MEMORANDUM

Subj: SOLE SOURCE MEMORANDUM TO ACQUIRE SOFTWARE

DEVELOPMENT VIA A CERTIFIED LABVIEW PROGRAMMER FOR THE

HYDROSPACE LABORATORY (ERP # 1300-_TBD__)

1. Identification of the agency and the contracting activity, and specific identification of the document as a “Limited Source Justification.”

This is a sole source justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001 (Contracts Division Code 02).

2. Nature and/or description of the action being approved.

This action will award a firm fixed price purchase order to Davis Systems, 3163 E.

Chestnut Ave, Crestview, FL, 32539 to develop and program critical life-support testing software for the Hydrospace Laboratory located at the NSWC PCD. The Hydrospace Laboratory conducts hyperbaric testing of Diving and Life Support equipment. This service will continue the advancement of the software packages used in testing unmanned underwater breathing systems, underground emergency escape equipment, life-support systems for Navy aircraft, etc. An advanced understanding of Diving and Life Support systems and the research and development of newer systems is critical for software development.

3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).

The following items are being acquired:

The primary software used in the development of an all-inclusive package will be LabVIEW©, a virtual instrument/ system-design platform and development environment created and distributed by National Instruments®. Additional software programs will be produced to control tests supported by the all-inclusive software package. These additional programs will control and monitor gas supplies, control hyperbaric test chambers used in testing, and support automation toward improving test accuracy for increased warfighter mobility.

Individual programs will be designed for specific tests required for project work conducted in the Hydrospace Laboratory, including but not limited to:

• Life Support Testing o Respiratory Work of Breathing (WOB) o Carbon Dioxide Canister Duration o Inspired Carbon Dioxide o Oxygen Control o System Pressures o System Temperatures o System Flow Rates

• Thermal Studies

• Flow Studies

• Pressure/Pressure Drop Studies

• Metabolic Consumption and Production

• Automated Gas Supply:

o Pressurized Gas Supply Monitoring o Hyperbaric Chamber Control o Transfer of Pressurized Pure and Mixed Gases

• Automated Breathing Systems:

o Software Controlled Waveforms o Breathing Loop Environmental Control

Within each program exist sub-programs capable of monitoring and controlling a multitude of sensors necessary for the above programs, these include:

• Temperature sensors

• Motion sensors

• Pressure sensors

• Flow sensors

• Acoustic sensors

• Video

• Supply Voltage (VDC, VAC)

• Supply Current (Ampere)

This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels, but not exceeding the simplified acquisition threshold of $150,000.00. The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. All services will be delivered within one (1) year after award of purchase order. The contract action will be funded with Direct Project Funds (sponsor PMS 408).

4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

10 U.S.C. 2304(c) (1) - Only one responsible source and no other supplies or services will satisfy agency requirements, FAR 6.302-1. The HYDROSPACE LABORATORY has been working with Davis Systems for over a year. The work performed requires knowledge of not only Software Development via LabVIEW, but a deep understanding of unmanned Diving & Life Support systems. The time and training required to bring a new service provider up to the level required would be prohibitive, costing a minimum of 120-160 hours (~$12,000-$16,000) just for another source to get to a minimal understanding and comfort with the Hydrospace Life-Support Systems (estimate based on previous experiences). As a result, not awarding to Davis Systems will cause reoccurring costs in time and schedule not expected to be recovered through competition, for the necessity to have contractor support gain the tacit knowledge needed to support this task.

Therefore, it is advantageous to the Government to award on a sole source basis to Davis Systems.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 8.404(d).

The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.

6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 4 above, for any company other than Davis Systems to provide the required gas standards.

7. Any other facts supporting the justification.

None

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

As stated in paragraph 4 above, Davis Systems LLC is the only company that can provide the required service within the timeframe and budget allotted.
