JUSTIFICATION
AND APPROVAL FOR USE OF OTHER THAN FULL AND OPEN
COMPETITION
1. Contracting Activity
The Naval Sea Systems Command, Naval Surface Warfare Center, Port Hueneme Division, Contracts Department, Port Hueneme, CA 93043-4307. This document sets forth the justification and approval as required by FAR 13.501(a).
2. Description of the Action Being Approved
NSWC PHD intends to award a sole source firm-fixed price contract to General Electric Company, in support of the Command Innovation Laboratory.
3. Description of Supplies/Services
M2 3D Cusing 400W Multilaser Metal Printer, Product ID 97889 – Qty. 1 - $ 1,078,279.00. All funding represented is for FY18 Capital Investment Program Funding (CIP). The Government’s minimum needs have been verified by the certifying technical and requirements personnel.
4. Statutory Authority Permitting Other Than Full and Open Competition
The proposed action may be awarded on a sole source basis under the authority of 41 U.S.C. 1901, as promulgated in subpart 13.5 of the Federal Acquisition Regulation.
5. Rationale Justifying Use of Cited Statutory Authority
The M2 3D Cusing 400W Multilaser Metal Printer has a physical separation of the process chamber and handling area to make them user-friendly and safer for novice users to operate. GE allows the addition of sensors to the printer for data collection without voiding warranty. This ability to modify the Printer allows for increased data collection to better understand the functionality.
Dual Laser (DL) machines provide productivity gains and increase component throughput. The machines will be utilized for rapid production and or prototyping to solve obsolescence issues and added capability for the Fleet, which will provide cost savings to the Navy. Although, single laser printers are commercially prevalent, this technology is becoming obsolete and will not meet anticipated requirements. To aid in experimentation the Navy must push the envelope for what can be printed to save cost. To achieve this reality, the Navy requires the latest equipment.
The M2 cusing Multilaser 400w machine is capable of running any metal that can be made into powder. This includes “reactive” materials such as titanium and aluminum. Additionally, “non-reactive” materials like 718/625 high nickel alloys, 15-5, 17-4 and maraging tool steel. The M2 is ATEX complainant in its architecture and operation with makes it the safest machine on the market to all of the above materials. Thusly, GE M2 is a Multilaser system which will provide unprecedented flexibility. The GE M2 has developed an algorithm for their system that ensures material properties are the same in the overlap zones. GE is the sole manufacturer and distributor of this product.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
A Sources Sought was posted on FedBizOpps with two (2) vendors responding to the solicitation. Philips Corporation’s "Electro Optical System M 290" is not technically acceptable as the addition of sensors for data collection voids the manufacturer’s warranty. GE’s Multilaser printer is technically acceptable for the reasons discussed above. No other potential vendors responded with an assertion that they could satisfy this requirement.
7. Determination of Fair and Reasonable Costs
The Contracting Officer has determined that the anticipated cost to the Government for the supplies covered by the

J&A will be fair and reasonable. The quoted price for M2 3D Cusing 400W Multilaser System is $1,078,279.00. The estimate is fair and reasonable based upon prior purchase history of a similar item.
8. Actions to Remove Barriers to Competition
The Government anticipates that due to the pace of technological development ion the field of metal additive manufacturing, the market environment will be fundamentally different when the next similar item is acquired. The Contracting Officer will undertake an entirely new market research effort to assess the availability of material solutions if competition is possible it will be enthusiastically pursued.
