About this file

This is Addendum 1 to Request for Qualifications NI-FM-2023-001-12 issued by the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) Western Capital District, Niagara Region for woods planting and vegetation installation at Four Mile Creek State Park. The project encompasses the purchase and installation of 80 tree containers (#5), 160 shrub containers (#5), 100 shrub containers (#2), and 200 live stake container plantings across 1.6 acres of designated woods and 200 feet of creekside. Bids were due August 31, 2026. The addendum clarifies that OPRHP can coordinate with the Four Mile Creek Park Manager regarding potential staging areas for plant delivery and storage at the park, and will meet the contractor on-site to walk planting areas with general flagging of zones, though placement of plant material will be determined by the contractor based on provided guidance. The project requires straight species plantings only, with no cultivars permitted, and OPRHP will prioritize smaller plant sizes if requested sizes are unavailable. Contract timing is flexible and will be finalized upon award; the contractor will be paid upon completion of planting work with a 12-month warranty period during which OPRHP reserves the right to request warranty plantings based on plant survival.

The addendum further specifies that no organic compost or mulching is included in the project scope, campsite accommodations for crews are unlikely due to ongoing park patron activity, and contractors have access to public trails within the project area but must maintain trail accessibility, implement proper safety measures for patron protection, and avoid passing through occupied campsites. All alternative plant sizes and species substitutions will be discussed after contract award rather than during the bidding phase. Bidders must acknowledge receipt of this addendum by inserting its number and date in the bid form, with failure to do so potentially resulting in disqualification.

Summary of Addendum Items:

QUESTION #1 – Can I have the plants delivered and stored at the park?

RESPONSE #1 – OPRHP can work with the contractor and the Four Mile Creek Park Manager to determine if there is a staging area that can be used at the park.

QUESTION #2 – You say that you will work with contractor on placement, do you mean your people will move the plants in place? Or mark the spots with flags or some other way?

RESPONSE #2 – Outside of the map provided in the RFQ document, OPRHP can meet the contractor at the site to walk the planting areas. OPRHP would likely be able to generally flag out the areas, but it would not be extensive flagging. Placement of plant material will be determined on-site by the contractor based on the planting areas and guidance provided.

QUESTION #3 – Some nurseries have asked me if it has to be straight species or if cultivars are ok?

RESPONSE #3 – No cultivars should be used on this project.

QUESTION #4 – If the size requested is not available would a smaller or larger alternative of the same species be ok? For example if #5 was requested, but only #3 or #7 is available which would you prefer? #7 is double the price of #3 at the nursery I got a quote from.

RESPONSE #4 – Prioritize smaller sizes if the requested size is not available. Please bid for this work based on the specifications and RFQ document.

QUESTION #5 – Would you like the plants to receive a top dressing of organic compost?

RESPONSE #5 – All details for planting can be found in the RFQ document. There is no organic compost or mulching as a part of this project.

QUESTION #6 – Can you provide one campsite during the work week for the crew?

RESPONSE #6 – Most likely not, the park will still have patrons and likely limited space at the time of planting.

QUESTION #7 – The RFQ says that "alternative container size or species substitutions can be recommended by chosen contractor". Is that something that can be worked out prior to the bid, or should we price everything based on the #5 containers and discuss other options after the contract is in place?

RESPONSE #7 – Please bid for this work based on the specifications and RFQ document.

Alternative plant sizes will be discussed once the contract is awarded.

QUESTION #8 – Is there any flexibility with the timing of the work? Specifically, could we push the container planting back a week or two to be able to do it at the same time as the live stake planting?

RESPONSE #8 – OPRHP can be flexible with timing, however the schedule will be determined once the contract is awarded.

QUESTION #9 – With regard to the 12-month warranty period, I was wondering if that would affect the timing of the payment or if we will receive the payment upon completion of the planting?

RESPONSE #9 – The contractor will be paid once the work is completed with the understanding that

OPRHP reserves the right to call in warranty plantings from the contractor based on the survival of the plants within the 12-month warranty period. The warranty period starts once the plantings are completed.

QUESTION #10 – Will we have access to the existing spur trails that connect the main trail to some of the adjacent campsite areas.

RESPONSE #10 – The contractor will have access to any of the public trails within the project area.

OPRHP asks the contractor to leave trails open and unobstructed during the work period due to campsite activity and patron use. OPRHP asks that proper measures are implemented to ensure patron safety during planting, if encountered. OPRHP also asks that the contractor do not pass through occupied campsites to reach spur trails.
