JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Naval Air Warfare Center Aircraft Division (NAWC-AD) Lakehurst, NJ
2. Description of the Action Being Approved.
This justification and approval authorizes and approves on a sole source basis, a Firm Fixed Price contract to Connector Micro Tooling Systems, 331 Aaron Ave, Ste. 129, Arlington, TX 76012 (Cage 54443) for the manufacturing and delivery of Electrical Connector Crimp and Repair Sets, Part Number G01P3NGH. This procurement will provide requirements to support initial outfitting for P-8A aircraft Product Support at Main Operating Base (MOB) Whidbey Island, Primary Deployment Site (PDS) Bahrain, 6th Jacksonville Squadron, and 1st Whidbey Squadron. This equipment will be used for O-level maintenance.
3. Description of Supplies/Services.
This acquisition is for the manufacturing and delivery of Electrical Connector Crimp and Repair Sets, P/N G01P3NGH. A quantity of 8 each are required to fulfill United States Navy requirements.
4. Statutory Authority Permitting Other Than Full and Open Competition.
Statute: 10 U.S.C. 2304(c)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
The above Support Equipment (SE) was designed by Connector Micro Tooling Systems at their own expense and tested to meet specifications for maintenance of the Boeing 737, P-8A Aircraft. Connector Micro Tooling Systems owns all proprietary rights to the engineering data and detailed product drawings. Connector Micro Tooling Systems is the only manufacturer with the capability to supply these items. An adequate purchase description or other information suitable to solicit by full and open competition has not been developed because the Government does not have sufficient engineering data or drawings to organically design the above items and enable a competitive procurement. Connector Micro Tooling Systems as the Original Equipment Manufacturer (OEM) is the only source that is capable of providing the above and they do not have any authorized distributors.
6. Description of Efforts Made to Solicit Offers from as Many Offeror’s as Practicable.
Market research was conducted and confirmed that Connector Micro Tooling Systems is the only source that can provide this required item. Various internet search engines (Google, Bing, and Yahoo) were queried for potential sources of this item to fill the requirements are Connector Micro Tooling Systems, Aero Base Group and E-Aircraft Supply. Aero Base Group and E-Aircraft Supply are after-market resellers and are not authorized distributors of Connector Micro Tooling Systems. Aero Base Group and E-Aircraft Supply do not possess the drawings to manufacture P/N G01P3NGH. In accordance with FAR 5.002 and the DFARS PGI 206.302-1, a Sources Sought Announcement was posted on the Federal Business Opportunities website on 07 September 2016 and closed 14 September. No responses were received. In accordance with FAR 5.2, a synopsis was posted on the Federal Business Opportunities website on 06 October 2016 and closed 21 October 2016. No responses or inquiries were received.
7. Determination of Fair and Reasonable Cost.
The negotiation and establishment of a fair and reasonable price will be conducted in accordance with FAR 15.4. As stated in FAR 15.402, the Contracting Officer shall purchase all supplies and services at a fair and reasonable price. Based upon historical cost data, the Contracting Officer, Defense Contract Management Agency, and Defense Contract Audit Agency auditors have adequate information and background to determine a fair and reasonable price.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in Paragraph 5, NAWC-AD has no plans at this time to compete future contracts for the types of supplies/services covered by this document. The Government does not have any future requirements for this item at this time. The Government does not own the item drawings nor does the Government have sufficient engineering data or drawings to organically design the above items and enable a competitive procurement. The Government will continue to analyze the marketplace and if another potential source emerges, NAWC-AD will assess whether competition for future requirements is feasible.
