BRAND NAME JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command (Supervisor of Shipbuilding, Bath, Maine) Contracts Division (C400).

2. Description of the Action Being Approved

Award of a contract on a brand name basis to procure a spare / replacement MAN B&W NA40S M1072 Turbocharger to support the Mobile Landing Platform (MLP) class of USN ships.

Authority to act under this J&A expires 30 September 2015.

3. Description of Supplies/Services

The planned contract action will provide for procurement of a spare / replacement Turbocharger to support continued operation of the main propulsion diesel engines installed aboard MLP class vessels.

The estimated cost to procure a single turbocharger is $557,411.

4. Statutory Authority Permitting Other Than Full and Open

Competition

41 U.S.C. 1901 as authorized by FAR Subpart 13.5.

5. Rationale Justifying Use of Cited Statutory Authority:

The main diesel generators are mission critical to the MLP fleet of USN vessels. Proper refurbishment and maintenance of the engines is critical to the safe operation of the vessels. Specific parts from the original equipment manufacturer, Man B&W, are required to ensure engine reliability and crew safety. In order to avoid degradation or malfunction of current systems, specific makes and models are required for spare components.

6. Description of Efforts Made to Solicit Offers from as Many

Offerors as Practicable:

Market research was conducted, including contacting knowledgeable individuals in the government and industry regarding market capability to meet requirements. In accordance with FAR Parts 5.2, 6.3 and 12.6 a combined synopsis / solicitation and this J&A are posted on the Federal Business Opportunities (FedBizOpps) website.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer will determine the price for the spare / replacement Turbocharger covered by this J&A is fair and reasonable. Similar quantities of this requirement have been purchased in the past. Historical pricing will be used to support analysis of the proposed price and will be sufficient to support fair and reasonable cost determination for this procurement.

8. Actions to Remove Barriers to Future Competition:

For the reasons set forth in paragraph 5, the specific make and model component is required. If a determination is made that other makes and models can meet the requirement, then the Naval Sea Systems Command will assess whether full and open competition for future requirements is feasible.
