5. Rationale Justifying Use of Cited Statutory Authority
Enclosure 1
During the planning conference in Zhanjiang that took place on 24 May 2017, the US government was informed by the Chinese South Sea Fleet (SSF) that
Zhanjiang Bay Shipping Agency Ltd. is the only authorized source to be utilized in this acquisition.
SSF provided enclosure (2) which states the following on page 12: “Please note that, same as before, because the visiting ship is berthed in the naval port, all logistics affairs (vehicle rent, mobile phones, garbage, sewage, oil waste, fenders, gangway, etc.) required by the ship or the
Embassy/DA Officer will be handled by a SSF qualified and authorized agency. Please contact the following ship agency for all the logistic demands. Zhanjiang Bay Shipping Agency Co. Ltd.” The document continues to discuss specific points of contact and details about each service.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as
Practicable
This acquisition is directed source procurement. Any attempts to deviate from a directed source would need to be discussed at a high level with an inter-country discussion between the SSF and US Defense Attaché. At this time, objectives of the diplomatic relations between the US Government and
Chinese government do not warrant this discussion.
IAW 5.202(a)(12), this requirement is exempt from publishing a synopsis on
FEDBIZOPS.gov.
7. Determination of Fair and Reasonable Cost
The contracting officer has determined the anticipated cost to the
Government of the supplies/services covered by this J&A will be fair and reasonable. During the meeting on 24 MAY 2017, the vendor provided a pricing list. On 26 MAY 2017, FLCY compared the unit prices proposed with previous invoiced costs from the USS BLUE RIDGE port visit to the same port with the same company. The unit prices were found to be very similar with both minor decreases and minor increases to various line items. The change in pricing is a reasonable expectation based on the 2-year period of time that has passed. Specific line by line detail discussing fair and reasonable determination will be documented in the award documentation.
8. Actions to Remove Barriers to Future Competition
For the reasons set forth in Paragraph 5, FLC Yokosuka has no plans at this time to compete future contacts for the types of supplies/services covered by this document. If another potential source emerges, FLC
Yokosuka will assess whether competition for future requirements is feasible.
