(End of Addendum to FAR 52.212-1)
Addendum to FAR 52.212-1, Proposal Preparation Instructions
FAR 52.212-1 is hereby amended to reflect the changes shown below as to the specific paragraph revised.
Paragraph (b) Submission of Offers. The following amends this paragraph with respect to the information and documents required for submission in response to this solicitation.
(1) ELECTRONIC OFFERS. The offeror shall submit electronic offers in response to this solicitation unless otherwise specified herein. The offer must arrive by the time specified in the solicitation to the following email address: Lisa.Schaupp@nih.gov .
(2) PROCESS FOR AWARD. Award will be made to the Best Value Offeror consistent with the evaluation criteria discussed at FAR 52.212-2 and Addendum to FAR 52.212-2.
a) Selection of an offeror for contract award will be based on an evaluation of proposals against three factors.
The factors in order of importance are: technical, price, and past performance. Although technical factors are of paramount consideration in the award of the contract, both past performance and cost/price are also important to the overall contract award decision. All evaluation factors other than cost or price, when combined, are significantly more important than cost or price. The Government intends to make an award to that offeror whose proposal provides the best overall value to the Government.
b) Offerors are advised that award will be made to that offeror whose proposal provides the combination of features that offers the best or greatest overall value to the Government. The Government is more concerned with mailto:Lisa.Schaupp@nih.gov obtaining performance capability superiority rather than lowest overall cost. However, the Government will not make an award at a significantly higher overall cost to the Government to achieve only slightly superior performance. Overall cost to the Government may become a significant determining factor for award of a contract as proposals become more equal based on the other factors. In any event the Government reserves the right to make an award to the best advantage of the Government, cost and other factors considered.
c) The evaluation will be based on the demonstrated capabilities of the prospective Contractors in relation to the needs of the project as set forth in the RFP. The merits of each proposal will be evaluated carefully. Each proposal must document the feasibility of successful implementation of the requirements of the RFP. Offerors must submit information sufficient to evaluate their proposals based on the detailed criteria provided in the solicitation.
(3) BASIS FOR AWARD. Award will be made to the offeror that proposes: a technical proposal conforming to the requirements of the solicitation; has an acceptable record of past performance; its price is determined to be fair and reasonable by the contracting officer; and the contracting officer determines the offeror is responsible in accordance with FAR Part 9. The Contracting Officer intends to award without discussions, but reserves the right to do so in his or her sole discretion.
(4) The Government may reject a proposal if it is found that any information that has a negative impact on the offeror's past performance record has been deleted, misrepresented, or withheld.
(5) Offers shall remain valid for a period of 90 days from the date offers are due.
(6) Quotation shall include Certifications and Representations, Technical, Past Performance, and Price as separate parts in the submission.
CERTIFICATIONS & REPRESENTATIONS:
Provide pricing for each Contract Line Item Numbers (CLINS).

Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
ADDENDUM TO 52.212-2
Paragraph (a) is hereby supplemented with the following:
The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.
Award will be made using the best value source selection process.
Except for communications conducted for the purpose of minor clarification, the Government intends to evaluate the proposal and award a contract without discussions.
In the evaluation of all Offerors’ proposals, appropriate consideration is given to three (3) evaluation factors:
Technical, Past Performance and Price are in descending order of importance. Technical is more important than past performance. Technical and Past Performance, when combined, are significantly more important than Price. The importance of price in the evaluation will increase with the degree of equality among quotations of the non-price factors.
To receive consideration for award, a rating of no less than “ACCEPTABLE” must be achieved for the technical capability evaluation factor. For Past Performance, the offeror must receive a rating of no less than
‘SATISFACTORY confidence’ to be considered for award. However, offerors which receive an unknown
(neutral) past performance rating will be considered for award.
EVALUATION FACTORS -- THE FOLLOWING FACTORS WILL BE EVALUATED:
PART I: TECHNICAL
Factor 1: Technical Capability reflects the Government’s confidence in the offeror’s ability, as demonstrated in its proposal, to perform the requirements as stated in this Solicitation.
Factor 2: The Offeror’s proposal will be evaluated for the degree to which it describes the automated vial filling system proposed as it represents required parameters in the Statement of Work. The Offeror’s documentation of a cGMP-compliant facility to support sterile testing, IQ/OQ documentation, FDA Form 483 within the past three years, FDA Establishment Inspection Report, Pre-Approval Facility Inspection, facility and product flow diagrams, and documentation of the proposed manufacturing facility’s current possession of and validity of a U.S. FDA facility registration will also be evaluated.
The following adjectival ratings will be used in evaluating each offeror’s technical proposal.
Color Rating Description
Blue Outstanding
Proposal meets requirements and indicates an exceptional approach and understanding of the requirements. Strengths far outweigh any weaknesses. Risk of unsuccessful performance is very low.
Purple Good
Proposal meets requirements and indicates a thorough approach and understanding of the requirements. Proposal contains strengths which outweigh any weaknesses. Risk of unsuccessful performance is low.
Green Acceptable
Proposal meets requirements and indicates an adequate approach and understanding of the requirements. Strengths and weaknesses are offsetting or will have little or no impact on contract performance. Risk of unsuccessful performance is no worse than moderate.
Yellow Marginal
Proposal does not clearly meet requirements and has not demonstrated an adequate approach and understanding of the requirements. The proposal has one or more weaknesses which are not offset by strengths. Risk of unsuccessful performance is high.
Red Unacceptable Proposal does not meet requirements and contains one or more deficiencies. Proposal is un-awardable.
PART II: PAST PERFORMANCE
The past performance evaluation results is an assessment of the offeror’s probability of meeting the minimum past performance solicitation requirements. This assessment is based on the offeror’s record of relevant and recent past performance information that pertain to the products and/or services outlined in the solicitation requirements.
Offerors are cautioned that in conducting present and past performance evaluations, the Government may use data provided in the offeror's proposal, any other source available to the Government and data obtained from other sources to include, but not limited, to data independently obtained from other Government and commercial sources.
After the Government has evaluated Offerors’ past performance for recency and relevancy, the Government will evaluate Quality of Performance (how well the contractor has performed on contracts).
The Government will assign an Unknown /Neutral rating, meaning the rating is treated neither favorably nor unfavorably, to Offerors with no recent/relevant past performance record or the offeror’s performance record is not available or the information is inadequate such that no meaningful confidence assessment rating can be reasonably assigned.
In this context:
“Offeror” refers to the proposed prime contractor and all proposed major subcontractors or team members. A major subcontractor or team member is defined as one who will be providing at least 25 percent of the contract effort. In either case, the contract or delivery order of the proposed prime contractor and proposed major subcontractors will be assessed individually and the results will then be assessed in their totality to derive the prime offeror’s past performance rating. The Government may consider the offeror’s past performance as an entire team including subcontractors, joint ventures and/or teaming partners, aggregately, rather than an individual contractor basis.
“Recency” - To be recent, the performance effort must have occurred within 3 years from the date of issuance of this solicitation.
“Relevancy” – Relevant performance includes products or services that are the same or similar in scope, magnitude and complexity to the effort described in the solicitation.
The following ratings shall be used in assessing an offeror’s Past Performance Relevancy
Rating Description
Very Relevant Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.
Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.
Somewhat Relevant Present/past performance effort involved some of the scope and Magnitude of effort and complexities this solicitation requires.
Not Relevant
Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.
The following ratings shall be used for the Performance Confidence Assessment.
Performance Confidence
Assessments
Rating Description
Substantial Confidence Based on the offeror’s recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.
Satisfactory Confidence Based on the offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.
Limited Confidence Based on the offeror’s recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.
No Confidence Based on the offeror’s recent/relevant performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort.
Unknown Confidence (Neutral) No recent/relevant performance record is available or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.
Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have “unknown” past performance and their performance confidence assessment rating will be “unknown confidence (neutral).”
PART III: PRICE
Price will be evaluated separately from the technical and past performance factors and will be evaluated for fairness and reasonability in terms of the Government’s requirement.
