Notice of Intent for Other than Full and Open Competition
Solicitation Number: NOI-623-2019-SPAP
Notice Type: Special Notice
Agency: US Agency for International Development (USAID)
Office: Somalia Field Office (SFO)
Location: USAID/ Kenya/East Africa (KEA)
USAID/KEA intends to negotiate a non-competitive award to Chemonics International Inc. to manage a
Strengthening Public Accountability in Parliament (SPAP) program that will run in parallel to Chemonics’ new Support to Four State Assemblies Project (SFSA).
Expected results under SPAP include:
1. Better management by Parliament of an inclusive legislative process that effectively engages citizens through public outreach, public hearings and related mechanisms, such as public participation in parliamentary committee meetings, hearings and debates that gather public and expert input.
2. Deepening and strengthening of existing oversight practices, such as robust legislative review of
Auditor General reports, including issuance of the follow-up recommendations to the executive.
3. More independent, interdependent institutions. Increased ability to amend bills and budgets submitted by the executive, and increased solicitation of testimony of executive officials before the parliament.
4. Greater capacity of MPs and staff on key committees, like budget and oversight, to instill principles and practices of accountability, including development and adherence to standard operating procedures for conducting comparative reviews of legislation and independent fiscal analysis of budget proposals and expenditure reports.
The above tasks are expected to result in a broad community of parliamentarians at the state and federal level able to accelerate the pace and quality of financial oversight with a higher degree of skill and more meaningful engagement with citizens.
USAID/KEA intends to negotiate non-competitively with only one source (Chemonics International Inc.)
under the authority of USAID Acquisition Regulation (AIDAR) 706.302-70(b)(5) which states that “An award for the continued provision of highly specialized services when award to another source would result in substantial additional costs to the government or would result in unacceptable delays.”
This is not a request for proposals. However, the Government may consider all expressions of interest received within fifteen (15) calendar days after date of publication of this notice. A determination not to compete this proposed follow-on contract based upon responses to this notice, if any, is solely within the discretion of the Government. Information or responses received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
Therefore, any responses to this notice must demonstrate clear and convincing evidence that competition would be advantageous to USAID and would not hinder USAID/KEA objectives. Please direct any responses to this notice to Mr. Sam Kraegel, Contracting Officer, at skraegel@usaid.gov with a copy to
Mr. Aziz Alibhai, A&A Specialist, at aalibhai@usaid.gov mailto:skraegel@usaid.gov mailto:aalibhai@usaid.gov
