MEMORANDUM
Subj: Sole Source Justification for a Dive Lab human mannequin torso form with test head and attachment provisions (PR 1300823026).
1. Identification of the agency and the contracting activity, and specific identification of the document as a “Sole Source Justification.”
This is a sole source justification. Contracting activity is NSWC-PCD, Code 024, 110 Vernon
Ave., Panama City, FL, 32407.
2. Nature and/or description of the action being approved.
This action will award a WOSB sole source, firm fixed price purchase order pursuant to FAR
19.1506 to Dive Lab Inc., Inc. to acquire a Dive Lab human mannequin torso form with test head and attachment provisions for use in N31 Test and Evaluation departments Experimental
Diving Facility.
3. A description of the supplies or services required to meet the agency’s needs
(including the estimated value).
1 Each Part Number DL-MNQT-H3, Custom Human Mannequin Torso for diving helmet experimentations.
This acquisition will be conducted using simplified acquisition procedures with a total estimated value of $28,400.00. The Government's minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This purchase will be funded with FY20 100001 473998 0060 funds.
4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.
10 U.S.C. 2304(c)(1), 10 U.S.C. 2304(d)(1)(B). Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements FAR 6.302-1(a)(2)(iii)(B), FAR 6.302-5(b)(7).
Dive Lab, Inc. provides complete support and testing, as well as manufacturing of hyperbaric and underwater diving equipment and have produced the testing mannequins that NEDU N31
Department uses to conduct evaluations of underwater breathing apparatus, specifically with
Kirby Morgan diving helmets and rebreathers. The current mannequin torso is a critical component of the experimental diving facility and has reached the end of its service life. The intimate knowledge the contractor has of these test mannequins is shown by the fact that they produced all previous versions NEDU has purchased. Execution of this contract allows for significant cost savings to the government if Dive Lab Inc. is to produce this mannequin, which is available in their stock system under part number DL-MNQT-H3 and is built to EN standard
15333-1. Their unique experience and ability the meet our needs allow for less risk and lower costs of this service. Additionally, time constraints are applicable as we are currently operating have requirements for the N31 human torso mannequin to perform mission essential tasking and have requirements that will become due before a contract bid process could be completed.
As such, the Government does not expect significant savings through competition and does expects significant and unacceptable delays that will negatively impact this requirement. Therefore, it is in the Governments’ best interest to award on a sole source basis to Dive Lab, Inc.
5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).
The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.
6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
For the reasons specified in paragraph 4 above, Dive Lab, Inc. is the only source that can meet the Government’s needs.
7. Any other facts supporting the justification.
None.
8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
As stated in paragraph 4 above, Dive Lab, Inc. is the only source that can meet this requirement.
