Pediatric Ambulance Services, Naval Medical Center Portsmouth, VA J&A #16-01147
JUSTIFICATION AND APPROVAL FOR
OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
This justification is executed by the Naval Medical Logistics Command, Fort Detrick, Maryland on behalf of Naval Medical Center Portsmouth, VA (NMCP).
2. Description of the Action Being Approved.
The government intends to award a sole source contract to Children’s Health System Inc. (CHS) for pediatric ambulance services at NMCP.
3. Description of supplies/services.
CHS is currently providing the required pediatric ambulance services under contract N00189-14-P-Z468 which expires 30 September 2016. It is anticipated that the contractor will provide 100 transports per year encompassing 4,500 miles. The Government intends to award an indefinite delivery indefinite quantity contract for the required services with a period of performance from 01 October 2016 through 30 September 2021. The total estimated dollar value of the resultant contract is $1,690,636.21. It is anticipated that Fiscal Year 17 Defense Health Program funding will be utilized.
4. Statutory Authority Permitting Other Than Full and Open Competition.
FAR § 13.106-1(b)(1)(i) Soliciting from a single source.
The procedures in FAR subpart 13.5 will be used in accordance with 41 U.S.C. 1901.
5. Rationale Justifying Use of Cited Statutory Authority.
CHS has the necessary vehicles, equipment/supplies and personnel to provide the services described herein.
CHS has specialized ambulances designed for neonatal transports. These specialized vehicles contain unique equipment that is not found on a standard ambulance, such as incubators and car safety seats, and standard equipment (such as needles, IV pumps and ventilators) designed specifically for infants and children. The transport team provided by CHS meets all of the requirements of Chapter 31 of the Virginia Administrative Code, including the requirements for neonatal transports. Unless staffed with a physician, the transport team must include a registered nurse or physician assistant with specialized neonatal training or another health care provider with equivalent training or experience approved by the Office of EMS.
CHS’s team consists of a registered nurse, respiratory therapist, and an emergency medical technician. CHS is also located within a close proximity (less than 75 miles) of NMCP. Due to the nature of this requirement, requests for service can be made at any time Monday through Sunday, including after hours, weekends and Federal holidays. A timely response is crucial as services are reserved for the most critical patients. Accordingly, CHS is the only qualified pediatric ambulance provider that has the capability to perform the work successfully.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
As discussed in paragraph 5 above, a sources sought notice was posted to FedBizOpps to identify potential sources; however, no response was received. Additionally, a notice of intent to award a sole source contract to CHS will be posted to FedBizOpps.
7. Determination of Fair and Reasonable Cost.
Prior to award, the Contracting Officer will make a determination that the award price(s) are fair and reasonable. It is anticipated that the price analysis conducted will utilize the Government’s independent cost estimate.
8. Description of the market research conducted.
A sources sought notice was posted to www.fedbizopps.gov (FedBizOpps) on 15 January 2016 with a closing date of 27 January 2016 in an attempt to identify potential sources that are interested in and capable of performing the required pediatric ambulance services. No responses were received in response to the notice posted to FedBizOpps. Additional market research was conducted and a search of the U.S. General Services Administration eLibrary yielded no contractors capable of providing the required services. In addition, the Federal Procurement Data System was queried and no ambulance companies capable of providing the required services were found within a 75 mile radius of NMCP.
9. Any other facts supporting the use of other than full and open competition.
Not applicable.
10. A listing of sources that expressed an interest in the acquisition.
Although a sources sought notice was posted on FedBizOpps, no sources expressed an interest in the acquisition.
11. Actions to Remove Barriers to Future Competition.
See Paragraphs 8 and 10. This requirement represents a non-competitive follow-on acquisition of services previously awarded on a non-competitive basis. At this time, no new sources could be located. For future requirements, market research will be conducted to identify potential sources. A copy of the previous justification is attached to assist the approval authority in determining whether the planned actions to remove any barriers to competition cited on the previous justification were completed.
