1. Contracting Activity
The Naval Sea Systems Command Naval Surface Warfare Center, Port
Hueneme Division (NSWC PHD), Contracts Department, Code 02.
2. Description of the Action Being Approved
NSWC PHD intends to award a sole source, base plus four option years, single contract on the basis of other than full and open competition to IHS Global, Inc. This contract will provide the Product Support
Office (PSO), Code 300 and Naval Surface Warfare Center, Port Hueneme
Division (NSWC PHD) with an IHS Global, Inc. subscription that will grant NSWC PHD access to a web-based, comprehensive solution that provides for a searchable parts availability tool to locate shipboard/submarine parts via commercial and government inventories for NSWC PHD and its detachments.
3. Description of Supplies/Services
NSWC PHD and the PSO, have an on-going requirement to access IHS

Integrated Logistics Support for surface warfare combat and weapon systems. This includes fleet maintenance, modernization, and technical support.
In order to sustain this mission, NSWC PHD and detachments require access to a comprehensive solution, searchable parts availability tool, to locate shipboard/submarine parts via commercial and
Government inventories. These capabilities include but are not limited the following:
1) Electronic version of historical military and commercial specifications and standards.
2) Department of Defense (DoD) adopted, non-Governmental specifications and standards.
3) Commercial specifications and standards.
4) Electronic components databases.
5) Vendor catalogs.
NCH 53.6-2
6) Inventory locator capabilities.
The data subscription service is a comprehensive solution providing a single source for on-line access to all of the products, documents and capabilities essential to:
Support material part substitution
Prepare Performance Work Statements (PWS) or Statements of
Work (SOW)
Develop waivers for part(s) re-procurement
Screen procurement actions to identify potential sources of supply and competition opportunities for replacement parts
Enable Engineering Laboratories to determine and extend shelf-life of materials
Research and develop test methods and limits, and provide process development support to depot maintenance activities
Identify technical and safety requirements to support tools and parts procurement
Ensure material conformance and compliance
Respond to contractor’s request for technical clarifications in support of Service Level Agreements (SLAs) with System
Program Offices (SPOs) and Program Managers (PMs)
Ensure compliance with Operational Safety, Suitability, and
Effectiveness (OSS&E) initiatives and directives
Update technical data packages for procurement actions
The Government's minimum needs have been verified by the certifying technical and requirements personnel.

4. Statutory Authority Permitting Other Than Full and Open
Competition
The proposed action may be awarded on a sole source basis under the authority of the test program for commercial items (section 4202 of the Clinger-Cohen Act of 1996. The specific statutory justification
NCH 53.6-2
permitting other than full and open competition is 10 U.S.C. Section
2304 (c)(1), as implemented by the Federal Acquisition Regulation
(FAR) 6.302-1, Only One Responsible Source and No Other Supplies or
Services Will Satisfy Agency Requirements.
5. Rationale Justifying Use of Cited Statutory Authority
Pursuant to 41 U.S.C. 1901, supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in unacceptable delays in fulfilling the Agency’s requirements.
This is a follow-on requirement to Purchase Order N63394-13-F-0007, to continue the use of a highly specialized data subscription services.
The current vendor, IHS Global, Inc., provides commercial online information services and web-based access to logistics and engineering parts management systems, databases and other logistics and engineering information throughout NSWC PHD and detachments.
IHS Global, Inc. has been providing these required capabilities to
NSWC PHD and detachments since the early 1990s and has consistently demonstrated unique and innovative capabilities to provide specific research and document access capabilities required by NSWC PHD and detachments. IHS Global, Inc. is the only known vendor that is licensed to provide on-line access to electronic versions of commercial specifications and standards required for use by NSWC PHD and detachments. IHS Global, Inc. owns the exclusive rights to software developed at their own expense that complies data rights subscription services from numerous different Standards Developing
Organizations (SDOs) comprised of both civilian and Government-owned agencies that retain/house the various logistics and engineering parts management systems, databases and logistical information complied into one cohesive web-based service. NSWC PHD and detachments have a need of data from approximately 70 of these SDOs. Of these SDOs, IHS
Global, Inc. retains exclusive subscription and reproduction rights to eight SDOs and retains primary rights agreement with four other SDOs
(e.g. AIA/NAS and AWS). These exclusive and primary rights agreements preclude/limit the SDOs from selling subscriptions services to other vendors making IHS Global, Inc. the single source of access to these agreements.
Due to the exclusive and primary right agreements discussed above, other vendors cannot provide the same on-line access to electronic versions of all military and commercial specifications required by the activity users. Other vendors offer on-line access to some of the documents, but other required documents would have to be purchased in
CD-ROM or paper copies precluding access to the most up to date information available through on-line subscription services.
NCH 53.6-2
Based upon the information contain herein, IHS Global, Inc. is the only company capable of providing the subscription services describe in Paragraph 3 above.
6. Description of Efforts Made to Solicit Offers from as Many
Offerors as Practicable
A Sources Sought notice was posted from 10 August 2017 to 25 August
2017 on the Federal Business Opportunities (FedBizOpps) website. No other potential sources expressed an interest in this requirement. Per the ISEA, there are no other similar commercial items that currently meet the Government's requirements.
This requirement is the follow-on effort for Purchase Order N63394-13-
F-0007. As a historical reference, N63394-13-F-0007 was synopsized on the FedBizOpps website on July 27, 2012. No other potential sources expressed interest on the requirement at that time.
No additional market research was conducted because it is not practicable, for the reasons discussed in Paragraph 5 above, for any company other than IHS Global, Inc. to provide the required supplies.
7. Determination of Fair and Reasonable Costs
The Contracting Officer will use price analysis, to the extent of including historical price estimating relationships from previous IHS
Global, Inc. (Haystack) Suite procurements, to determine that the final price to the Government is fair and reasonable. The Contracting
Officer has determined that the anticipated cost to the Government for the supplies covered by this Justification & Approval (J&A) will be fair and reasonable.
8. Actions to Remove Barriers to Competition
For the reasons set forth in Paragraph 5, NSWC PHD Contracts
Department has no plans at this time to compete future contracts for the types of supplies covered by this document. If any potential sources emerge, the Government will assess whether competition for future requirements is feasible.
