II. Background:

The Pacific Islands Fisheries Science Center of the National Marine Fisheries Service (NMFS) is part of the National Oceanic and Atmospheric Administration (NOAA). The Center administers scientific research and monitoring programs that support domestic and international conservation and management of living marine resources.

The Pacific Islands Fisheries Science Center (PIFSC) is headquartered in Honolulu, Hawai‘i. The Center has taken a leading role in marine research on ecosystems, in the insular and pelagic environments. It is implementing a multidisciplinary research strategy including an ecosystem observation system, and scientific analysis to support ecosystem approaches to management and restoration of living marine resources. It conducts a wide range of activities including resource surveys and stock assessments, fishery monitoring, economic and sociological studies, oceanographic research and monitoring, critical habitat evaluation, life history and ecology studies, and advanced oceanographic and ecosystem modeling and simulations.

The Fisheries Research and Monitoring Division (FRMD) coordinates the Center's programs for fisheries monitoring, fisheries data management, fisheries interactions, fish life history studies, and stock assessment. The mission of the Division is to provide the scientific foundation to enable informed and effective implementation of ecosystem-based management and conservation strategies for U.S. fisheries throughout the Pacific Islands Region.

To accomplish this mission, the Division carries out extensive activities to monitor U.S. fisheries of the Pacific Islands and oceanic waters of the central and western Pacific, assess the status of exploited fish stocks, and provide scientific advice to fishery managers. Computer, network, and information security is of paramount concern for the Department of Commerce (DoC), NOAA, and NMFS. NMFS must ensure that hardware and software does not compromise the security of its NMFS OCIO infrastructure and/or contribute to the disclosure of sensitive, proprietary, or other non-public data. The vendor guarantees that any systems or software provided by the vendor is free of known vulnerabilities that are identified in the National Vulnerability Database (https://nvd.nist.gov). At a minimum, the vendor would be expected to provide evidence of the following security measures:

· Fully comply with all Federal Statutes, Executive Orders and Regulations; as well as DoC, NOAA, and NMFS policies.

· The vendor must ensure that all hardware that is acquired for use pursuant to this contract meets the requirements of Section 515 of the Consolidated Appropriations Act of 2014. The vendor will be fully responsible for any cost associated with component replacement resulting from violations of this provision.

· Maintain separate environments for production and non-production systems. Developers should not typically have unmonitored access to production environments.

· Test application software for coding errors and potential vulnerabilities prior to deployment using automated static code analysis software, as well as manual testing and inspection. In particular, input validation and output encoding routines of application software should be reviewed and tested.

· Protect web applications by deploying web application firewalls (WAFs) that inspect all traffic flowing to the web application for common web application attacks, including but not limited to cross-site scripting, SQL injection, command injection, and directory traversal attacks. For applications that are not web-based, specific application firewalls should be deployed if such tools are available for the given application type. If the traffic is encrypted, the device should either sit behind the encryption or be capable of decrypting the traffic prior to analysis. If neither option is appropriate, a host-based web application firewall should be deployed.

· Test third-party-procured web applications for common security weaknesses using automated remote web application scanners prior to deployment, whenever updates are made to the application, and on a regular recurring basis. Include tests for application behavior under denial-of-service or resource exhaustion attacks.

· Do not display system error messages to end-users (output sanitization).

· Ensure that all software development, database, and system administrator personnel routinely receive training in current security best practices for their specific development environment and role.

· In addition to the web application vulnerability scanner, the evaluation team must also run static code analysis tools and database configuration review tools against Internet-accessible applications to identify security flaws prior to moving any changes into production. A quarterly scan will be required if no updates have been made.

· Unless approved by NMFS OCIO, any security flaws deemed to be moderate or greater must be remediated within 30 days of discovery.

· Unless approved by the NMFS OCIO, all browser accessible applications must be capable of full functionality with the latest browser releases and updates from Microsoft, Apple, Mozilla, and Google.

· All software provided by the vendor must be capable of operating on the latest vendor provided updates. This includes operating system and middleware (such as Java and Flash).

· Unless approved by NMFS OCIO, all licensing for operating systems, middleware, applications, data, or any other licensing required for the successful operation of the application or systems shall be with the Government as licensee.

· Unless waived by NMFS OCIO, throughout this contract and all support periods of the initial or subsequent contracts, the vendor will provide a security point of contact who meets DoC CITR-006 minimum requirements.

· Unless approved by the NMFS OCIO, all systems and applications must be fully functional in a VMware environment.

· Vendor must adhere to NMFS configuration management process and must maintain documentations on configuration management for operating system, middleware, applications, data or other components Protecting data dissemination:

The contractor agrees, in the performance of this contract, to keep the information furnished by the Government and designated by the Contracting Officer or Contracting Officer’s Technical Representative in the strictest confidence. The contractor also agree not to publish or otherwise divulge such information in whole or part, in any manner or form, nor to authorize or permit others to do so, taking such reasonable measures as are necessary to restrict access to such information while in the contractor’s possession, to those employees needing such information to perform the work provided herein, i.e., on a “need to know” basis. The contractor agrees to immediately notify the Contracting Officer in writing in the event that the contractor determines or has reason to suspect a breach of this requirement.

Secure Communications: The contractor must verify with the government prior to transmission of information that all information designated as sensitive will meet National Institute of Standards and Technology (NIST) Federal Information Processing FIPS 140-2 validated cryptographic module(s).

The contractor agrees that it will not disclose any information described in performance of this activity to any persons or individual unless prior written approval is obtained from the Contracting Officer. Whenever the contractor is uncertain with regard to the proper handling of information/data under the contract, the contractor shall obtain a written determination from the Contracting Officer. The Contractor agrees to insert the substance of this clause in any consultant agreement or subcontract hereunder.

Upon completion of the work, the contractor will certify in writing to the contracting officer that:

Except as approved in writing by the contracting officer, they have not disclosed and any data or media collected, developed, and/or correlated in the performance of this acquisition.

They have not retained any data or media collected, developed, and/or correlated in the performance of this acquisition.

All instances of data or media in the possession or under the control of the contractor has been destroyed using one of the methods for secure destruction of unclassified but sensitive information recommended by the National Security Agency in the Media Destruction Guidance available online at http://www.nsa.gov/ia/guidance/media_destruction_guidance/index.shtml.
