A firm-fixed-price commercial item order will be issued under the Test Program for Commercial Items, Federal Acquisition Regulations (FAR) Subpart 13.5, and pursuant section 41 U.S.C. 1901 (c). The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This justification does not authorize acquisition for other requirements. Delivery will be complete within 190 days after award of the order.

4. Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C. 2304(c) (1) - Only one responsible source and no other supplies or services will satisfy agency requirements, FAR 6.302-1.

5. Rationale Justifying Use of Cited Statutory Authority

NSWC PCD is the design authority and in-service engineering agent (ISEA) for the LCAC C4N SLEP system. The parts being purchased are ruggedized commercial off-the-shelf (COTS) items manufactured by SEKAI (formerly IVT). This purchase is not suitable for full and open competition for the following reasons:

a. SEKAI Electronics (formerly IVT) delivered fully environmentally qualified night vision complaint displays for the SLEP and Craft Alt 506K efforts. These products underwent full environmental qualification testing for the LCAC operational environment to ensure 100 percent compatibility with the product specification and MIL-STD-810G and MIL-STD-461F. Full integration testing was accomplished to ensure that the display met the signal requirements of the LCAC system. As a result NSWC PCD awarded contract N61331-12-D-0005 in 2012 on a sole source basis for the liquid crystal diode (LCD) displays, end-of-life (EOL) spare parts, and non-recurring engineering to deal with potential parts obsolescence issues. Due to the requirements as provided in the Multi-Platform display specification, NSWC PCD has determined that it is necessary to purchase the same configuration end-items for the remaining LCACs. As the design authority of the IVT Multi- Platform Display (MPD), Sekai Electronics has sole proprietary (limited) rights to their Technical Data Package (TDP), which would be required for a build-to-print competitive acquisition. Due to the proprietary nature of the TDP, Seakai is listed as the single source of supply by NAVSUP for the MPD.

b. The installed displays are integrated into the display console and craft wiring, and are 100% compatible with the Alarm Monitoring System (AMS), Sperry Bridgemaster E Radar and the Foruno FAR-2127 Radar, Radar Interface Converter Unit (RICU), and Navigation Processor Unit NPU or Keypad Video Navigation KVN unit. A full and

open competition would be schedule and cost prohibitive as it would require another vendor to undergo the same level of qualification and testing without assurance of the end results (previous competitive development cycles have been between 24 and 30 months for this product).

c. Due to the end-of-life issues with the LCD display glass and subcomponents, a full and open competition would not provide a fully compatible product as to what is already integrated with the craft. Sekai Electronics currently holds the EOL tested, certified, and integrated components to produce the deliverables on this contract. In order to develop a new display to meet the MIL-STD-810G environmental standards required and MIL-STD-461F electromagnetic interference standards required, the Multi- Platform Display Specification, and night vision equipment compatibility requirements, a specified LCD would have to be utilized. Current commercially available LCDs do not meet this profile. In addition to qualification testing in order to utilize what is currently commercially available, the aspect ratio of the LCAC displays would have to be changed This would cause a Class I change (or major changes as defined in the EIA standard 649)to the configuration of the console. The projected development time of said change (30 months plus 12 months Craft Change Document development time) would not meet the projected FY17 GFE delivery dates as follows:

LCAC Installation 8 10/02/17* 29 10/02/17* 30 10/02/17* 10 11/01/17* 21 11/01/17* 9 12/01/17* 47 12/01/17*

Based on the aforementioned certification and compatibility requirements, SEKAI is the only source that can meet these immediate requirements, within acceptable cost and schedule thresholds, while ensuring craft compatibility. The cost associated with the effort to re-qualify a ruggedized display is estimated at $700,000, based upon previous efforts. This invested cost could not be recovered through competition.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

SOURCE SELECTION INFORMATION - SEE FAR 3.104

This proposed acquisition will synopsized from 03/15/2017 through 3/30/2017 in the Federal Business Opportunities as required by FAR 5.2.

7. Determination of Fair and Reasonable Costs

The Contracting Officer will determine that the anticipated prices to the Government for the supplies/services covered by the J&A will be fair and reasonable.

8. Actions to Remove Barriers to Competition

Due to significant engineering costs and long lead time for development described under paragraph 5 above, there are no actions taken by the LCAC program to remove the barrier to competition.
