MEMORANDUM
Subj: SOLE SOURCE MEMORANDUM TO ACQUIRE PBATS BREATHING
MACHINE(S) FOR THE HYDROSPACE LABORATORY (ERP # 1300-
_TBD__)
1. Identification of the agency and the contracting activity, and specific identification of the document as a “Limited Source Justification.”
This is a sole source justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001 (Contracts Division Code 02).
2. Nature and/or description of the action being approved.
This action will award a firm fixed price purchase order to Reimers Systems (A DIVISION OF PCCI, INC.) 300 North Lee Street, Ste. 201, Alexandria, VA 22314 for a PBATS Breathing Machine for the Hydrospace Laboratory located at the NSWC PCD.
The Hydrospace Laboratory conducts hyperbaric testing of Diving and Life Support equipment. Procured item(s) would directly support testing of unmanned underwater units, underground emergency escape equipment, life-support systems for Navy aircraft, etc. A device that is currently used by Hydrospace Laboratory’s partner, The Navy Experimental Diving Unit, is required to eliminate variances in data due to equipment variability.
3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).
The following items are being acquired:
1) PBATS Breathing Machine, LM-150- 1000psi-DELM-ECV (Double Cylinders similar to the one built for NEDU in year 1997) each USD $188,105.00
2) Estimate shipping to site each USD $1,250.00
This acquisition will be conducted using simplified acquisition procedures for other than commercial items FAR 13.003(g)(1). The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. All services will be delivered within one (1) year after award of purchase order. The contract action will be funded with Direct Project Funds (sponsor PMS 408).
4. Identification of the justification rationale (see FAR 8.405-6(a) and (b)) and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.
10 U.S.C. 2304(c) (1) - Only one responsible source and no other supplies or services will satisfy agency requirements, FAR 6.302-1. The Hydrospace Laboratory has been working with the Navy Experimental Dive Unit (NEDU) on unmanned testing of underwater breathing equipment will be working with NEDU on the life-supports systems of aviation units in the Navy and Air Force.
In order to ensure that data is sharable between the Hydrospace Laboratory and NEDU, it is imperative that equipment matches to the best of our ability. Currently NEDU uses multiple Reimers Systems Breathing Machines (identical to those listed in Paragraph 3).
The Hydrospace Laboratory has obtained the exact plans and requires having the same company Reimers Systems construct the breathing machine(s) required to perform the testing. Based on the collaborative approach used by the Hydrospace laboratory and NEDU, the requirement to maintain the data’s integrity, and systems compatibility it is imperative that the brand provided solely by Reimers Systems is acquired.
The Hydrospace Laboratory has performed an extensive market survey of possible suppliers for the required equipment needed by the HYDROSPACE. Based upon the market survey performed by the Hydrospace Laboratory, only Reimers Systems can provide the Hydrospace Laboratory with the equipment listed in paragraph 3, avoiding the associated expenses to change the instrumentation baseline and training required to use the equipment, which are not expected to be recovered through competition.
Therefore it is imperative that these services be acquired through Reimers Systems.
5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).
The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.
6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 4 above, for any company other than Reimers Systems to provide the required breathing machine.
7. Any other facts supporting the justification.
None
8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
As stated in paragraph 4 above, Reimers Systems is the only company that can provide the required service within the timeframe and budget allotted.
