Task order number GS00P05BQD0003/GS-P-11-09-YT-0056 was issued on 12/8/2008 for the DHS Mission
Support Consolidation at St. Elizabeths under project number 8DC2175. In April of 2011 the procurement was placed on hold due to a change in DHS's funding availability in FY10 and outlook in FY12.
Due to the loss of funding for the Department of Homeland Security (DHS) Headquarters Mission Support
Consolidation, five (5) leases at 20 Massachusetts Avenue, NW, Washington DC require a four (4) year extension for their existing spaces to allow enough time to complete the consolidation to house USCIS HQ.
Under the DHS Omnibus, Prospectus No. PDC-23-WA10, GSA has interim authority to enter into an extension until the consolidation of USCIS HQ occurs.
2. DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED:
USCIS currently occupies 213,712 RSF of leased space at 20 Massachusetts Avenue under 5 leases as stated above and require a four (4) year extension to allow enough time to consolidate USCIS HQ.
2. IDENTIFICATION OF STATUTORY AUTHORITY:
(Task Orders)
FAR 16.505 (b)(2)(i)(c) The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.
41 U.S.C. §3304 (a) (1), only one responsible source and no other supplies or services will satisfy agency requirements.
Projects: 0DC2100, 0DC2101, 0DC2102, 0DC2103 & 0DC2104
4. DEMONSTRATION THAT THE ACQUISITION REQUIRES USE OF THE AUTHORITY CITED:
On April 1, 2010, GSA released SFO NO 8DC2175 through which GSA sought to acquire approximately 1,136,000
RSF to consolidate DHS entities. USCIS was to occupy approximately 670,000 RSF under this consolidation procurement. On July 22, 2011, SFO No 8DC2175 was cancelled due to lack of funding.
In accordance with GSAM 570.405(c)(4) it is permissible to extend the term of a lease where, as here, the agency occupying the space encounters delays in planning for a potential relocation to other federally controlled space due to financial uncertainties. During the extension term GSA will complete a long-term consolidation to house USCIS.
To award a task order for the extension period to another broker at this time would result in a further loss of time due to the time required for a new contractor to be brought up to speed and to produce required project deliverables. This loss of time in the project schedule would potentially cause the lease extensions to not be executed by the September and October 2012 expiration dates.
5. DESCRIPTION OF EFFORTS TO SOLICIT AS MANY OFFERS AS PRACTICABLE:
No other sources will be sought under this procurement. The action will be publicized as required by FAR
Subpart 5.2.
6. DEMONSTRATION THAT THE ANTICIPATED COST WILL BE FAIR AND REASONABLE:
The National Broker Contracts (NBC2) IDIQ contracts were issued as a no cost contract. The estimated contractor net commission has been found to be fair and reasonable by the contracting officer.
7. DESCRIPTION OF THE MARKET SURVEY CONDUCTED:
N/A
8. OTHER FACTORS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION:
9. LIST OF SOURCES THAT EXPRESSED INTEREST IN THE ACQUISITION
10. STATEMENT OF ACTIONS TO OVERCOME BARRIERS TO COMPETITION:
This task order is issued as follow-on work to an existing task order. The original task order was procured using full and open competition between the four IDIQ contractors. It is anticipated that future orders be conducted using full and open competition.
11. TECHNICAL REQUIREMENTS PERSONNEL CERTIFICATION (Regional Program Manager):
I certify that the supporting data used to form the basis of this justification is complete and accurate to the best of my knowledge and belief.
12. CONTRACTING OFFERICER’S CERTIFICATION
Projects: 0DC2100, 0DC2101, 0DC2102, 0DC2103 & 0DC2104
By signature on this justification for Other than Full and Open Competition, the Contracting Officer certifies that the award of a lease extension to Jones Lang LaSalle is in the Government’s best interest and is accurate and complete to the best of my knowledge and belief.
