Questions Received Round One Week Ending 5 September 2020
Q1: Would you consider making this a small business set aside?
A1: The Government has reviewed the above request. This is a limited competition among the Original Equipment Manufacturer (OEM) and its authorized distributors. The effort is for equipment manufactured by an “other than small business” and exceeds the threshold for the non-manufacturer’s rule. When doing a Small Business Set Aside, FAR Clause 52.219-14 - Limitation on Subcontracting would apply. This clause under a set aside requires the small business to either manufacture at least 50% of the item (minus the cost of materials) or provide the end item of another small business. Accordingly, as Small Businesses under a set-aside would be prohibited from providing the required end items (which are not manufactured by a small business) in accordance with FAR 52.219-14, the Government will not be setting this aside for small businesses.
