference contracts should range between $500.000 and $5,000,000.

Question #13: Past Performance. Please confirm that past performance need to be in the bid documents (volume 1) and not sent in prior to the bid date by the reference.

Answer #13: Past Performance information shall be submitted as part of Volume 1, which is due by the proposal deadline indicated.

Question #14: Under the Key Personnel section in Volume I of the proposal, you requested references for the key personnel. Are you referring to project/client references? Can they be from work performed when the employee worked for another company?

Answer #14: Yes, references provided for Key Personnel can be project/client references and may be from prior employment if the Key Personnel was in the same/similar position as the one they are identified for in your organization’s proposal.

Question #15: I could not find the liquidated damages for this solicitation. Please advise.

Answer #15: The liquidated damages clause is not included in the solicitation.

Question #16: Is there a specific form to be used for the Sample Project/Task Order price proposal?

Answer #16: No, no specific format is required for the price proposal for the Sample Project/Task Order. Offerors shall provide a firm-fixed price for the sample project/task order and backup documentation that includes a breakdown of the firm-fixed price of the sample project/task order detailing all labor categories, quantity of hours per labor category, pricing for material, equipment, general and administration costs, profit, bonds, and all other charges that the offeror intends to recover and perform.

However, there is a specific format that should be used for offers submission of their overall IDIQ contract price; see Section B.3 PRICE/COST SCHEDULE of the attached.
