SPECIAL NOTICE: 12318720Q0165

Description: NOTICE OF INTENT TO AWARD A SOLE SOURCE

The US Forest Service (USFS), Washington Office Procurement Support Branch, (herein after referred to as “WOPSB”) intends to issue a Firm Fixed-Priced purchase order under the authority of FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements and FAR 6.302-3, titled "Industrial mobilization; engineering, developmental, or research capability; or expert services." on or about March 23, 2020 to Motion Pro, Inc. for the USFS, National Technology & Development Center (NTDP) located in San Dimas, CA.

This requirement includes the purchase of, “Soter Fueling Systems (SFS)” to be used in forest and fire management activities. The SFS are used to allow for the operator to safely refuel equipment without the release of fuel vapors, reducing the potential for burn injury. The purchase of the SFS are needed to mitigate risk to operators, ensure mission readiness, and maintain the level of safety required for operators.

WOPSB intends to non-competitively award this requirement to Motion Pro, Inc. The SFS is proprietary to Motion Pro, Inc. and there are no other authorized vendors approved to provide this vaporless refueling system. Furthermore, the SFS is the only vaporless refueling system authorized to be used in conjunction with USFS equipment. The SFS is the only vaporless refueling system that has passed the stringent, controlled evaluation process for safety, strength, and deployment conducted and adopted by the USFS through a Cooperative Research and Development Agreement (CRADA) with Motion Pro, Inc.

As a result, any vendor other than Motion Pro, Inc. capable of providing a comparable model would not be approved by the manufacturer or per established USFS equipment approvals. Motion Pro, Inc. is the only source capable of providing the authorized SFS vaporless refueling system to use in conjunction with the USFS field equipment to maintain the safety of personnel, equipment, continuity of service, and the uninterrupted operation and mission readiness.

The North American Industry Classification System (NAICS) code for this requirement is 333111 with the size standard of 1,250 employees. This notice of intent is not a request for proposals or quotes.

However, all responsible sources may submit an offer and capabilities/narrative that proves by clear and convincing evidence that detail their ability to provide Soter Fueling Systems by Motion Pro, Inc. If said OFFER and capabilities/narrative is received within fifteen (15) calendar days of publication of this notice, the narrative will be considered by WOPSB. All responses must be submitted to the Government point of contact at the email address shown below. A determination by the Government not to open the requirement to competition based upon the responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
