SECTION SF 30 BLOCK 14 CONTINUATION PAGE

The following items are applicable to this modification:

SECTION B - SUPPLIES OR SERVICES AND PRICES

SUMMARY OF CHANGES

Quetsions Regarding RFP

1. Question 1a: In Section B, all of the CLINS except the travel support costs are identified as Firm Fixed

Price (FFP), and Clause 52.216-22 states that this is an Indefinite Quantity contract. As such, we assume that the resultant contract will be Firm Fixed Price Indefinite Quantity. However, Clause 52.216-1 states that the Government contemplates award of a Firm-Fixed Price/ Cost Plus Fixed Fee, Indefinite Delivery, Indefinite Quantity (IDIQ) type contract. Would you please clarify the contemplated contract type?

Answer: Contract type is Indefinite Delivery - Indefinite Quantity with provisions for both FFP and Cost

(Travel) line items.

2. Question 1b: If the contract will be Firm Fixed Price Indefinite Quantity, we assume that the clauses relating to cost plus fee contracts (such as HQ B-2-0007, HQ-B-2-0014, HQ G-2-0009 & PD-G01) and the

Attachment 3 Cost Summary Forms for CPIF, CPFF, and CPAF are not applicable and are self-deleting.

Would you please confirm?

Answer: Mention of Cost-Plus-Fixed-Fee has been removed from the RFP. As such, clauses HQ B-2-

0014, PD-G01, and the Cost Summary Form have been deleted.

3. Question: Clause L.2.2 states that proposals are to be delivered by mail to the recipient in Block 7 of the front page of the solicitation. Are we permitted to deliver our proposal by courier such as Federal Express, UPS, or DHL to the same recipient?

Answer: Yes, you are permitted to deliver by courier, so long as the proposal is received prior to the due date.

4. Question: Clause L.2.3 is not clear on the requirement for electronic/soft copy files on CD-ROMS to be submitted with our hard copy proposal. Please let us know if electronic/soft copy files on CD-ROMS are required, and if so, the quantity required.

Answer: As stated in paragraph (L.2.3(1) ), CD-ROMS with electronic copy files are required with the hard copy proposal. One (1) CD-ROM is required with each proposal to supplement the hard copy.

SECTION M - EVALUATION FACTORS FOR AWARD

The following have been modified:

PD-M01 AGENCY SPECIFIC PROVISION - EVALUATION OF PROPOSALS (OCT 2003)

http://www.sam.gov/

SECTION M – EVALUATION FACTORS FOR AWARD

EVALUATION OF PROPOSALS

Factors

(1) Technical

(1A) Design and Performance Characteristics

(1B) Corporate Experience

(1C) Test Plan for First Article Testing

(1D) Small Business Participation Commitment

(2) Past Performance

(3) Price

(a) General. Careful, full and impartial consideration will be given to all offers received pursuant to this solicitation, and the evaluation will be applied in a similar manner. Factors against which offers will be evaluated (e.g., Technical Capability and Price) are set forth below and parallel the solicitation response called for elsewhere herein.

(b) Initial Evaluation of Offers. An evaluation plan has been established to evaluate offers pursuant to the factors set forth in (g) below and all offers received will be evaluated by a team of Government personnel in accordance with the plan. Offerors are advised that technical proposals may be evaluated without consideration of any proposed subcontractor which is deemed to have an organizational conflict of interest.

(c) Evaluation Approach. The following evaluation approach will be used:

(1) Technical. A rating of Acceptable or Unacceptable shall be assigned under the factors/subfactors of

Technical, and on an overall basis. In order to be assigned an overall rating of Acceptable, an offeror must receive a rating of Acceptable in the Technical Subfactors.

(a) Failure to submit adequate information will result in a proposal being rated as Unacceptable. The

Government intends on making an award based on the initial proposals received. Therefore, an offeror’s initial proposal should contain its best offer from both a price and a technical standpoint. Each proposal will be evaluated against the evaluation criteria set forth in the solicitation. Proposals will not be compared to each other or to criteria which are not identified in the solicitation; similarly, each proposal will be evaluated for every factor/subfactor identified. Technical acceptability shall be determined based on Design and Performance Characteristics, Corporate Experience/Resources, Management and

Logistical Support Plan, and Test Plan for First Article Testing

(b) Technical acceptability will be based on the offeror’s ability to perform as the result of an evaluation of the factors of Design and Performance Characteristics, Corporate Experience, Test Plan for First Article

Testing, Small Business Participation Commitment, and Past Performance as detailed in Section M. To be determined technically acceptable, an offer must be evaluated as acceptable in the Technical evaluation factor, including all subfactors. Technical trade-offs will not be made. The Government reserves the right to make an award without discussion. Therefore, each initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if determined necessary by the Contracting Officer.

(2) Price. Pricing will be evaluated by adding the prices/costs for all Items 0001 through 0027 using the unit price associated with procuring the maximum quantity specified.

(d) Competitive Acquisition Instructions.

(1) The solicitation will include the provision at FAR 52.215-1, “Instructions to Offerors-Competitive

Acquisitions”, which states the Government intends to evaluate proposals and award a contract without discussions.

(2) The Government reserves the right to conduct discussions if the Contracting Officer determines them to be necessary. If the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the

Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the technically acceptable proposals.

(e) Discussion/Final Proposal Revisions (if applicable)

The Contracting Officer MAY indicate to, or discuss with, each offeror still being considered for award, aspects of its proposal (such as cost, price, technical approach, and terms and conditions) that could, in the opinion of the Contracting Officer, be altered or explained to enhance materially the proposal's potential for award. The scope and extent of discussions are a matter of Contracting Officer judgment. At the conclusion of discussions, each offeror still in the competitive range shall be given an opportunity to submit a final proposal revision. A final cut-off date for receipt of final proposal revisions will be established by the Contracting

Officer.

(f) Basis for Contract Award.

The contract resulting from this solicitation will be awarded to the responsible offeror submitting the lowest priced, technically acceptable offer. It is the Government’s intent to make a single award and will evaluate offers for award purposes by adding the total price for all ordering periods.

(g) Evaluation Factor

Factor 1: Technical

1A. Design and Performance Characteristics: Proposals will be evaluated on how well the design and performance characteristics of the proposed solution meet each of the characteristics required by the specification. In addition, the proposal’s perceived level of risk, and strategies to manage the risk will be assessed, affecting the proposal’s evaluation.

Factor 1A. Design and Performance Characteristics Evaluation Ratings

Rating Description

Acceptable Proposal clearly meets the minimum requirements of the solicitation.

All requirements detailed in Section 3 of the specification, at a minimum, must be met. Such requirements include physical dimensions, weight, parallel operation, electrical interface and characteristics.

Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.

If any one requirement as detailed in Section 3 of the specification is not met, the proposal will be considered unacceptable. Requirements include physical dimensions, weight, parallel operation, electrical interface and characteristics.

1B. Corporate Experience: Offerors will be evaluated on their corporate experience in providing equipment that is the same or similar to the requirement cited in Section C of the Solicitation. The proposal will be evaluated on the merit of the offeror’s company profile and facilities. Manufacturing, production, technical equipment, and other company resources will be evaluated. The offeror shall also be evaluated on their previous experience with production of turbine driven main pumps.

Factor 1B. Corporate Experience/Resources Evaluation Ratings

Rating Description

Acceptable Proposal clearly meets the minimum requirements of the solicitation.

Acceptable offerors will provide information on its corporate experience with regards to providing equipment that is the same or similar to the requirement cited in Section C –

Descriptions and Specifications of the solicitation. Corporate experience information will be also be used to determine the extent to which an offeror is currently, or has previously performed work similar or related to the scope of work for this solicitation.

Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.

Offerors with corporate experience unrelated to the scope in Section C – Descriptions and

Specifications of the solicitation will be considered unacceptable.

1C. Test Plan for First Article Testing: Offerors will be evaluated on their plan to conduct first article testing on an as needed basis as described in Section C. This test plan must demonstrate the proposed First

Article Testing procedures and how they will allow the offeror to demonstrate that their proposed main feed pump will be in compliance with all the requirements set forth in Section C. The Government reserves the right to have a representative present for First Article Testing or to request an independent accredited testing facility, Government or Contractor, verify all submitted first article test results before granting any offeror first article approval.

Factor 1C. Test Plan for First Article Testing Evaluation Ratings

Rating Description

Acceptable Proposal clearly meets the minimum requirements of the solicitation.

Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.

1D. Small Business Participation Commitment Document (SBPCD)

Offerors will be evaluated on the extent small businesses are identified in the performance of the contract, and the nature of the Offeror’s commitment to use such firms..

Offerors will be evaluated on the realism of the proposed subcontracting commitment when compared to the information in its cost and technical proposal and its subcontracting plan, if required. Small businesses and goals specifically identified in proposals will be evaluated to assess consistency across the Individual Subcontracting Plan

(if applicable), and the Small Business Participation Commitment Document. The Government reserves the right to use both data provided by the Offeror as well as data the Government develops and obtains through other sources

(e.g., CPARS, PPIRS, eSRS reports and mentor-protégé agreements etc.).

FACTOR 2 – PAST PERFORMANCE

The Past Performance Evaluation is an assessment of the Offeror’s probability of meeting the solicitation requirements.

There are (3) three aspects to the past performance evaluation: Recency, relevancy (including context of data), and quality (including general trends in Contractor performance and source of information). The first is to evaluate the recency of the Offeror’s past performance. Recency is considered work performed within the past (3) three years.

The second is to determine how relevant a recent effort accomplished by the Offeror is to the effort to be acquired through the source selection. Common aspects of relevancy include, but are not limited to, the following: similarity of product/service/support, complexity, dollar value, contract type, use of key personnel (for services), and extent of subcontracting/teaming. With respect to relevancy, past performance of greater relevancy will typically be a stronger predictor of future success and have more influence on the past performance confidence assessment than past performance of lesser relevance. The third aspect of the past performance evaluation is to establish the overall quality of the Offeror’s past performance (see FAR 15.304(c)(2)) these are combined to establish one performance confidence assessment rating for each offeror . The past performance evaluation conducted in support of a current source selection does not establish, create, or change the existing record and history of the Offeror’s past performance on past contracts; rather, the past performance evaluation process gathers information from customers on how well the Offeror performed those past contracts.

NOTE: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered “acceptable.”

Past Performance Evaluation Ratings

Rating Description

Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.

Unacceptable Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.

FACTOR 3 – PRICE

Price evaluation shall be conducted on total pricing of all CLINs.

NOTE: Price evaluation shall be conducted on total pricing of all CLINs, even if an offeror requests a First Article

Test (FAT) waiver. Offerors shall propose pricing for FAT units even if requesting a FAT waiver; FAT waivers will be approved either before or after award by the Contracting Officer.

For the quantity/unit identified in the First Article Testing CLIN, once that unit is tested and approved, OR if a FAT waiver is granted, the unit under that CLIN shall become a Production unit.

Proposals which are unrealistic in terms of technical or schedule commitments or unrealistically high or low in cost may be deemed reflective of an inherent lack of technical competence, or indicative of a failure to comprehend the complexity and risks of the proposed work, and may be grounds for rejection of the proposal. If the proposed contract requires the delivery of data, the quality of organization and writing reflected in the proposal will be considered to be an indication of the quality of organization and writing which would be prevalent in the proposed deliverable data. Subjective judgment on the part of the Government evaluators is implicit in the entire process.

Throughout the evaluation, the Government will consider "correction potential" when a deficiency is identified.

The Government may determine that a proposal is unacceptable if the prices proposed are materially unbalanced between line items or subline items. As defined in FAR 15.404, unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly overstated or understated as indicated by the application of cost or price analysis techniques. A proposal may be rejected if the

Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.

PRICE EVALUATION

Price will be evaluated for reasonableness in accordance with FAR 15.404-1(b)(2) for Firm-Fixed Price CLINS All

CLINs except 0006, 0014, 0020, 0026. The proposed price for the Offeror’s proposal will be arrived at by multiplying the offered price for each CLIN in Section B times the quantity for that CLIN, and totaling the result for all CLINs.

Total quantities and Support Costs amounts are estimates only to establish ceiling amounts, and do not necessarily reflect the total amount of Support Costs that the Government will actually order. The Government may order less than the total quantities or may order up to the maximum quantities listed in Section B.

In the absence of adequate price competition, the Contracting Officer may request additional data per FAR 15.403-3 and as described in the solicitation provision 52.215-20, Requirements for Cost or Pricing Data and Data Other Than

Certified Cost or Pricing Data.

Support Costs

These costs represent material, travel and incidental subcontracting costs.

For proposal purposes, the estimated base amounts for support costs have been pre-established and specified in

Section B. Offerors shall burden the pre-established NTE amount with applicable indirect cost rate loadings to arrive at its total proposed Support Costs. Offerors are required to clearly identify as part of their proposal any indirect markup rates (i.e. G&A and material handling) which will be applicable to base support costs. The total proposed amount for CLINs identified as Support Cost CLINs in Section B, shall include the pre-established base amount and the Offeror's proposed markup costs, which will be used for evaluation purposes. Example: If Section

B established $1M as the NTE amount, offerors shall use $1M as the basis and apply any indirect loadings to arrive at its total proposed Support Costs of $1.1M. The Government will use the $1.1M in its evaluation of the cost proposal, but any subsequent awards will include the pre-established $1M.

It is intended to reimburse support costs on the basis of actual reasonable and allowable costs. If an Offeror fails to identify, as part of its proposal, an indirect cost rate(s) that would otherwise be applicable to one of the support cost items, it shall not be allowed to invoice for the indirect rate(s) after award since the evaluation of its offer did not include that rate(s). At the time of Task Order award, the Task Order will reflect the stated support cost estimate plus any applicable proposed markup costs, which were considered in the evaluation of the offer.

M.4 COMPETITIVE ACQUISITION INSTRUCTIONS

The Government intends to evaluate proposals and award a contract without discussions with Offerors. Therefore, the Offeror's initial proposal should contain the Offeror's best terms from a cost or price and technical standpoint.

However, the Government reserves the right to enter into discussions with Offerors as it is determined by the

Contracting Officer to be in the Government’s best interest.

M.5 DISCUSSION/FINAL PROPOSAL REVISIONS

If the Contracting Officer determines that discussions are to be held, they shall indicate to, or discuss with, each

Offeror still being considered for award; significant weaknesses, deficiencies, and other aspects of its proposal (such as cost, price, technical approach, past performance, and terms and conditions) that could, in the opinion of the

Contracting Officer, be altered or explained to enhance materially the proposal's potential for award. The scope and extent of discussions are a matter of Contracting Officer judgment. At the conclusion of discussions, each Offeror still in the competitive range shall be given an opportunity to submit a final proposal revision. A final cut-off date for receipt of final proposal revisions will be established by the Contracting Officer.
