About this file
This document is a Sole Source Justification Memorandum for the Naval Surface Warfare Center Panama City Division (NSWC PCD) to acquire SDV MK11 Bow Plane Assemblies from Teledyne Brown Engineering, Inc. The procurement involves purchasing 10 Bow Plane Assemblies (Part Number 8600030), with additional line items for individual wrapping/boxing/labeling and shipping to Panama City. The acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels but not exceeding the simplified acquisition threshold of $250,000.00.
The justification for sole source procurement is based on the unique manufacturing history of the MK11 Bow Plane Assembly, which was custom manufactured by Teledyne Brown Engineering specifically for the SDV (Special Depth Vehicle). The government determined that other manufacturers of similar assemblies have not been vetted or approved for substitution, and the costs and time required to identify, evaluate, and test alternative systems would be prohibitively expensive. The Contracting Officer has determined that this order represents the best value and lowest overall cost alternative to meet the government's needs, with items to be submitted no later than 6 months after order award.

10 U.S.C. 2304(c) (1) - Only one responsible source and no other supplies or services will satisfy agency requirements, FAR 6.302-1.
The Naval Surface Warfare Center Panama City Division (NSWC PCD) has a requirement to procure ten SDV MK11 Bow Plane Assemblies. This requirement is not suitable for full and open competition for the following reason(s): The MK11 Bow Plane Assembly referenced in the subject purchase request were custom manufactured by Teledyne Brown Engineering, Inc. for the SDV. Other manufacturers of similar assemblies have not been vetted or approved for substitution. The additional costs and time delays for the Government to identify and evaluate another system, perform the field-testing of the equipment, and produce the required documentation and drawings would be prohibitive. As such, Teledyne Brown Engineering Inc. is the only source capable of meeting this requirement.
5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).
The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.
6. A description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted.
The purchase amount is greater than $25,000 and will be synopsized on the Contract Opportunities website at sam.gov. No additional market research was conducted for the reasons discussed in paragraph 4 above, for any company other than Teledyne Brown Engineering, Inc.
to provide the products.
7. Any other facts supporting the justification. None.
8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
As stated in paragraph 4 above, Teledyne Brown Engineering, Inc. is the only source that can meet the requirement.
