OVERVIEW
The Act of October 1, 1974, (88 Stat. 1184) declared it a national policy to preserve for the benefit and inspiration of the people of the United States, as a national historical park, certain historic structures and properties of outstanding national significance located in Boston, Massachusetts. Faneuil Hall, located at Dock Square, Boston, is one of the outstanding historic sites mentioned in the Act. The City plays an important part in preserving the history of the City of Boston with Faneuil Hall being a historic structure that the City was given in 1742 and, as such, it is the desire of the City to promote the preservation, exhibition, interpretation and use of Faneuil Hall as part of Boston National Historical Park and it is the desire of the NPS to cooperate with the City in preserving the integrity of Faneuil Hall as an historic structure and to assist in furthering its preservation for the benefit of the American people as part of their national inheritance.
RECIPIENT INVOLVEMENT
The City of Boston agrees to:
1. Exert its best efforts to preserve, protect, operate and maintain the structure.
2. Wherever possible, grant the NPS the right of access to all portions of the site under its control at all reasonable times and cooperate in making historical studies dealing with the historic fabric.
3. Provide for access by the public to all public portions of the property at all reasonable times, as may be appropriate.
4. Maintain on display or make available for use under the terms of this agreement all-existing furnishings and artifacts presently displayed or associated with the history of Faneuil Hall. Changes to existing furnishings and artifacts may be effected by mutual agreement subject to review by the City's Arts Commission.
5. Be responsible for all public meetings in Faneuil Hall, including scheduling, issuance of permits, set up of the assembly areas and clean up after each event. Clean up includes but is not limited to sweeping, mopping, removal of all trash generated by such event and will be accomplished prior to the building's next opening to the public. When any public event is scheduled the Superintendent of Faneuil Hall for the CITY will provide, when possible, at least 72 hour notice to the NPS so that rescheduling of interpretive programs can be made on a timely basis.
6. Permit the NPS to interpret the main hall on the second floor through talks and other appropriate media. At times when the main hall is being used for public meetings, the CITY shall use its best efforts to allow the NPS to provide interpretive services in the fourth floor armory.
7. Be responsible for routine maintenance and janitorial services for the following areas in Faneuil Hall, which it occupies: the Superintendent’s Office on the Second Floor; the Third Floor balcony; the Fourth Floor; and attic.
8. Cooperate with the NPS on custodial and minor maintenance services for the interior of the second floor.
9. Make no material changes or alterations to the premises except by mutual agreement with the NPS.
10. Not allow erecting or placing upon the premises of any monument, marker, tablet or other material except by mutual agreement with the NPS.
11. Allow Faneuil Hall to be identified as a unit of Boston National Historical Park and will cooperate with the NPS in developing appropriate interpretive markers, signs and exhibits.
12. Include the NPS in all appropriate literature associated with Faneuil Hall as part of Boston National Historical Park.
13. Permit the NPS to provide interpretive services in the vicinity of Faneuil Hall. The location of physical facilities for interpretation is subject to approval by the City.
14. Be responsible for the provision and payment of all utility costs, and the maintenance and repair of all utility equipment and services.
15. Pay all utility costs for the Great Hall, seeking reimbursement from the NPS of Sixty (60) percent of those utility costs.

SINGLE-SOURCE JUSTIFICATION
DEPARTMENT OF THE INTERIOR
SINGLE SOURCE POLICY REQUIREMENTS
Department of the Interior Policy (505 DM 2) requires a written justification which explains why competition is not practicable for each single-source award. The justification must address one or more of the following criteria as well as discussion of the program legislative history, unique capabilities of the proposed recipient, and cost-sharing contribution offered by the proposed recipient, as applicable.
In order for an assistance award to be made without competition, the award must satisfy one or more of the following criteria:
(1) Unsolicited Proposal – The proposed award is the result of an unsolicited assistance application which represents a unique or innovative idea, method, or approach which is not the subject of a current or planned contract or assistance award, but which is deemed advantageous to the program objectives;
(2) Continuation – The activity to be funded is necessary to the satisfactory completion of, or is a continuation of an activity presently being funded, and for which competition would have a significant adverse effect on the continuity or completion of the activity;
(3) Legislative intent – The language in the applicable authorizing legislation or legislative history clearly indicates Congress’ intent to restrict the award to a particular recipient of purpose;
(4) Unique Qualifications – The applicant is uniquely qualified to perform the activity based upon a variety of demonstrable factors such as location, property ownership, voluntary support capacity, cost-sharing ability if applicable, technical expertise, or other such unique qualifications;
(5) Emergencies – Program/award where there is insufficient time available (due to a compelling and unusual urgency, or substantial danger to health or safety) for adequate competitive procedures to be followed.
The National Park Service did not solicit full and open competition for this award based on the following criteria:
(2) CONTINUATION
(3) LEGISLATIVE INTENT
Single Source Justification Description:
The activity to be funded is a continuation of an activity presently being funded as authorized by Congress under 16 USC 410z-1(b), and for which competition would have a significant adverse effect on the continuity or completion of the activity. The activity to be funded is a modification to an existing cooperative agreement. The City of Boston was non-competitively selected for this Cooperative Agreement because it is the owner of Faneuil Hall.
STATUTORY AUTHORITY
16 USC 1(g) authorizes the NPS to enter into cooperative agreements that involve the transfer of NPS appropriated funds to State, local, tribal governments, other public entities, educational institutions and private non-profit organizations for the public purpose of carrying out National Park Service Programs.
16 USC 410z-1(b) authorizes the Secretary of the Interior to enter into cooperative agreements with the City of Boston, the Commonwealth of Massachusetts, or any private organization to mark, interpret, restore, and/or provide technical assistance for the preservation and interpretation of any of the seven properties listed, which, in his opinion, would best be preserved in private, municipal, or state ownership, in connection with the seven outstanding historic sites in the Boston National Historical Park.
