About this file

This is a Justification and Approval (J&A) document for the use of other than full and open competition for a Department of Navy sole source contract award.

The contracting activity is the Naval Information Warfare Systems Command (NAVWAR) supporting the Program Executive Office Undersea Warfare Systems and the Maritime Surveillance Systems Program Office. The action awards a sole source contract to Lockheed Martin Rotary and Mission Systems (LM RMS) for continued production, integration, assembly, test, and delivery of towed arrays and related modules, along with engineering services for post-delivery support, trade studies, component development and testing, failure analysis, installation, integration, repairs, and refurbishment of existing towed arrays. The contract structure includes a base year plus four option years with Firm-Fixed-Price (FFP) Contract Line Item Numbers (CLINs) for procurement of towed arrays, On Board Repair Parts (OBRP), and Provisioned Item Orders (PIOs) for spares; Cost-Plus-Fixed-Fee (CPFF) CLINs for engineering services and refurbishment labor; and Cost CLINs for travel and materials. The total estimated contract value for fiscal years 25-30 is identified but redacted. The statutory authority for sole source contracting is 10 U.S.C. 3204(a)(1), justified on the basis that LM RMS is the only known source with the unique production facilities, specialized tools, and test equipment designed for producing the towed arrays and conducting Full Factory Acceptance and Certification Testing. The J&A notes that awarding to another source would result in unacceptable schedule delays and substantial duplicative costs for facility buildout, secure facility certification, and engineering asset production. A market research synopsis was posted on SAM.gov on May 11, 2023, closing May 26, 2023, with only one inquiry received and no responses indicating capability to perform. The document includes certifications from the Program Manager (October 23, 2023), Program Executive Officer (February 29, 2024), Associate Counsel (March 4, 2024), Contracting Officer (March 5, 2024), and final approval by the Assistant Secretary of the Navy (July 8, 2024).
