JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
Authority: 41 U.S.C. 1901, as implemented by FAR 13.106-1(b)(1)
Pursuant to the Competition in Contracting Act (CICA) and in accordance with Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i) this justification shall contain sufficient facts and rationale to document the basis for using the exception to the fair opportunity process of the statutory authority cited above.
1. Contracting Activity.
The Naval Oceanographic Office (NAVOCEANO), Contracting Department, Stennis Space Center, MS, anticipates awarding a firmed-fixed price delivery order on a sole source basis to Quality Positioning Services Inc.(QPS Inc.) for Qimera software.
2. Description of the Action Being Approved.
The Government anticipates awarding a contract / order for commercial items utilizing FY19 OM&N funding. The anticipated delivery date is thirty (30) days after award.
3. Description of Supplies.
NAVOCEANO, Special Projects Cell (0TPL), has a requirement to procure Qimera software in order to standardize the configuration of the Sensitive Compartmented Information (SCI) Network architecture. The software is required to essentially provide both access to applications and services as well as allow for integration of complex mapping technologies. The intent is to maximize system application uptimes and provide reliable and consistent products to customers within the Intelligence Community (IC). These Qimera products shall support both the National Geospatial Intelligence Agency (NGA) as well as Special Projects Cell (0TPL) efforts and, those customers within the IC.
The overall contract efforts and goals are to acquire the software as well as annual software maintenance support for the software outlined below. Collaboration among the vendors trained / certified technicians and the system administrator to analyze and resolve complex technical issues with custom solutions specific to the organization ensuring there is no lapse in support.
FOR OFFICIAL USE ONLY
4. Statutory Authority Permitting Other Than Full and Open Competition.
The statutory authority permitting limited sources for this requirement is 41 U.S.C. 1901 as implemented by FAR 13.106-1(b)(1)(i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available.
5. Rationale Justifying Use of Cited Statutory Authority.
During this transition of the Surf Eagle architecture, NAVOCEANO would not be able to support national mission requirements for 6-9 month and appropimately $463k of funding impacts.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
Current market research confirms that Qualtity Positioning System (QPS) is the only manufacturer of the software and the only company that has the source code to maintain compatibility with existing Qimerasoftware such as firmware, patches, and software upgrades.
However, there are numerous Qimera partners available to provide the hardware repair and replacements as well as associated software patches, firmware, and updates. This purchase is for new hardware, required by Intelligence Community Directive 503 and 501. All new hardware shall be deployed and / or implemented utilizing existing Government personnel and / or resources.
7. Determination of Fair and Reasonable Cost.
Before making an award, the Contracting Officer will determine that the proposed price is fair and reasonable based on one of the techniques identified in Federal Acquisition Regulation (FAR) Subpart 13.106-3 - Award and Documentation.
8. Actions to Remove Barriers to Future Competition.
At this time NAVOCEANO has no intent to compete this requirement full and open; however, recurring market research will continue to be conducted throughout the lifecycle to examine suitability of emerging software technologies and products. If new software is capable and compatible, full and open competition will be sought to maximum extent possible.
