About this file
This document is a Justification and Approval (J&A) for Other Than Full and Open Competition for the Naval Medical Research Command (NMRC). The document details a sole-source procurement of 125 license activations for GraphPad Prism software from GraphPad Software, LLC in Boston, MA, at a cost of $36,250.00 for Fiscal Year 2025. The procurement is justified because the software is already in use by over 100 NMRC researchers, switching would render previous data inaccessible, and GraphPad Prism is widely used by research institutions like NIH. The software is a commercial graphing and statistics program designed for scientists, offering intuitive data analysis and presentation capabilities, and is approved for use on the MedCOI network. The contract will be awarded using statutory exceptions 10 U.S.C. 2304(c)(1) and FAR 6.302-1 for sole-source acquisitions, with the previous contract from April 2022 totaling $57,925.00.

JUSTIFICATION AND APPROVAL
OTHER THAN FULL AND OPEN COMPETITION
1. Identification of the agency and the contracting activity.
This justification is executed by the Naval Medical Research Command (NMRC), Silver Spring, MD, on behalf of the Navy to meet Navy Expeditionary Medical Research requirements.
2. Nature and/or description of the action.
The proposed action is to award a contract to renew 125 license activations for GraphPad Prism software. The proposed source is GraphPad Software, LLC, 225 Franklin Street Floor 26, Boston, MA 02110.
3. Description of Supplies or Services:
NMRC researchers have a critical need to maintain access to GraphPad Prism on their government systems. The command currently has an agreement for 125 GraphPad Prism licenses that is available to all NMRC researchers. GraphPad Prism is a commercial graphing and statistics software designed for scientists and non-statisticians. It specializes in presenting choices for analysis types and presentation functionality. Each license authorizes NMRC researchers to utilize the latest DoD-approved version of GraphPad for one year. SEAT Rate Fiscal Year 2025 funds in the amount of $ $36,250.00 will be used to procure the licenses.
4. Identification of the statutory exceptions permitting other than full and open competition.
The statutory exception permitting other than full and open competition for this acquisition is 10
U.S.C. 2304(c)(1) and FAR 6.302-1 sole source (including brand name) acquisitions or FAR
13.106-1(b)(1) soliciting from a single source.
5. Demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.
GraphPad Prism is currently in use by over 100 NMRC researchers and switching to another program would render all previous data inaccessible and useless. It is also widely used by other research institutions such as the NIH, thus making data sharing among collaborators more efficient and effective.
GraphPad Prism is intuitive for NMRC researchers. A single click sends completed graphs or layouts to Microsoft PowerPoint or Word, making it easy to incorporate them into a presentation or manuscript. It allows for graph manipulation in the program it was exported into.
It can calculate statistical analysis of data sets that can be quickly copied and pasted from other programs such as Microsoft Excel. It does not require specialized training for operation.
This statistical program is approved by the Defense Health Agency to be operate on the MedCOI network.
6. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
GraphPad Software LLC is the only vendor authorized to sell license activations for GraphPad
Prism. No other vendor can offer estimates.
7. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The Contracting Officer shall determine the anticipated cost to the Government of the supplies/services covered by this Justification and Approval will be fair and reasonable by conducting a price analysis before an award is made. In addition, the Government anticipates that the negotiated contract price will reflect a discount from the GraphPad Software LLC’s commercial price list and will be determined fair and reasonable.
8. Description of the market survey conducted and the results, or a statement of the reasons a market survey was not conducted.
In January 2025, MID submitted a web inquiry to GraphPad seeking information on its varying licensing models including the Enterprise version. The vendor responded with information on their Pro and Enterprise licensing models and outlined pricing. After receiving an automated notification from GraphPad stating that the current license is set to expire in April 2025, MID confirmed that renewing GraphPad for another year using the same legacy licensing model was possible. GraphPad also informed MID that multi-year agreements were no longer available for purchase. MID received an estimate from GraphPad to activate 125 GraphPad Prism licenses for an additional year.
9. Other facts supporting the use of other than full and open competition.
The requirement for statistical software was completed via sole source in April 2022. The contract was awarded to GraphPad Software LLC through contract N3239822P030626, totaling $57,925.00.
10. Listing of Sources, if any, which expressed, in writing, an interest in the acquisition.
GraphPad Software LLC is the only vendor authorized to sell license activations for GraphPad
Prism. No other vendor can offer estimates.
11. Statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
Future requirements will be synopsized in accordance with FAR 5.203.
For the reasons set forth in Paragraph 5, NMRC has no plans at this time to compete future contacts for the types of supplies/services covered by this document. If another potential source emerges, NMRC will assess whether competition for future requirements is feasible.
12. Point of Contact:
