JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
1. Identification of the agency and the contracting activity.
This justification is executed by the Naval Medical Logistics Command (NMLC), Fort Detrick, MD to meet the requirements of the Navy Medicine Education, Training and Logistics Command (NMETLC), Fort Sam Houston, TX.
2. Nature and/or description of the action.
The requirement is for web-based emergency nursing orientation courses. The Government intends on awarding a Firm Fixed Price (FFP) contract. The proposed manufacturer is Elsevier, Inc., 1600 John F Kennedy Blvd, Suite 1800, Philadelphia, PA 19103. 4. Identification of the statutory exceptions permitting other than full and open competition.
The statutory exception permitting other than full and open competition for this acquisition is 10 USC 2304(c)(1) and FAR 13.106-1(b)(1), brand name only. There are distributors capable of providing courses meeting the minimum government requirements.
5. Demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.
The Emergency Nurses Association (ENA) is the professional source for Emergency/Trauma Nursing related topics and is the only organization to provide board certification in Emergency Nursing. Elsevier, Inc. (in partnership with the ENA) developed the only comprehensive, web-based Emergency Nursing Orientation (ENO) program capable of meeting the minimum requirements for emergency nurses outlined by the NAVMED 1500/10 and discussed in section 3 above. Further, the ENO program developed by Elsevier, Inc. is the only program capable of running on the Navy Clinical Skills On-line LMS platform currently utilized across the Navy enterprise. While there are other entities that can provide this type of program, they are all in-person, classroom programs and are not web-based and therefore not capable of running on the Navy Clinical Skills On-line LMS platform or be available for use at all MTFs Navy wide. There are no other web-based ENO programs currently available that would meet the competency requirements outlined in the Navy Nursing Knowledge, Skills and Abilities (NAVMED 1500/10) and be capable of running on the current LMS platform utilized across the Navy enterprise. Thus, Elsevier, Inc. is the only manufacturer that developed an ENO program that can meet the minimum requirements of the Government.
Various distributors are capable of providing access to the ENO program developed by Elsevier, Inc.
6. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
Market research was performed, the results of which are in paragraph 8. This requirement will be posted to the Federal Business Opportunities (FedBizOpps) website in accordance with FAR 5.202. The Government will evaluate any responses received.
7. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The Contracting Officer shall determine the anticipated cost to the Government of the supplies/services covered by this Justification and Approval will be fair and reasonable by conducting a price analysis before an award is made. In addition, the Government anticipates that the negotiated contract price will reflect a discount from the vendor’s commercial price list and will be determined fair and reasonable.
8. Description of the market survey conducted and the results, or a statement of the reasons a market survey was not conducted.
Market research was conducted in May/June 2017. It included a search of the Internet using Google and Bing; a query of the Electronic Document Access (EDA) system in WAWF; contact with the Navy Nurse Corps Subspecialty Leader as well as the Emergency Nursing Associated (ENA). The ENA is the governing body of clinical excellence for registered nurses specializing in emergency medicine and a standard of professional development culminating in certification. The Emergency Nursing Orientation (ENO) Kit, developed by Elsevier in conjunction with the ENA, is
Form 02.4G.AB Page 3 of 4 01 Nov 2012 the only comprehensive resource that meets the mission and training requirements of this targeted group by reflecting the most current standards of practice in order to provide the best educational product possible.
Comparable programs were identified through a search of the Internet; however, these programs focused on continuing education and did not have a methodical delivery of content for comprehensive development of individuals new to the emergency nursing environment. Further, comparable programs offered a blended learning approach for orientation and professional development (classroom, online and self-study) and were not available for an audience across a variety of geographical locations. Vendors which can provide web-based emergency nursing orientation courses addressing the topics specified in the NAVMED 1500/10 include Elsevier, Inc. and Advanced Educational Products (AEP), Inc. Elsevier, Inc. is the only manufacturer that can meet the requirements of the Government. Further, the Elsevier ENO product is the only product capable of delivering comprehensive content in accordance with NAVMED 1500/10 via an online delivery platform. AEP, Inc. is the only authorized distributor of Elsevier, Inc. products that could potentially meet the government’s minimum requirement. It should be noted that AEP, Inc. does have a GSA contract (GS-02F-0043M); however, it could not be verified whether the ENO or Emergency Triage courses are currently available via the GSA schedule. As a result, this requirement should be competed as Brand Name Only.
9. Other facts supporting the use of other than full and open competition.
None
10. Listing of Sources, if any, which expressed, in writing, an interest in the acquisition.
To date, no other sources have written to express an interest. This requirement will be posted on FedBizOpps in accordance with FAR 5.202. Any sources expressing interest in response to the synopsis will receive consideration.
11. Statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
Future requirements will be synopsized in accordance with FAR 5.203. For the reasons set forth in Paragraph 5, NMLC has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NMLC will assess whether competition for future requirements is feasible.
