CLAUSES INCORPORATED BY FULL TEXT
252.225-7001 BUY AMERICAN AND BALANCE OF PAYMENTS PROGRAM--BASIC (DEC 2017)
(a) Definitions. As used in this clause--
Commercially available off-the-shelf (COTS) item--
(i) Means any item of supply (including construction material) that is--
(A) A commercial item (as defined in paragraph (1) of the definition of ``commercial item'' in section 2.101 of the Federal Acquisition Regulation);
(B) Sold in substantial quantities in the commercial marketplace; and
(C) Offered to the Government, under a contract or subcontract at any tier, without modification, in the same form in which it is sold in the commercial marketplace; and
(ii) Does not include bulk cargo, as defined in 46 U.S.C. 40102(4), such as agricultural products and petroleum products.
Component means an article, material, or supply incorporated directly into an end product.
Domestic end product means--
(i) An unmanufactured end product that has been mined or produced in the United States; or
(ii) An end product manufactured in the United States if—
(A) The cost of its qualifying country components and its components that are mined, produced, or manufactured in the United States exceeds 50 percent of the cost of all its components. The cost of components includes transportation costs to the place of incorporation into the end product and U.S. duty (whether or not a duty-free entry certificate is issued). Scrap generated, collected, and prepared for processing in the United States is considered domestic. A component is considered to have been mined, produced, or manufactured in the United States (regardless of its source in fact) if the end product in which it is incorporated is manufactured in the United States and the component is of a class or kind for which the Government has determined that--
(1) Sufficient and reasonably available commercial quantities of a satisfactory quality are not mined, produced, or manufactured in the United States; or
(2) It is inconsistent with the public interest to apply the restrictions of the Buy American statute; or
(B) The end product is a COTS item.
End product means those articles, materials, and supplies to be acquired under this contract for public use.
Foreign end product means an end product other than a domestic end product.
Qualifying country means a country with a reciprocal defense procurement memorandum of understanding or international agreement with the United States in which both countries agree to remove barriers to purchases of supplies produced in the other country or services performed by sources of the other country, and the memorandum or agreement complies, where applicable, with the requirements of section 36 of the Arms Export Control Act (22 U.S.C. 2776) and with 10 U.S.C. 2457. Accordingly, the following are qualifying countries:
Australia, Austria, Belgium, Canada, Czech Republic, Denmark, Egypt, Estonia, Finland, France, Germany, Greece, Israel, Italy, Japan, Latvia, Luxembourg, Netherlands, Norway, Poland, Portugal, Spain, Sweden, Switzerland, Slovenia, Turkey, United Kingdom of Great Britain and Northern Ireland.
Qualifying country component means a component mined, produced, or manufactured in a qualifying country.
Qualifying country end product means--
(i) An unmanufactured end product mined or produced in a qualifying country; or
(ii) An end product manufactured in a qualifying country if--
(A) The cost of the following types of components exceeds 50 percent of the cost of all its components:
(1) Components mined, produced, or manufactured in a qualifying country.
(2) Components mined, produced, or manufactured in the United States.
(3) Components of foreign origin of a class or kind for which the Government has determined that sufficient and reasonably available commercial quantities of a satisfactory quality are not mined, produced, or manufactured in the United States; or
(B) The end product is a COTS item. United States means the 50 States, the District of Columbia, and outlying areas.
(b) This clause implements, Buy American. In accordance with 41 U.S.C. 1907, the component test of the Buy American statute is waived for an end product that is a COTS item (see section 12.505(a)(1) of the Federal Acquisition Regulation). Unless otherwise specified, this clause applies to all line items in the contract.
(c) The Contractor shall deliver only domestic end products unless, in its offer, it specified delivery of other end products in the Buy American--Balance of Payments Program Certificate provision of the solicitation. If the Contractor certified in its offer that it will deliver a qualifying country end product, the Contractor shall deliver a qualifying country end product or, at the Contractor's option, a domestic end product.
(d) The contract price does not include duty for end products or components for which the Contractor will claim duty-free entry.

00 22 16.16 SECURITY AND ACCESS REQUIREMENTS FOR NAVAL AIR STATION
FALLON, FALLON, NEVADA
Identification badges, if required, will be furnished based on the individual installation security procedures in addition to Defense Biometric Identification System (DBIDS). DBIDS is a DoD-owned and operated system developed by Defense Manpower Data Center as a force protection program to manage personnel identity and access at DoD installations. DBIDS is a network database system designed to easily verify access authorization of personnel entering military installations by using barcodes and fingerprint biometric identifications. To improve management and force protection at Navy installations, the Navy is transitioning from using NCACS to DBIDS for contractors and vendors requiring access to an installation at no cost to them. The transition began on April 17, 2017 and individuals were given up to 180 days to obtain the permanent card. As of July 15, 2017, NCACs cards will no longer be accepted.
The contactor is responsible for obtaining proper credentials, including participation in the DBIDS program. The Contractor must immediately report instances of lost or stolen badges to the Contracting Officer. Failure of contractor personnel to obtain entry approval will not affect the contract price or time of completion. All Contractor personnel shall become familiar with and obey all Government regulations including fire, traffic, and security regulations. Refer to individual Task Order or Station requirements provided at the preconstruction conference.
Contractor personnel will not be admitted to the work site without approval. Access requirements will be as identified in station policy for each location. Some facilities, or areas within some facilities, restrict access to U.S. Citizens only.
Additional details may be found at the Commander, Navy Installations Command website at https://www.cnic.navy.mil/om/dbids.html.
Escorted Persons: This category of personnel encompasses un-vetted contractor/vendor personnel who require access and are not covered in any other category. Escorts take responsibility for said personnel who are riding in a separate vehicle (delivery trucks, contractor rentals, etc.). It is inherent they are physically escorted AT ALL TIMES while on board Government property. By nature, these personnel have not been through any vetting process and represent the greatest risk. As such, the procedures described in this paragraph apply to the ESCORT, rather than the escorted. Personnel eligible to escort are as follows:
(1) Personnel assigned to NAFACSW or a permanent tenant who possesses a CAC credential.
(2) Contractors/vendors providing a service to NAFACSW or a tenant command who possess a DBIDS or NPACS credential for NAS Fallon.
However, eligibility is dependent on completion of Escort training, available from the Pass and ID office, submission of the escort training acknowledgement letter, and contractor enhanced access designation letter. Names of approved escorts who have completed the required training will be maintained in a searchable database at each gate. Contact your Construction Manager/Technician via email or telephone for more information.
Unescorted persons: Personnel who are requesting unescorted access will be required to submit a SECNAV 5512/1 (APR 2014) a minimum of 14 CALENDAR DAYS PRIOR to the date of desired access. For new construction contracts; all contractor personnel who will require access during the subject contract must submit said form individually NLT 10 calendar days from the date of award. SECNAV 5512/1 (APR 2014) will be provided by PWD Fallon upon contract award.
Upon approved vetting, unescorted personnel will need the following to access the installation:
(a) Valid Federal/State identification including photo, name, date of birth, height, eye color and current address.
(b) If driving on board, they will also need a valid driver’s license, vehicle registration, proof of insurance or valid rental contract and valid driver’s license.
Contact your Construction Manager or Tech for the required documents to gain the access type described in this section.
Foreign Nationals: Civilian contractors employing foreign nationals shall ensure they possess a U.S. work visa or a valid Permanent Resident Card for lawful employment in the United States.
In addition, prior to permitting any foreign national access to work in or on classified or restricted areas and equipment, the contractor shall perform a clearance check equivalent to the requirements set for civilian employees of the Department of Defense. The results of these background checks shall be made available to the ISO upon request.

52.211-12 LIQUIDATED DAMAGES--CONSTRUCTION (SEP 2000)
(a) If the Contractor fails to complete the work within the time specified in the contract, the Contractor shall pay liquidated damages to the Government in the amount of $1,100.00 for each calendar day of delay until the work is completed or accepted.
(b) If the Government terminates the Contractor's right to proceed, liquidated damages will continue to accrue until the work is completed. These liquidated damages are in addition to excess costs of repurchase under the Termination clause.
52.211-13 TIME EXTENSIONS (SEP 2000)
Time extensions for contract changes will depend upon the extent, if any, by which the changes cause delay in the completion of the various elements of construction. The change order granting the time extension may provide that the contract completion date will be extended only for those specific elements related to the changed work and that the remaining contract completion dates for all other portions of the work will not be altered. The change order also may provide an equitable readjustment of liquidated damages under the new completion schedule.
52.219-28 POST-AWARD SMALL BUSINESS PROGRAM REREPRESENTATION (JULY 2013)
Long-term contract means a contract of more than five years in duration, including options. However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority.
Small business concern means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (c) of this clause. Such a concern is ``not dominant in its field of operation'' when it does not exercise a controlling or major influence on a national basis in a kind of business activity in which a number of business concerns are primarily engaged. In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity.
(b) If the Contractor represented that it was a small business concern prior to award of this contract, the Contractor shall rerepresent its size status according to paragraph (e) of this clause or, if applicable, paragraph (g) of this clause, upon the occurrence of any of the following:
(1) Within 30 days after execution of a novation agreement or within 30 days after modification of the contract to include this clause, if the novation agreement was executed prior to inclusion of this clause in the contract.
(2) Within 30 days after a merger or acquisition that does not require a novation or within 30 days after modification of the contract to include this clause, if the merger or acquisition occurred prior to inclusion of this clause in the contract.
(3) For long-term contracts--
(i) Within 60 to 120 days prior to the end of the fifth year of the contract; and
(ii) Within 60 to 120 days prior to the date specified in the contract for exercising any option thereafter.
(c) The Contractor shall rerepresent its size status in accordance with the size standard in effect at the time of this rerepresentation that corresponds to the North American Industry Classification System (NAICS) code assigned to this contract. The small business size standard corresponding to this NAICS code can be found at http://www.sba.gov/content/table-small-business-size-standards.
(d) The small business size standard for a Contractor providing a product which it does not manufacture itself, for a contract other than a construction or service contract, is 500 employees.
(e) Except as provided in paragraph (g) of this clause, the Contractor shall make the representation required by paragraph (b) of this clause by validating or updating all its representations in the Representations and Certifications section of the System for Award Management (SAM) and its other data in SAM, as necessary, to ensure that they reflect the Contractor's current status. The Contractor shall notify the contracting office in writing within the timeframes specified in paragraph (b) of this clause that the data have been validated or updated, and provide the date of the validation or update.
(f) If the Contractor represented that it was other than a small business concern prior to award of this contract, the Contractor may, but is not required to, take the actions required by paragraphs (e) or (g) of this clause.
(g) If the Contractor does not have representations and certifications in SAM, or does not have a representation in SAM for the NAICS code applicable to this contract, the Contractor is required to complete the following rerepresentation and submit it to the contracting office, along with the contract number and the date on which the rerepresentation was completed:
