DEPARTMENT OF THE NAVY
NAVAL AIR WARFARE CENTER AIRCRAFT DIVISION
IN REPLY REFER TO:
J&A 18_0183
JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity Naval Air Warfare Center Aircraft Division (NAWC-AD) Lakehurst, NJ
2. Description of the Action Being Approved This Justification and Approval authorizes and approves the establishment of a Sole Source support contract with Lockheed Martin Rotary and Missions Systems (LMRMS), 100 Global Innovation CIR, Orlando, FL 32825-5002 (CAGE: 16331), for support services, including maintenance for Government owned Consolidated Automated Support Systems (CASS) Offload Operational Test Program Sets (OTPS') located in the Fleet as well as throughout the world (both foreign and domestic). The following CASS Offload OTPS' are included under the following Contractor Logistics Support efforts: RADCOM E2C, CAT IIID E2C, RADCOM EA6B, CAT IIID EA6B, HTS EA6B/EA18G, DTB EA 6B, MH-60R OWEGO, NEWTS & HTS F/18.
3. Description of Supplies/Services The required services are to meet Fleet demand by performing depot-level repair, replacement, overhaul and/or modification, maintain component reliability, improve parts availability/fill rate/logistics and requisition response time, conduct obsolescence analysis to determine system supportability throughout the end item system's life cycle, contribute to obsolescence solutions based on the analysis, and monitor the equipment's configuration. The Navy will be maintaining control over configuration changes in consonance with the hardware design. Services for each OTPS shall include, but not be limited to all subcomponent, subassemblies and ancillary gear associated with each individual OTPS. Included in this support are obsolescence tracking and mitigation, as well as possible engineering investigation/logistics documentation update support.
The period of performance of this effort shall be for 5 years (1 year base plus 4 one year options).
4. Statutory Authority Permitting Other Than Full and Open Competition 10 U.S.C. 2304(c) (1), Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority Performance of all of the above efforts is contingent on the Navy supplying copies of all the OTPS', CASS stations, and CASS Ancillary Government Furnished Equipment (GFE) to the contractor in order to perform this effort. At this time, all the required OTPS assets, sufficient quantities of CASS stations and CASS ancillary equipment reside at LMRMS Orlando and are presently being used on other Government contracts; specifically, the eCASS program. There are no spare OTPS’ or the required configuration of CASS stations available to provide as GFE in order to fully compete this effort. It has been estimated that the cost to procure additional OTPS' to provide as GFE would be approximately $5,200,000 which is significantly higher than the overall effort. Additionally, support costs for the required CASS stations would require an additional $800,000 over the period of performance of this contract to support extra CASS stations. A substantial duplication of cost would not be recovered through competition as a result. Therefore, LMRMS is the only source capable of meeting the Government's requirements and is the best value for the Government.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable Several efforts were made in determining the most suitable approach for acquiring the support services. Market research was conducted by the NAWC-AD Lakehurst, NJ technical team, which consisted of internet searches on Google and Bing, as well as discussions with Government Subject Matter Experts. The results revealed that no known sources except for LMRMS could meet the Government’s requirements. A Request for Information (RFI) and Synopsis of this procurement were released to Federal Business Opportunities in accordance with DFARS 206.302-1(d) and FAR 5.201 on 8 November, 2017 and 30 January 2018, respectively, to assist the NAVAIR Lakehurst team in identifying other potential companies. Submissions from two (2) small businesses, Bowhead Manufacturing Technologies, LLC and Advanced Testing Technologies, Inc. (ATTI) were received in response to the RFI.
The technical team reviewed each response thoroughly, and based on the information provided, determined that because the Government does not possess the required GFE, it would not be possible for either company to perform the work without a significant cost to the Government, and significant risk to the eCASS Program. Each company was notified of the Government’s decision. No responses to the synopsis were received.
7. Determination of Fair and Reasonable Cost In accordance with FAR 15.402, the Contracting Officer shall determine that the services provided under this contract are procured at a fair and reasonable price. The Contractor will submit a formal price proposal with certified cost or pricing data and sufficient information to support the accuracy and reliability of the estimate.
The contractor’s proposal will be reviewed by experienced technical analysts and contract specialists with the aid of field pricing support, as necessary. The Contracting Officer will utilize cost and price analysis as the basis for negotiating a fair and reasonable price.
8. Actions to Remove Barriers to Future Competition There is no future plan for a competitive procurement at this time. However, PMA260 continuously conducts market research via various DoD and commercial consortiums and will assess whether competition for future requirements is feasible.
